Subject: - Reply to Show Cause Notice no. 858 dated 13/03/2024 for refusal of consent to operate under the Air (prevention & Control of Pollution) Act, 1981. (24828724).
Sir,
We would like to bring to your kind notice that we are not violating any provisions of the Air (prevention & Control of Pollution) Act, 1981 as our project is not operational, we had obtained completion certificate from the competent authority in 2014.
Because of severe market downfall, financial constraints and covid, the leasing of the mall could not happen and hence the operation of the mall could not happen on time.
After installing all proper pollution control devices, we had obtained consents under Air & Water category and the same are being regularized/extended well in time along with the requisite fees.
Reply to the observations of your visit date 08/02/2024 are as under.
1. The unit is duly approved Shopping Mall.
2. The unit has duly informed to the Board in written that the mall is not operational.
3. As far as your office visit dated 08/02/2024 is concerned, it is matter of record that the Mall is not operational hence installed 02 no. of D.G. sets of capacity 1000 KVA each. are also not in use. it was witnessed by the visiting official as well during his visit. We assure and undertake through this communication that whenever the mall starts its operations activity, D.G. sets will be fitted with canopy and the area of D.G. sets will be provided with acoustic materials well in advance before its operations.
It is therefore humbly submitted that the shopping mall is not operational and installed D.G. sets are also lying non-operative, we also undertake to provide canopy and acoustic well before its operations. It is therefore evident that there is no violation of the Air (prevention & Control of Pollution) Act, 1981.
We also undertake to inform the Board about the operations activity of Mall well before three months’ time along with the site and DG area photographs showing the desired work as directed by Board has been completed.
It is further requested to kindly grant us extension up to the paid requisite fees as requested.
