Online agenda is generated, the detail of the case are as under : -
The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 vide nos. CTOW/Renewal/MNS/2020/12060961 & CTOA/Renewal/MNS/2020/12060928 dt. 24.01.2020, both valid upto 30.09.2025 for operation of rice sheller unit of capacity 21 TPD of Raw rice/sorted rice without dryer, subject to the conditions mentioned therein.
Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 & Air Act, 1981 through OCMMS for operation of rice sheller unit to produce 21 TPD of Raw rice / sorted rice without dryer under orange category.
The details of the case is as under: -
The industry has already deposited consent fee of Rs. 20,400/- each under the Water Act, 1974 & Air Act, 1981 through online vide JAKA200116065392 & JAKA200116065114 which are adequate upto 30.09.2025 against fixed assets of Rs. 66.01 as per the CA certificate dated 27.09.2021. The increase in the C.A. is due to replacement and repair of machine parts and has deposited Rs. 700/- vide online UTR No. NEFTSDC16979740 dated 04.10.2021 as NOC regularization fees.
The industry has applied for renewal as the proprietor has changed due to death of earlier proprietor. The industry has submitted the death certificate as well as descendent certificate (varies certificate) from revenue authorities to certify that the rice sheller has been transferred in the name of son (Sh. Ashish Garg) of the earlier proprietor (Late Sh. Raj Kumar).
It is submitted that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.
The industry was lastly visited by AEE of this office on 27.12.2019 and it was observed that the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
It is submitted that condition was imposed in the CTO issued to the industry that the industry shall comply with the air emission discharge standards prescribed by MoEF by notification no. GSR 152 (E) dated 16.03.2012. The Board has not notified these standards and the industry is complying with the emission standards of 750 mg/NM3 as notified vide notification dated 15.10.2013.
Keeping in view of above, it is recommended that the validity of consents to operate granted to the industry under the Water Act, 1974 & Air Act, 1981 may be extended to the industry for operation of rice sheller unit of capacity 21 TPD of Raw rice / sorted rice without dryer for a period upto 30.09.2025, subject to the suitable conditions along with special condition that the rice sheller will get its air emission sample analyzed by Board's lab/Board's approved lab in coming paddy season 2021-22.
