<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the project was surprisingly visited by officer of the Board on 26.05.2021. During the visit, it was observed as under:</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l5 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has started establishing its commercial project without obtaining the prior NOC of the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The above violation was recommended to the Competent Authority of the Board through E-office file no. E-71119 dated 31.05.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing on 24/8/2021 before the Senior Environmental Engineer (ZP-1) vide Board’s letter no. 4527-28 dated 09.08.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent was given personal hearing before the Senior Environmental Engineer of the Board on 24.08.2021, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry shall apply consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 within 15-days through OCMMS.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry to verify the compliances, give comments/ recommendations with respect to the industry statement/ claim of the industry. He is also further requested to process the applications on merits to be submitted by the industry.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the above project was visited on 16.11.2021 and observed that the civil construction work of the commercial project is almost complete and finishing work is under progress. As physically observed, the total built up area of the project is more than 20000 sqm thus the project is covered under EIA Notification dated 14.09.2006. The project proponent failed to obtain consent to establish (NOC) as well as consent to operate of the Board which is also in violation to the condition no. 1 of the personal hearing dated 25.08.2021. Further, action u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 and u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was recommended.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was issued notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 alongwith an opportunity to submit the reply within 15-days vide Board’s letter no. 848-50 dated 27/1/2022. The project proponent neither applied for consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 nor submitted reply to the notice issued to the project proponent.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent applied for obtaining fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was returned due to certain observations mentioned as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent again applied for obtaining consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was returned being incomplete.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the project proponent was re-visited by AEE of this office on 12.07.2022. During the visit, it was observed as under:</span></p>

E-71119 and same is under process at Zonal Office-I, Patiala.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the project proponent has again re-applied for obtaining consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the development of <span style="mso-spacerun: yes;"> </span>Commercial plots @ 74 plots.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had earlier deposited Rs. 58900/- vide UTR No. P279210130981414 dated 06.10.2021, Rs. 84600/- vide UTR No. P010220147380497 dated 10.01.2022 as NOC fee. The project proponent has not submitted any detail regarding date of start of construction so the fee deposited by the project proponent could not be adjudged.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted provisional certificate issued vide no. About 55 KLD wastewater will we generated from the project after full occupancy which will be treated in proposed STP of capacity 60 KLD based on MBBR technology. </em></strong>The treated waste water @ 31 KLD shall be reused (Wastewater being / to be recycled with or without treatment)<span style="mso-spacerun: yes;"> </span>and @ 23 KLD shall be partially used / discharge onto land for plantation @ 0.19 acres and partially into sewer.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted site plan approved by Competent Authority. The project proponent needs to submit detail of plantation area duly marked on approved site plan. The project proponent needs to submit detail regarding built up area.</span></p>

(iii) i.e. M.C. Zirakpur be directed not to approve new project plans till necessary infrastructure like sewer / STPs/ disposal mechanism is not put in place with copy to PSLG. The project proponent needs to arrange additional land for the disposal of treated effluent. Moreover, present STP of MC, Zirakpur is under capacity and is not adequate to handle the additional effluent load of such projects. T</span><span style="font-family: 'Tahoma','sans-serif';">he project proponent needs to install mechanical composter being a bulk waste generator.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is </span><span style="font-family: 'Tahoma','sans-serif';">relevant to mention here </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">that the Board vide letter no. SEE(HQ-2)/2022/F.No.82 dated 11.03.2022 has intimated that it has been observed that while filing application for Environment Clearance under EIA notification, 2006, the project proponents proposed to discharge their effluents into public sewer. AT times, the capacity of the STP is not adequate to handle the additional effluents load of such project. For instance, cities like Zirakpur and Kharar have treatment capacity much below the present effluent generation. Despite this, the MCs of these cities are giving NOCs for allowing the outlet of new projects to their sewer. In absence of environmentally sound disposal arrangements, untreated or partial treated effluent is being bypassed from these STPs causing serious environmental damages. In absence of sustainable disposal arrangements, the project proponents, resort to unhealthy practices, like disposal of effluents into the bore wells or for stagnation or to unknown places / drains / roadside / ponds through mobile tankers etc. Further requested State Level Environment Impact Assessment Authority that the Environment Clearance may not be granted for disposal of effluent into public sewer in case the city STPs have not adequate capacity to handle the additional wastewater from such new / expansion projects. There project proponents shall be advised to provide concrete proof for alternate modes of disposal like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">It is appropriate to mention here that the project / construction of showrooms is being done/ constructed in the same symmetry on all the plots. The project proponent confirmed that they have sold commercial plots to the purchasers and they are constructing themselves. The project proponent needs to ensure that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo6;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated14/09/2006.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be decided in light of the above facts after decision in the notice to issue directions issued by Competent Authority please.</span></p> |
