It is submitted that earlier, the industry was granted  consents to operate under the Water Act, 1974 and Air Act, 1981 for production of steamed / raw rice @ 120 TPD and sorted rice @ 2 TPH vide nos. CTOW/Varied/FZL/2020/12870138 & CTOA/Varied/FZL/2020/12870063 dated 26.07.2020 respectively, valid up to 30.09.2025.                                 Thereafter, the industry was granted NOC for expansion for production of steamed / raw rice @ 180 TPD and sorted rice @ 2 TPH vide no. CTE/Exp./FZL/2020/12870177 dated 26.07.2020 valid upto 25.07.2021 by installing additional machinery i.e. 02 nos. dryers, 01 no. paddy separator and boiler of capacity 10 TPH along with existing machinery i.e. 04 nos. dryers, by replacing existing boiler of 6 TPH.                                 The industry has obtained consent to operate under the Water Act, 1974 & the Air Act, 1981 vide no.  CTOW/Varied/FZL/2020/14447164 dated 02/12/2020 and vide no.   CTOA/Varied/FZL/2020/14447008 dated 02/12/2020, respectively, to produce steamed rice / raw rice @ 150 MTD and sorted rice @ 2 TPH with 05 no. dryers, 02 paddy cleaner, 01 no. dryer of capacity 6 TPH and 02 no. shelling sections with sortex machine, same are valid upto 30.06.2025.                                 Thereafter, the industry was granted extension the validity of NOC, granted vide no. CTE/Exp./FZL/2020/12870177 dated 26.07.2020 valid upto 25.07.2021, for installation of additional machinery i.e. 01 no. dryer and boiler of capacity 10 TPH vide no.  CTE/Ext/FZL/2021/16245092 dated 22.07.2021 valid upto 24.07.2022.                                 Now, the industry has applied for obtaining varied of consents to operate under the Water Act, 1974 and the Air Act, 1981 for operation of rice sheller unit to manufacture  Saila rice @ 40 TPD or Steamed Rice/ Raw Rice @ 150 TPD and Sorted Rice @ 2 TPH, under Orange category. The rice sheller has submitted compliance report of the conditions of the consent earlier granted to it under the Water Act, 1974 and the Air Act, 1981.                                 The industry has already deposited  Rs. 53,550/- (Rs. 26,800/- vide R. No. 68/5103 dated 22.07.2020, Rs. 20,000/- vide online R. No. 952377314 dated 18.07.2020 and Rs. 6,750/- vide UTR/Ref. No. N169201162417190 dated 17.06.2020) in addition to earlier deposited fee of Rs. 45,000/- under the Water Act, 1974 and Rs. 53,550/- (Rs. 26,800/- vide R. No. 69/5103 dated 22.07.2020, Rs. 20,000/- vide online R. No. 292389276 dated 18.07.2020 and Rs. 6,750/- vide UTR/Ref. No. N169201162416778 dated 17.06.2020) in addition to earlier deposited fee of Rs. 45,000/- under the Air Act, 1981 against fixed assets of Rs. 350.52 Lacs (including plant & machinery of Rs. 311.66 Lacs) as per the CA certificate dated 18.08.2020, which is adequate upto 30.06.2025. Now, the industry has deposited Rs. 33,000/- vide UTR/Ref. No. N194222036827324 dated 13.07.2022 and Rs. 40,500/- vide UTR/Ref. No. N235222088816483 dated 23.08.2022 as water fee under the Water Act, 1974 & Rs. 33,000/- vide UTR/Ref. No.  N194222036804880 dated 13.07.2022 and Rs. 40,500/- vide UTR/Ref. No. N235222088811336 dated 23.08.2022 as air fee under the Air Act, 1981, against the fixed assets of Rs. 515.22 Lakhs (including plant & machinery of Rs. 452.13 Lacs) as on 07/07/2022 as per CA certificate dated 07/07/2022 submitted by it. Thus, the adequacy of consent fee becomes 30/09/2027 under each Act. The industry has also deposited Rs. 8,400/- vide UTR/Ref. No. N194222036831596 dated 13.07.2022 as NOC fee. For the increase in value building head and plant & machinery head, the industry has submitted that there is no expansion of the building, only some walls of building of the rice sheller have been increased and covered with roofs. The industry has further submitted that a solar system has been installed in its existing premises, due to which, plant & machinery head increased. Also, bills of same were attached.                                 To verify the facts, the industry was visited by undersigned on 23.08.2022 it was observed as under:- 1.            The industry was not in operation due to non available of paddy. The industry has installed 05 no. dryers for processing of total paddy 225 TPD. The work for installation of 01 no. new dryer and boiler of capacity 10 TPH is not yet carried out. The representative of the industry was informed to obtain further extension of NOC from the Board, immediately. 2.            Water pipeline to handies was found stands sealed. 3.            The industry has provided trima-cyclone followed by wet scrubber as APCD with the boiler of capacity 6 TPH and adequate stack height has been provided after APCD along with sample collection facilities. Same was found in line. 4.            Automatic conveyor system has been provided for carrying rice husk from storage room to the boiler feeding point with mechanical feeding system. 5.            The industry has provided cyclones as APCDs with 02 nos. paddy pre-cleaners of parboiling section separately with adequate stack heights and sampling facilities, same were found in line. 6.            The industry has installed cyclones as APCDs with both shelling sections separately, same were found in line. 7.            The industry has provided storage shed for storage of rice husk generate form the both shelling section 8.            The industry has provided room type enclosure for temporary storage of rice husk ash with arrangement for wetting to avoid its blowing. 9.            Pucca road has been provided inside the industry for movement of vehicles inside the industry. 10.          A Septic tank has been provided for treatment of domestic effluent generated from the industry and the treated effluent is discharged into MC sewer. 11.          The industry has provided ETP for treatment of trade effluent generated from parboiling section which consists of Equalization Tank, Anaerobic filter, Aeration tank, secondary sedimentation tank & sludge drying beds and plantation area of 1.5 acres, which is adequate for 40 KLD treated trade effluent. The industry has provided flow meter at the outlet of ETP however, separate energy meter with the ETP has not provided.                         The industry is complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013 for rice sheller industries. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                           Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture  Saila Rice @ 40 TPD or Steamed Rice/ Raw Rice @ 150 MTD and Sorted Rice @ 2 TPH, under Orange category, subject to the suitable conditions and following special conditions:- 1.            The industry will apply online for further extension the validity of NOC for installation of additional machinery i.e. 01 no. dryer and boiler of capacity 10 TPH, immediately. 2.            The industry will provide separate energy meter with ETP within 7 days.
