File Note: It is intimated that the BKO was granted consent to operate under Air Act, 1981 vide no. CTOA/Renewal/NWS/2016/4735185 dated 01.11.2016, which was valid upto 30.09.2026. Now the BKO has applied for obtaining varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 through OCMMS. The industry has already deposited Rs. 16875/- vide receipt No. 53/4325 dated 25.10.2016 as Air consent fee and now deposited Rs. 9000/- vide cheque no. 342971 dated 05.10.2020 under Air Act, Rs. 500/- vide cheque no. 342973 dated 05.10.2020 as an application form fee, Rs. 1800/- vide cheque no. 598983 dated 05.10.2020 as NOC regularization fee and Rs. 12600/- vide chqeue no. 342974 dated 05.10.2020 under Water Act fee. The fee deposited by the industry is adequate upto 30.09.2025. The brick kiln was visited by officer of this office on 06.10.2020 and it was observed as under: 1. The kiln was not in operation during visit. 2. The kiln has provided a induced draft technology with zig-zag firing and submitted completion certificate issued by M/s PSCST,Chandigarh vide no. 1121 dated 27.02.2019 regarding installation of Induced draft zig zag technology. The BKO has submitted a copy of coal register authenticated by CA mentioning that the BKO had no run in 01.02.2019 to 28.02.2019. 3. The BKO is discharging its D.E. onto land for plantation after passing through septic tank. 4. The kiln is complying with code of practices laid down for such type of units.. It is pertinent to mention here that Punjab Pollution Control Board vide office order SEE(HQ-2)/2018/606 dated 18.12.2018 has issued directions as under: 1. The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category – I) 2. The brick kilns which have adopted induced / high draft zig-zag technology but yet to obtain the completion / adequacy certificate from Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board OR to whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab, (Category – II). 3. The consent to operate to above brick kiln owners / brick kiln shall be granted with the following special condition:- a. Regular consent shall be granted to Category – I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above. b. The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. c. The consent is subject to the performance evaluation of new technology adopted by the brick kilns Recommendations Keeping in view of the above, if approved, consent to operate under the Air Act and Water Act, 1974 may be granted upto 30.09.2025 to the brick kiln under orange category as the brick kiln falls in category-1 subject to the suitable conditions along with following special conditions that: a. The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. b. The consent is subject to the performance evaluation of new technology adopted by the brick kilns. c. The kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report. d. The brick kiln will pave the movement area around kiln with Bricks within 03 months. e. The brick kiln shall not use of pet coke as fuel in its brick kiln. f. The BKO will comply with the directions u/s 18 (1) (b) of the Air (Prevention & Control of Pollution) Act, 1981 issued by CPCB. g. The BKO will submit building plan approved by Competent Authority within 03 months. h. The consent to operate granted under Air Act, 1981 vide no. CTOA/Renewal/NWS/2016/4735185 dated 01.11.2016 is hereby cancelled.
