<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Earlier, brick kiln was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide No. ROP/APC/2003/20 dated 30/04/2003, having valid upto 31/12/2016 for manufacturing of bricks @ 15,000 nos. /day. However, the said consent to operate was cancelled vide letter no. 5046 dated 03/09/2004 due to the failure of the brick kiln to use 25 % fly ash in the manufacturing of bricks. Also, a notice under section 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide no. 11600-01 dated 29/10/2004 to the industry for not using 25% of the fly ash for manufacturing of bricks. However, the Board vide letter no. EE(HQ)/2005/5225 dated 14/04/2005 addressed to the Director, food, civil supply and consumer affairs, Department Punjab, Chandigarh informed that the Board had decided that the already granted consents (which were refused for not utilizing fly ash @ 24% by weight to weight for manufacturing of bricks/tiles) were revived till the final decision of the Hon'ble Punjab & Haryana High Court.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and renewal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry was visited by this office on 02/03/2016 and it was observed that the industry was using pet coke as fuel along with crushed coal. The industry has not obtained permission for use of pet coke from the Board. The stack emission sampling of the brick kiln was carried out on 02/03/2016 and the analysis results are tabulated as under:</span></p>

The industry has not provided proper ladder and sampling arrangements on the stack of the brick kiln. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the brick kiln was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2017/5070222 dated 01.03.2017 which is valid upto 30.09.2023 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry was re-visited by AEE of this office on 17/02/2017 and it was observed that the brick kiln was not in operation; however, industry had stored a significant amount of pet coke in its premises, which shows that the industry uses the pet coke as fuel regularly.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry was issued Show Cause Notice vide this office letter no. 938 dated 03/03/2017 to reply within 15 days.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was issued show cause notice for the refusal of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 alongwith opportunity of personal hearing on 18.04.2017. However, no one from the industry came for the hearing on the said date and time. Also, the show cause notice send to the industry had received undelivered, which is not understandable as the letter was registered and the industry is a well established and old brick kiln. This officer had received an undertaking from the industry dated 07.04.2017, received on 02.05.2017 to the effect that the industry had stopped the using pet coke for brick kiln.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the brick kiln was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2017/5070169 dated 10.08.2017 which is valid 30.09.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">As per the directions on Head office, Patiala the Brick Kilns operating under the jurisdiction of Regional Office, SAS Nagar were surprisingly visited. The above brick kiln was visited by Er. Piyush Jindal AEE of this office on 13.06.2022. During the visit, it was observed as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln applied for consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the brick kiln was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/19067254 dated 04.07.2022 which is valid upto 30.09.2026 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/19067233 dated 04.07.2022 which is valid upto 30.09.2026 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the brick kiln has applied for obtaining further renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents which may kindly be perused.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry had deposited Rs. 20,900/- vide C.R. no. 64/4348 dated 16/09/2016 (Rs. 13,800/- under the Water Act, 1974, Rs. 6600/- under the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 500/- as the application form fee). The industry has also deposited Rs. 4500/- vide C.R. No. 55/4428 (Rs. 3600/- as consent fee under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 900/- on account of NOC regularization fee). There has been increase in the value of fixed assets from Rs. 4.13 lacs as on 31/03/1999 to Rs. 6.11 lacs as on 31/03/2016. The industry has submitted an undertaking to the effect that the value of the fixed assets is increased due to the installation of new pump and shed and there has been no increase in the production capacity of the industry due to such addition. The industry had deposited Rs. 11500/- vide UTR No. SDL106606619 dated 10.06.2022 under Water (Prevention & Control of Pollution) Act, 1974 including Rs. 500/- as FDF and Rs. 11000/- vide UTR No. SDL106607031 dated 10.06.2022 under Air (Prevention & Control of Pollution) Act, 1981.The fees are adequate till 31.12.2033. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">And, as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange & Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, as such, the Brick kiln unit covers under orange category.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be auto renewed upto 30.09.2031 subject to suitable conditions as per earlier consent granted and with the special condition to comply with the observation/ suggestions in the visit on 13.06.2022.</span></p>
