<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">As per note history of the E-Noting no. 18529062, the project proponent was issued show cause notice for revocation of consent to operate granted under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 3245 dated 30/05/2022. The RO, Patiala in its note dated 21.06.2022 submitted that industry has submitted its reply vide its letter no. 62 dated 08.06.2022 and further recommended to this office to file the show cause notice as the industry has already complied with the provisions of Water Act, 1974. Though, vide note dated 22.07.2022, it was informed to RO, Patiala that the purview of dropping of SCN does not lies with PBIP and w.r.t. processing of the present CTE expansion application, the industry is required to submit an undertaking as per PBIP office order dated 28.03.2022.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The RO, Patiala through its note dated 07.08.2022 has again recommended to grant CTE expansion to the industry, subject to suitable conditions.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">It is pertinent to mention here that the CEO, PBIP had issued office order dated 28.03.2022 and the operative part of the said order is given as under:</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">“Accordingly, it has been decided to lay down following procedure for processing such applications for obtaining Consent to Establish under Water Act, 1974 & Air Act, 1981, for establishment/expansion/ modernization of the projects in PBIP:</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;"><span style="mso-spacerun: yes;"> </span>1. The application of the investor shall be processed on merits in PBIP as per the applicable Rules & regulations. The investor shall submit a self-declaration (Annexure-A), assuring to comply with the violations for which show cause notice or proceedings under various Environmental Acts/Rules are issued/pending and directions issued under the provisions of Environmental Acts/ Rules, within the period prescribed by the Competent Authority of the Board or well before applying for Consent to Operate for proposed project, whichever is earlier.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">2. Punjab Pollution Control Board shall impose special conditions (Annexure-B) in the clearances to be issued in PBIP, accordingly.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">As far as, the compliance of earlier observed violations / directions issued by Board is concerned, the regulatory functions of the PPCB to remain intact and are to be exercised independently and simultaneously by the Board.</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">This order will come into force with immediate effect”</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">In view of the above order, the industry has submitted an undertaking to the effect that it shall comply with the violations for which proceedings under various Environmental Acts/Rules are pending as well as well as directions issued to the industry under the provisions of Environmental Acts/Rules with in the period prescribed by the Competent Authority or well before applying for Consent to Operate, whichever is earlier. A copy of the undertaking received in PBIP is attached in the reply to clarification submitted by the industry vide note dated 02.07.2022.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">Also, regarding the suitability of site of the unit; the RO, Patiala vide note dated 02.07.2022, has intimated that “<em>the industry has submitted an undertaking to the effect that it falls in designated industrial zone notified in the master plan of Rajpura and there is no increase in land area (123.708 acre). The map has already been approved by Chief and District Town Planner. The same maybe sent to DTP, Department of Town and Country planning, in case if there is any objection regarding site of unit.</em>”</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">As per the policy of the Board dated 30.04.2013:</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;"><span style="mso-spacerun: yes;"> </span>“PPCB will grant NOC to new industries of all categories, which are proposed to be located in the designated Industrial zones/areas of the notified/draft Master Plan on the basis of undertaking submitted by the entrepreneur to the effect that the proposed site of the project/industry is located in the designated Industrial zone/area of the notified Master Plan or draft Master Plan in which the establishment of such industry/project is permissible.”</span></p>
<p class="MsoNormal"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">In consideration of the recommendations sent by RO, Patiala on 21.06.2022 & 07.08.2022 and the undertaking(s) submitted by the industry; if approved, the following actions may be taken:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">A.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry be granted Consent to Establish (NOC) for expansion for enhancing the manufacture capacity SBP to 42000 MTA [Stable Bleaching Powder (Existing)<span style="mso-spacerun: yes;"> </span>@ 24000 MT/year + Stable Bleaching Powder (Proposed) @ 18000 MT/day = Stable Bleaching Powder (Total) @ 42000 MT/year] alongwith same manufacturing capacity of already consented products i.e. Caustic Soda @ 82500 MT/year, Liquid Chlorine @ 73095 MT/year, Hydrogen @ 2062.5 MT/year {inclusive of Hydrogen Bottling (proposed) @ 688.3 MT/year} by using Sodium Chlorite @ 380 Metric Tonnes/Day, Barium Carbonate @ 3.75 MT/Day, Sodium Carbonate @ 0.587 MT/Day, Sodium sulphite @ 0.5 MT/Day, Sulphuric Acid @ 11.25 MT/Day, Lime Powder (Existing) @ 55 MT/day, Flocculant @ 0.0025 MT/Day, Alpha Cellulose @ 0.05 MT/Day, Lime Powder (Proposed) @ 33 MTD + Lime Powder (Total) @ 88 MTD as raw material within its existing premises, subject to suitable conditions and the following additional conditions that:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">This NOC is valid for enhancing the manufacturing capacity of Stable Bleaching Powder from 24000 MTA to 42000 MTA and for bottling of Hydrogen @ 688.3 MTA (from exisiting Man. Cap. of Hydrogen @ 2062.5 MTA) only and there shall be no increase in the manufacturing capacity of already consented products shall remain the same.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall ensure that it shall not manufacture SBP more than 42000 MTA, Hydrochloric Acid more than 66000 MTA and Sodium Hypochlorite more than 8250 MTA viz-a-viz maximum allowable production of chlorine @ 73095 MTA.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall install the proposed rice husk fired boiler of capacity 20 TPH alongwith ESP as APCD & stack of adequate height, in line with the proposal submitted by it. Further, it shall install 2 no. additional cyclone separators alogwith blower of capacity 12000 cfm to control the dust emissions from the expansion in the SBP manufacturing plant, as per the feasibility report submitted by it.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall enhance/ upgrade the capacity of the MEE plant from 10 KL to 25 KL, to treat the increased load of effluent from the SBP section, as per the feasibility report submitted by it.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;"><span style="mso-spacerun: yes;"> </span>The industry will operate and maintain its Air Pollution Control Devices (APCDs) efficiently, so as to achieve the stack emission standards, consistently as prescribed by the Board/ MoEF&CC and as amended from time to time.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry will not emit black smoke from its stacks under any circumstances.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry will operate and maintain its effluent treatment plant (ETP)/ multi-effect evaporator (MEE), regularly and efficiently, so as to achieve the effluent standards, consistently as prescribed by the Board/ MoEF&CC from time to time and maintain records regarding operation of the same.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry will not discharge any of its wastewater into any drain/river/nallah/choe/inland surface water under any circumstances.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">9.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall comply with the Hazardous Waste Management, Handling & Transboundary Movement) Rules, 2016.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">11.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall get the revised building plan under the Factories Rule, 1952 from the competent authority or the authorized person of the Department of Labours. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">12.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">13.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">14.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The Consent is being issued to the industry based upon the documents/ information/ undertakings submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">15.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The project proponent shall comply with the violations for which notice/ proceedings under Environmental Acts/ Rules are pending and directions issued to the industry under the provisions of aforesaid Acts/Rules with in the period prescribed by the Competent Authority and well before applying for Consent to Operate, whichever is earlier.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">16.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">In case, the project proponent failed to abide by the assurance undertaken, the Board shall have the liberty to take action against the project proponent under the provisions of the Environmental Acts/ Rules as deemed fit including cancellation/revoking of Consent to Establish.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">17.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">This Consent to Establish (CTE) shall not be considered as compliance of existing violations/ Show Cause Notice/ Proceedings of Hearing observed/issued by any Competent Authority, as the case may be.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">20.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 54.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">21.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">B.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">A copy of the ‘consent to establish’ (NOC) for expansion be sent to the Chief Town Planner, Punjab, for information and with the request to intimate the unit as well as Punjab Pollution Control Board, within 15 days, if the Department of Town and Country Planning has any objection for the expansion carried out by the unit by enhancing its production capacity of SBP from 24000 MTA to 42000 MTA and in case, no reply is received from the Department of Town and Country Planning within 15 days, then, it would be presumed that the department has no objection regarding suitability of the site for expansion & operation of the unit at the present location(s).</span></p> |
