File Note: <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is submitted that the subject cited industry is a brick kiln and was granted consent to operate under the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. RO/PTA/APC/2001/F-73 dated 16/01/2001 having validity upto 15/07/2001, which was further extended upto 15/01/2016. The consents were granted for the production of bricks @ 15000 nos/day subject to certain terms and conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the said consent to operate was cancelled vide letter no. 5050 dated 03/09/2004 due to the failure of the brick kiln to use 25 % fly ash in the manufacturing of bricks. Also, a notice under section 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 was issued vide no. 11604-05 dated 29/10/2004 to the industry for not using 25% of the fly ash for manufacturing of bricks. However, the Board vide letter no. EE(HQ)/2005/5225 dated 14/04/2005 addressed to the Director, food, civil supply and consumer affairs, Department Punjab, Chandigarh informed that the Board had decided that the already granted consents (which were refused for not utilizing fly ash @ 24% by weight to weight for manufacturing of bricks/tiles) were revived till the final decision of the Hon'ble Punjab &amp; Haryana High Court.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the brick kiln had applied for fresh consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and renewal of consent to operate under Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was granted consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2017/5068414 dated 01.03.2017 which is valid upto 30.09.2022 and Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2017/5068390 dated 01.03.2017 which is valid upto 30.09.2022 subject to certain terms and conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was visited by Er. Piyush Jindal, AEE of this office on 13.06.2022. During the visit, it was observed as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was in operation during the visit.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was complying with the code of practice for such type of units. </span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln has adopted the zig-zag induced draft technology. </span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was advised to provide more green area during upcoming monsoon season.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln was advised to spread more brick bate/ keri in the movement area &amp; to increase sprinkle water of the carriage way of the Kiln.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln applied for renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the brick kiln was granted renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/19081005 04.07.2022 which is valid upto 30.09.2026 and Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/19080984 dated 04.07.2022 which is valid upto 30.09.2026 subject to certain terms and conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the brick kiln has applied for further renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 alongwith requisite documents which may kindly be perused.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The BKO had deposited Rs. 51800/-(Rs. 43800/- under Water (Prevention &amp; Control of Pollution) Act, 1974, Rs. 7500/- under the Air (Prevention &amp; Control of Pollution) Act, 1981 and Rs. 500/- as application form fee) vide R. No. 96/4169 dated 13/06/2016. The industry has also deposited Rs. 9600/- vide C.R. No. 56/4428 dated 16/02/2017 (Rs. 7200/- as consent fee under the Air (Prevention &amp; Control of Pollution) Act, 1981 and Rs. 2400/- on account of NOC regularization fee). The brick kiln had deposited Rs. 18500/- vide R. No. 348265642 dated 22.06.2022 under Water (Prevention &amp; Control of Pollution) Act, 1974 including Rs. 500/- as FDF and Rs. 18000/- vide R. No. 491211332 dated 22.06.2022 under Air (Prevention &amp; Control of Pollution) Act, 1981. The total fee deposited by the brick kiln is adequate upto 30.06.2032 as per latest CA certificate Rs. 16.22 lacs on 31.03.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The brick kiln has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">And, as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange &amp; Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; the Air (Prevention &amp; Control of Pollution) Act, 1981, as such, the Brick kiln unit covers under orange category.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 may be auto renewed upto 30.09.2031 subject to suitable conditions as earlier consent granted and with the special condition to comply with the observation/ suggestions in the visit on 13.06.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-family: 'Tahoma','sans-serif';">*Competency &ndash; Environmental Engineer as per policy of the Board.</span></strong></p>
