It is intimated that the subject cited industry as afforded personal hearing before the Worthy Chairperson of the Board on 26.02.2026, in reference to Notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act 1974 & u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981. The proceedings of the personal hearing dated 26/02/2026 were issued vide Zonal Office, Amritsar letter no. 902 dated 06/03/2026 wherein following decisions were taken:-
15. The industry shall ensure to operate its APCD and ETP regularly and efficiently so as to achieve the prescribed standards of the Board. The industry shall maintain proper record of ETP & APCD operation.
16. The industry shall ensure to operate all the component of its ETP and ensure that no component of ETP is Bye passed. The industry shall also ensure to provide water meter on the ETP outlet and shall maintain proper record of ETP operation.
17. The industry shall ensure to provide adequate plantation in the plantation area. The industry shall increase its plantation area and shall ensure that no stagnation of treated effluent be observed.
18. The industry shall install piezometers at upstream and downstream locations so that groundwater sampling is carried out as per the prescribed norms within one month.
19. The industry shall make a comprehensive proposal for fly ash utilization in scientific manner and shall explore the possibilities for its reuse by the brick kilns owners, road filling by NHAI / PWD / other departments, cement industry and other establishments and submit the same to the Board, within one month. The industry shall ensure proper sprinkler system and scientific disposal of its fly ash and maintain daily record of fly ash disposal and submit the same In the Regional Office by every 5th of the month.
20. The industry shall ensure ODAMS (Online Data Acquisition and Management System) provided with ETP / APCD is connected to CPCB server and is operational all the time. The industry will ensure that the OCEMS are connected with the PPCB / CPCB server & dashboard.
21. The industry shall ensure to install CCTV cameras facing the components of ETP, APCD, fuel feeding point, OCEMS (parameter display and probe) and shall connect to PPCB server & Dash Board.
22. The industry shall ensure mechanised feeding of fuel is carried out in all time to come. The industry shall ensure that only authorized fuel is utilized in the boiler furnace. The industry shall make all the efforts to avoid wetting of fuel including proper storage/ covers while storing in its premises.
23. The industry shall operate its Decanters regularly and maintain proper record of ETP sludge, press mud and other hazardous waste. The Industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 within 15-days.
24. The industry shall apply for renewal of consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 7 days.
25. The industry shall strictly comply with the directions Issued by Central Pollution Control Board u/s 18(1)(b) of the Water Act 1974 to the sugar mills vide Board letter no.3817 dated 29.11.2022 that:-
V. All the Units must ensure continuous running of ETPs even during the non-crushing season for the adequate maintenance of required bio-mass so that the ETP is able to take the load/shock when it receives the pollution load/effluent at the start of the crushing season.
VI. All the Units must provide for separate Energy Meter for entire ETP setup including its accessory units with data logging facility which shall be inspected by PPCB and CPCB from time to time.
VII. All the units must ensure Interlocking of Pollution Control Devices with production processes (one way but not vice-versa) so as to ensure that whenever ETPs/PCDs are intentionally closed, the production also comes to halt.
VIII. If the unit falls in the critical zone, an assessment of water recharge needs to be carried out by Central Ground Water Authority (CGWA) or Punjab Water Regulation and Development Authority (PWRDA)before issuance of NOC, with respect to ground water withdrawal.
26. The industry shall comply with the conditions mentioned in the Environmental Clearance granted to it in true letter and spirit.
27. The Managing Director, Sugar Fed be appraised regarding the Environmental Compliances required to be made by the Sugar mill with request to direct the Concerned General Manager of the Sugar mill to make compliance in time bound manner.
28. Senior Environmental Engineer, to whom 17-category/ Large (Red) industries are assigned for surprise visit (of Amritsar zone) vide order no.55 dated 18.02.2026, shall visit the industry within 10-days, verify the compliance made by the industry, shall carry out monitoring of the industry and send the report/recommendations accordingly.
It is further intimated that the industry was again visited by Er. Vijay Kumar, Senior Environmental Engineer along with Er. Amit Kumar, Environmental Engineer on 10/03/2026 in compliance to Board’s order no. 55 dated 18.02.2026 and observed as under:-
16. The industry was in operation and representative of the industry informed that the season was going to be over in 1-2 days.
17. The ETP installed by the industry was in operation. The flow rate at outlet of ETP during visit was 83.2 m3/hr and Totalizer reading was 7761.70 m3.
18. The industry has commissioned its decanter as observed during the visit.
19. Effluent was seen stagnated near the ETP and effluent samples were collected from the outlet of ETP as well as from the stagnation same have been sent to Zonal lab Jalandhar for analysis.
20. The industry has maintained the record for operation of the ETP except power consumption/ Energy Meter reading as it has yet to install separate energy meter for ETP.
21. The industry has installed online meters indicating the value for pH as 7.35, BOD as 25.26 mg/l, COD as 124.52 mg/l and TSS as 52.55.
22. The industry has not constructed proper storage area for storage of sludge.
23. The industry has plantation area of around 7.5 acres out of which plants in approx. 2.5 acres are already dead. The plantation area is not adequate for discharge of treated effluent around 1000 Kl/d. Some pockets in plantation area were seen stagnated and some were dry due to improper distribution of treated effluent.
24. The industry has installed SPM meter over its stack of Bagasse fired Boiler of capacity 145TPH but the same is yet to be commissioned. The representative of the industry informed that the same shall be commissioned the coming off period.
25. No separate Energy meter has been installed at APCD hence no record is maintained.
26. A lot of bagasse was seen scattered in the premises around Bagasse handling and Boiler feed area. Housekeeping was very poor.
27. No black smoke was observed and the stack was almost clear during visit.
28. The industry has installed Three Field ESP as APCD which was in operation. Stack emission sample was collected during the visit and the same has been sent to Zonal lab Jalandhar for analysis.
29. The industry is disposing off its ash generated from the boiler in the low lying area with in premises.
30. The industry has not obtained the authorization for cat 5.1 under 1st schedule of HWM Rules, 2016.
Emission/effluent samples analysis report has been received from Zonal Lab, Jalandhar issued vide letter no. 444-46 dated 30/03/2026 & no. 353-56 dated 20/03/2026 respectively. As per analysis report of emission samples, the concentration of Particulate matter is 142 mg/Nm3 and results of the parameters at the outlet of the ETP are pH @ 7.2, TSS @ 36 mg/l, TDS @ 809 mg/l, BOD @ 12 mg/l, O&G @ BDL, MLSS @ 5460 mg/l & MLVSS @ 3930 mg/l & results of the effluent collected near inlet of the ETP from stagnation are pH @ 2.4, TSS @ 87 mg/l, TDS @ 1862 mg/l, BOD @ 418 mg/l. As above the results of the parameters of air emission & effluent at the outlet of the ETP are within the limit, however results of the effluent collected near inlet of the ETP from stagnation are not achieving the standards as prescribed by the Board.
As the industry found non-complying during the visit of officers of the Board on dated 10/03/2026 and non-complying with the decisions of the personal hearing. Accordingly, show cause notice for violation of conditions of consent to operate granted under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and violation of Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 has been issued vide Zonal Office, Amritsar letter no. 1344-45 dated 20/04/2026 to file objections, in writing, within 15-days from the issuance of this show cause notice.
