File Note: It is submitted that the industry was given personal hearing by the worthy Chairman of the Board on 19/02/2020 (kindly peruse note dated 09/03/2020 in the note history) and it was decided as under; 1. The industry shall deposit Environmental Compensation amounting to Rs. 21,30,000/- for the violation made by it under Water (Prevention and Control of Pollution) Act, 1974 with Environmental Engineer, Regional Office, SAS Nagar, within 7 days 2. Environmental Engineer, Regional Office, SAS Nagar will visit the industry to verify the submissions made by it in its reply, process the online consent cases submitted by the industry on merits. Further, Environmental Engineer, Regional Office, SAS Nagar shall submit the detailed report/recommendations, within 7 days. 3. It was made clear to the representative during the hearing that if the submissions made by the industry during the hearing found incorrect, then directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 be confirmed for the closure without giving any further notice/opportunity. 4. Further action in the matter will be taken after the receipt of report from Environmental Engineer, Regional Office, SAS Nagar. The proceedings of the aforesaid personal hearing were conveyed to the industry as well as RO vide this office letter no. 1410-11 dated 09/03/2020 for compliance. As per decision of personal hearing, the industry was visited by the officer of RO on 18/03/2020 and was not in operation. The industry was found complying except that the components of STP has been arrived at site. The industry has developed plantation appox 1944 Square meter to dispose of the domestic/ treated trade effluent & now, appox. 1440 Square meter plantation/gardening area was under development within the factory premises. The industry has still not installed the APCD to control the Acid/Mist emissions from phosphating section, as per condition of the NOC. The industry has submitted the electric bill vide which the electric connection was released on 17/07/2018 to the industry.The industry has not submitted the analysis report of treated trade effluent.The industry was requested to deposit Rs. 21,30,000/- as Environmental Compensation as per decision of personal hearing dated 19/02/2020 through clarification dated 12/03/2020 and also through offline vide Regional Office letter No. 1651 dated 16/03/2020, but industry has failed to deposit the Environmental Compensation. Keeping in view of the above, EE, RO, SAS Nagar has recommended that consent applied by the industry under the Air (Prevention & Control of Pollution) Act, 1981 may be refused. Now, the industry has submitted a request letter that they are a company based , having registered office and based out of Madhya Pradesh. The industry is supplier of Chassis Long member Frame to SML Isuzu Ltd, who have their plant near Roopnagar, Punjab.Therefore, it was decided to set up a plant in Punjab , to serve costomer in a better manner. The industry has received utmost help and support from Punjab Invest, and all concerned departments in this endeavour. In compliance to the Consent to Establish , the industry has set up an Effluent treatment plant , and all necessary pollution control equipments. The equipment was set up as per experience and requisites of pollution control Act applicable in MP. The Painting , PT , CED plant is in trial stage, and prove out is going on. During the site inspection of the Regional Office on 10/01/2020, certain anomalies were found. The anomalies were immediately rectified , and counter actions were taken. In the order of the Honourable Chairman , the industry has been levied Environmental Compensation (EC) for 142 days. However since the industry is yet in the prove out / trial stage , hence EC should be levied for a period starting from 10/1/2020 till rectification of anomalies.The anomalies, were out of ignorance , and not on purpose, or to save cost at the expense of environment. The industry has requested to consider the plea on basis of above and recalculate the environmental compensation. In this regard, it is submitted that the industry was found not in operation during the visit to the industry on 18/03/2020 and is still not fully complying as reported by RO after verifying the compliance.
