Kindly find attached the detailed inspection report along with agenda note. Further observations are asunder:- It is submitted that earlier the industry was visited by officer of this office surprisingly on 12/07/2022 and accordingly action under the provisions of the Plastic Waste Management Rules, 2016 has been recommended to the competent authority of the Board. Accordingly, directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued by the competent authority of the Board vide No. 2515-16 dated 28/07/2022 as under:- “That the industry shall not manufacture Single Use Plastic items and the plant & machinery installed by the industry meant for manufacturing of Single Use Plastic (SUP) items shall be sealed immediately.” Now, the industry has applied for obtaining consent to operate under Air (Prevention & Control of Pollution) Act, 1981, under Orange Category through OCMMS with required documents for manufacturing of Packing Material HM @ 400 Kgs/day, Packing Material LD @ 100 Kgs/day & Packing Material PP @ 400 Kgs/day by using Packaging Material Mix @ 900 Kgs/day as Raw Materials. The industry is also engaged in manufacturing of Paper Cups @ 500 Kgs/day by using Paper Blank @ 400 Kgs/day & Bottom Paper Cup @ 100 Kgs/day as Raw Materials. The industry has submitted latest CA Certificate, site plan, land documents, partnership deed, SSI certificate & request letter etc.           The site of the industry was visited by officer of this office on 09/08/2022 and observed that:- 1.    The industry was in operation. 2.    The industry is engaged in the manufacturing of Packing Material HM @ 400 Kgs/day, Packing Material LD @ 100 Kgs/day & Packing Material PP @ 400 Kgs/day by using Packaging Material Mix @ 900 Kgs/day as Raw Materials. 3.    The industry has installed 03 no. machines to manufacture industrial packing material. 4.    The industry is also engaged in manufacturing of Paper Cups @ 500 Kgs/day by using Paper Blank @ 400 Kgs/day & Bottom Paper Cup @ 100 Kgs/day as Raw Materials. 5.    The industry has also installed 05 no. machines to manufacture paper cups. 6.    The industry has not installed any DG set inside the premises of the industry. 7.    During the visit as directed by the Competent Authority of the Board 03 no. machines meant for manufacturing of SUP i.e. plastic cups were sealed in presence of Sh. Ashwani Kumar, Partner.           It is further intimated that the industry is now complying with the provisions of Water Act, 1974 and Air Act, 1981 and SOPs framed for plastic industries. Further, the industry has stop manufacturing any item falling under the single use plastic ban. The industry falls in Orange category in the small scale sector and competency to decide the case lies with Senior Environmental Engineer of the Board.           Keeping in view of above, may if approved, the Consent to operate under Water Act, 1974 and Air Act, 1981 be granted to the industry up to 30/09/2027 with suitable conditions along with special conditions that:- 1)   The industry will comply with the SOPs framed for the Plastic industries by the CPCB. 2)   The industry will not manufacture any item falling under the single use plastic ban. 3)   The industry shall not manufacture and sell commercially any compostable or biodegradable plastic item without first getting registration from CPCB.
