It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/BAR/2020/13831538 dated 22/09/20220 and the Air Act, 1981 vide no. CTOA/Renewal/BAR/2021/16074325 dated 29/06/2021, both valid upto 30/09/2025, for manufacturing of Raw Rice (without Sortex Machinery and without Dryer) @ 5.0 TPH by processing of Paddy @ 7.50 TPH, as raw material under orange category under the name & style of M/s Mahesh Rice Mills, Rajgarh Road, Dhanaula, Tehsil and District Barnala.                 The rice sheller has submitted an affidavit dated 22/07/2022 signed by Sh. Harsewak Lal, Sh. Hargobind Lal, Sh. Harjeevan Lal, Sh. Harsampat Lal S/o Narsingh Dass S/o Kulwant Rai r/o Dhanaula Smt. Lakshita D/o Swaran Rekha w/o Sh. Rameshwar Dass r/o Patiala and Sh. Gurdev Singh Dhillon s/o Sh. Bagga Singh s/o Partap Singh r/o Dhanaula and Sh. Jagdish Rai s/o Sh. Brij Lal s/o Sh. Shivji Dass urf Sibbu Mal r/o Dhanaula  and Deep Sikha D/o Swarn Rekha w/o Rameshwar Dass Urf Rameshwar Dass Garg (Deep Sikha w/o Raj Kumar s/o Harbans Lal r/o Kurkushetar) and Ashwani Kumar s/o Sh. Jagdish Rai S/o Sh. Brij Lal r/o Dhanaula  and director of M/s Mahesh Rice Mills, Rajgarh Road, Dhanaula, Tehsil and District Barnala to M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala. In that affidavit, it is mentioned that they have sold rice sheller to M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala, and they have no objection in transfer of consent to operate in the name of new owner i.e. Sh. Sourav Bansal s/o Sh. Balvinder Kumar.                 The industry has also submitted the new registered sale deed of the rice sheller in the name of M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala.                 The rice sheller has not changed in production capacity and has not added any new land, building and Plant & Machinery in its premises.                         Now, the industry has applied for fresh consent to operate under the Water Act, 1974 & varied consent to operate under the Air Act, 1981, for production of Raw Rice (without Sortex Machinery and without Dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category under the name & style of M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala.                  The industry has deposited Rs. 22400/- deposited through online vide UTR No. 648883317 dated 04/08/2022, which is adequate up to 30/09/2025 under the Water Act, 1974 & Rs. 9,500/- already deposited vide UTR No. AXSK202340008621 dated 21/08/2020, which is adequate upto 30/09/2023 under the Air Act, 1981 against the value of fixed assets of Rs. 83.98 lacs as per CA certificate dated 25.07.2022.                 The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has not changed in its production capacity. The industry has only sold to new firm and has applied in the name & style of M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala.                 It is pertinent to mention here that the Board vide Office Order No. 59 dated 09/08/2014 has decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site / premises of the industry, in order to facilitate the industry.                 It is further added here that the Board vide its letter no. SEE(HQ-II)2018/9982-10003 date 27/03/2018 as requested to strictly follow the consent validity criteria for grant of consents to red/orange/green categories industries for 05 years, 10 years & 15 years, respectively                 In view of above, it is recommended that fresh consent to operate granted under the Water Act, 1974 may be granted upto 30.09.2025 & under the Air Act, 1981 may be transferred upto 30.09.2023 for manufacturing of Raw Rice (without Sortex Machinery and without dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH under orange category under the name & style of M/s Boby Rice Mill, Rajgarh Road, Dhanaula, Tehsil and District Barnala, subject to certain conditions to be mentioned therein.
