A. It is intimated that the industry was granted consent vide no R15LDH4CTOW3203665 dated 28.10.2015 valid upto 30.06.2020 under Water Act, 1974……..
B. The industry was visited by AEE of this office on 17.07.2020 & observed violations during the visit. Directions u/s 33-A of the Water Act, 1974 were issued for disconnection of power supply of the industry……………
C. Thereafter, the industry applied for renewal of consents to operate under Water Act, 1974 and Air Act, 1981 on 28.08.2020 with written request that the industry is facing acute financial crunch due to the COVID-19 situation and the industry may not be able to revive after disconnection of electric supply………….
D. Thereafter, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2020/13584475 dated 16.09.2020, valid upto 15.11.2020 with restoration of electric connection temporarily for 02 months with special conditions that:-
1. The industry shall not exceed its discharge @ 150 KLD.
2. The industry shall apply for NOC for expansion for discharge of effluent @300 KLD within 15 days.
3. The industry shall remove the pipe provided for bye-passing the effluent by excavating the floor, within 10 days…………
E. The industry was visited by a surprise team on 20.09.2020. The team reported that during the visit, manholes near the dyeing cluster of Phase-VIII, Focal Point, Ludhiana and the industries located at the upstream of the manhole, wherein coloured effluent was observed were also inspected………..
F. The team further reported that while carrying out the above exercise, brown coloured waste water was observed flowing in the sewer manhole located in front of the subject cited industry………..
G. Accordingly, the subject cited industry was visited by the team. During the visit the team collected effluent samples from the outlet of the ETP installed by the industry. As per analysis report received from the lab, parameters (TDS 2284 mg/l), (COD 256 mg/l), (BOD 65 mg/l) and (O&G 11.8 mg/l) were beyond the prescribed limits. It is worth mentioning here that expect BOD all the other three parameters were only marginally beyond the prescribed limits……….
H. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued for closure of the industry and for disconnection of the electric connection available to the industry……….
I. In compliance of the directions issued by the Competent Authority, the electric supply available to the industry has been disconnected by PSPCL authorities vide TDCO no. 129/57 dated 08.10.2020 which was verified by the undersigned on 12.10.2020. Also, the polluting machinery along with D.G. set were sealed by the undersigned on 12.10.2020 in the presence of representative of the industry………..
J. Thereafter, the industry has submitted a representation mentioning that:-
“It is requested that we are running our industry under the name & style of M/s Nav Durga Dyeing House, Phase-8, Focal Point, Ludhiana. Our electric connection was disconnected on 28.08.2020 and was restored on 18.09.2020. We started industry process on 20.08.2020 at 09:00 Am and on the same day officers of PPCB visited our industry at 11:00 AM to collect samples. Our factory was closed for 20-25 days and ETP was not properly stabilized and some short comings were found in the sample. I was not present in the industry that day as my father-in-law had expired and I had gone to Mandi Gobindgarh to attend the Bhog Ceremony. The keys of the office were with me and as such the workers could not produce the records to the visiting team. As such, orders for disconnection of our electricity supply were issued and machines were sealed by the Board. Sir, you know that due to COVID-19 lockdown, the industries remained closed for 03 months and we suffered huge financial loss. Further, due to the death of my father-in-law, are family is aggrieved. We request your good-self to give us a chance to correct our mistake and are electricity connection be restored and machinery be de-sealed, please. We will abide by the pollution control norms in future…………...
K. As per the study carried out by GNE the discharge was estimated to be 260 KLD, which is slightly on the higher side and the industry has consent for discharge effluent @150 KLD. The industry has purchased shares of 300 KLD in the CETP 40 MLD being constructed by the PDA (Focal Point Module)…………….
L. The industry was visited by the undersigned along with EE and it was observed that the industry has carried out repair of the tube settler by cleaning its tubes and had painted the components of the ETP…………….
M. The competent authority of the Board considered the request of the industry and restoration of electric connection along-with de-sealing of machines was allowed upto 31.03.2021 after deposition of EC of 1.0 lac by the industry. The Competent Authority also decided that It may be made clear to the industry that in case of any violation observed in this period, the industry will be closed without any prior notice. Also, the effluent generation, adequacy of ETP may be audited wrt production by an audit team within 2 months and report be obtained for further necessary action.
N. It is further submitted that while allowing the restoration, the Competent Authority imposed interim EC of Rs. 1,00,000/- along with special condition that the industry will be audited w.r.t. production capacity, effluent generation, ETP capacity and performance by a team to be constituted by the Board within 03 months. In case of any non-compliance by the industry, directions will be given for closure and disconnection without any opportunity of hearing by the Board.…… In compliance to the decisions of the Competent Authority the industry has deposited Environmental Compensation of Rs. 1,00,000/- and accordingly electric connection was restored upto 31.03.2021. The matter regarding constitution of surprise team is under consideration of the higher authorities.
O. It is submitted that the industry has not submitted any reply to the notice issued for imposition of Environmental Compensation for violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974…….
P. This office has requested Sh. S.S. Matharu, Environmental Engineer for calculation of Environmental Compensation vide e-mail dated 17.11.2020……..
Q. It is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be granted to the industry upto 31.03.2021 with special condition that the industry shall submit Environmental Compensation if, when and as imposed by the Board.
