Subject: - Show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for violations of its provisions. Ref:- Your application no. 21149352, 21149288 dated 22.02.2023. Whereas, it is obligatory on the part of the industry to obtain the consent to establish (NOC) u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 and u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 before establishing / expansion of the industry. And whereas, it is mandatory as the part of industry to install proper and adequate pollution device to ensure that concentration of various pollutants in emission/discharge to be discharged by industry confirm to the standards prescribed by the Board/MoEF under Environment (Protection) Act, 1986. And whereas, the industry is a Brick Kiln and it has applied for obtaining consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981. And whereas, the industry was visited by AEE of this office on 14.03.2023 and it was observed as under: - 1. The brick kiln was in operation during the visit. 2. The brick kiln is using coal as fuel but at the time of visit the used tyre/tubes were found stored within its premises which reflect brick kiln may be use it as fuel. The representative of the brick kiln informed that they are using same as initial firing in the kiln. 3. The brick kiln has not provided adequate septic tanks for domestic effluent of its labour quarters. 4. The brick kiln has not provided the plantation along its boundary wall. 5. The brick kiln has not stabilized its inroads and dust is being generated through movements of vehicles. 6. The brick kiln has not uploaded the copies of previous consents, nor it has submitted proof of its date of commissioning. Also, the date of closure of M/s Billa Brick Traders is not known through any proof as such the fee of the brick kiln could not be ad-judged. 7. The brick kiln has applied for fresh consent to operate, it is required to submit the fresh siting criteria report for the establishment of brick kilns as per Board’s office order no. 3 dated 02.09.1998. And whereas, the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. And whereas, it has now been proposed to refuse the consent to operate of the industry for the violations of the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause. You are, hereby, given an opportunity to file reply and objections, if any, through this notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 before the Environmental Engineer, in Regional office-2 at Midland Financial Centre, Second Floor, Opp. King Hotel, Near Bus Stand, Jalandhar, within 10 days failing which it will presumed that industry has nothing to say and the Board shall go ahead to take the proposed action without giving any further notice/opportunity. |
