<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is intimated that the industry started its operations at the site without obtaining prior consent to operate/consent to establish of the Board and accordingly the industry was afforded an opportunity of personal hearing before worthy Senior Environmental Engineer of the Board on 05/05/2017, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry shall remove the incompletions pointed out by the Board complete in all respects within 15 days under intimation to this office as well as Regional Office, SAS Nagar.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Environmental Engineer, Regional Office, SAS Nagar visit the industry immediately after 15 days to verify the compliances made by the industry and thereafter, process the consent applications on merits.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2017/6770056 dated 08.12.2017 which was valid upto 30.06.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry had applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and same was returned due to certain observations mentioned as under:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 45.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><strong><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span style="font-family: 'Tahoma','sans-serif';">CA certificate submitted by the industry is not proper i.e. the industry needs to submit un-depreciated value of fixed assets as on 31.03.2022 under three heads i.e. Land & Building, Plant & Machinery and Other fixed assets.</span></em></strong></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 45.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><strong><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span style="font-family: 'Tahoma','sans-serif';">The compliance report submitted by the industry is not proper i.e. most of the conditions noted & agreed as written and no supporting documents submitted by the industry.</span></em></strong></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 45.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><strong><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span style="font-family: 'Tahoma','sans-serif';">The industry also needs to apply authorization under Hazardous & Other Waste (Management & Tran boundary Movement) Rules, 2016 as per the special condition imposed in the previous consents granted by the Board.</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the industry again applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 without removing complete observations due to which earlier application was returned.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry had deposited Rs. 35,000/- vide UTR No. STBP217100157569 dated 10/04/2017 (Rs. 31500 /- under Water Act, 1974, Rs. 3000/- as NOC regularization fee and Rs. 500/- as form fee) and same adequate upto 31/12/2022 under the Water (Prevention & Control of Pollution) Act, 1974 against the total cost of the industry Rs. 48.72 lacs.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the industry has deposited Rs. 27500/- vide UTR No. N179222014249966 dated 28.06.2022 under Water (Prevention & Control of Pollution) Act, 1974 against the total cost of the industry Rs. 65.66 lacs as per latest CA certificate submitted by the industry. The industry has not submitted any detail regarding increase in fixed assets. The industry has not submitted NOC regularization fee as well as late fee / penalty as per Board’s office order dated 29.10.2018.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has signed agreement with M/s Bantech Water Private Limited regarding lifting of trade effluent @ 2000 liter/month.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The site of the industry was visited by AEE of this office on 17.08.2022. During the visit, it was observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry was in operation and was engaged in the manufacturing of stitch wire used for card board by using MS Wire as raw material.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has installed one submersible pump for abstraction of ground water and the industry has not provided water meter on the same.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry generates trade effluent by the rinsing of pickling process, spent acid and zinc electroplating. The industry has made agreement with common treatment facility at Chanalon for lifting of wastewater. The industry is not maintaining any record regarding generation of the trade effluent and effluent lifted by authorized CETP.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has not provided Environment Data Board at the entrance.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Spillage of the effluent was observed in the floor within the premises of the industry.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry is not storing its Hazardous waste in scientific manner.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry failed to obtain authorization under Hazardous & Other Waste (Management & Tran boundary Movement) Rules, 2016.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">No DG set was found installed in the premises of the industry.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is appropriate to mention here that the industry is not complying with the various conditions of the consents granted under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and failed to obtain consent to operate under the provisions of the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 may be refused.</span></p> |
