The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 vide nos. CTOW/Varied/BTI/2019/11297066 & CTOA/Varied/BTI/2019/11296868 dt. 26.09.2019, both valid upto 30.09.2020 for operation of rice Sheller unit of capacity 2 TPH of Raw rice/sorted rice with dryer, subject to the conditions mentioned therein.
Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 & Air Act, 1981 through OCMMS for operation of rice sheller unit to produce 2 TPH of Raw rice / sorted rice with dryer under orange category. The detail of the case is as under:
- The industry has already deposited consent fee as Water Act:- Rs. 14,500/- vide R. No. 67/5052 dated 08.07.2019 & Air Act : Rs. 14,500/- vide R. No. 68/5052 dated 08.07.2019 To make it adequate upto 31.03.2023 as per the Board's office order dated 29.10.2018
It is submitted that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.
The industry was lastly visited by officer of this office on 24.09.2019 and it was observed that the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
It is submitted that condition was imposed in the CTO issued to the industry that the industry shall comply with the air emission discharge standards prescribed by MoEF by notification no. GSR 152 (E) dated 16.03.2012. The Board has not notified these standards and the industry is complying with the emission standards of 750 mg/NM3 as notified vide notification dated 15.10.2013.
Keeping in view of above, it is recommended that the validity of consents to operate granted to the industry under the Water Act, 1974 & Air Act, 1981 may be extended to the industry for operation of rice sheller unit of capacity 2 TPH of Raw rice / sorted rice with dryer for a period upto 30.09.2021, subject to the suitable conditions and specific conditions as under:-
1. The industry will get its emission sample analyze from all stacks of installed by it in the coming paddy season i.e. 2020-21 and submit report to this office.
2. The industry shall be bound to install bag house filter/upgrade its APCD as and when asked by the Board. |
