CTOA/Renewal/PTA/2019/8903961 dated 03/01/2019, valid upto 30/09/2023 (without drier) subject to conditions mentioned therein. <span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Rice @ 2.0 T/Hour by processing of Paddy @ 3.0 T/Hour (without drier) under orange category along with requisite documents. The industry has deposited Rs. 10800/- vide R.No. 54414179 dated 23.08.2022 on account of consent fee under the Water (Prevention and Control of Pollution) Act, 1974 and Rs. 10800/- vide R.No. 142964434 dated 23.08.2022 under the Air (Prevention and Control of Pollution) Act, 1981. The total fee deposited by the industry is adequate up to 30.09.2026 against the fixed assets of Rs. 70.00 lakh as on 01.08.2022 submitted by the industry. The industry has also deposited Rs. 7198/- as sample testing fee.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">The firm is a partnership firm and the industry has submitted retirement deed and new partnership deed. The industry has also applied under the authority of new partner. </span></p>
<p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">The industry has submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">Standards to be followed by Rice Shellers as per item no. 4 of Proceedings of the 4<sup>th</sup>Core-Committee meeting (2018) taken by the Chairman of the Board on 31.10.2018 in the Committee Room, Head office, Patiala, it was decided that the Board will raise a clarification to CPCB on e-samiksha portal as to whether the sitting guidelines for Rice Shellers had been considered while finalizing/ prescribing stringent emission standards in notification dated 16.03.2012. The relevant text is as under; "It is intimated that the Govt. of Punjab, Department of Science, Technology & Environment vide notification no. 10/48/2004-STE(4)/932 dated 15.10.2013 has prescribed standards for discharge of emissions from rice mills and saila plants as 750mg/Nm3, whereas Ministry of Environment & Forest, New Delhi vide notification dated 16.03.2012 has prescribed amended emission standards of 150 mg/Nm3 (SPM) for rice mills having capacity upto 3 TPH and 100 mg/Nm3 (SPM) for rice mills having capacity more than 3 TPH. The Board has constituted a committee to suggest the modifications/up gradations to be made in the existing Air Pollution Control Device to achieve the prescribed standards in light of the MoEF notification dated 16.03.2012. The committee has submitted the report with the various conclusions. The report submitted by the committee has been has been discussed in the Core Committee of the Board held on 31.10.2018 and observed that Department of Science, Technology and Environment while issuing notification no. 10/48/2004-STE(4)/932 dated 15.10.2013 has prescribed stringent sitting guidelines for setting up of rice shellers and saila plants, whereas there is no reference of such sitting guidelines prescribed by the Ministry of Environment & Forest in the notification dated 16.03.2012. By virtue of the sitting guidelines, the rice shellers/ saila plants in State of Punjab are to be established either in Industrial Zone or away from Abadies/ MC limits /City Areas. The Board had then raised a clarification to CPCB on e-samiksha portal on 28/12/2018 as to whether the sitting guidelines had been considered while finalizing/prescribing the stringent emission standards in notification dated 16.3.2012. The reply from CPCB/ Head Office, Patiala is still awaited in the matter. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. </span></p>
<p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';">Keeping above in view, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 granted to the industry may be renewed upto 30.09.2026 for manufacturing of Rice @ 2.0 T/Hour by processing of Paddy @ 3.0 T/Hour (without drier) under orange category subject to certain condition and following additional conditions that:</span></p>

At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 meters above the roof of the building.</span></p>

<p class="MsoListParagraph" style="text-align: justify; text-indent: -.25in; line-height: 130%; mso-list: l0 level3 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">b.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -.25in; line-height: 130%; mso-list: l0 level3 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">c.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5'height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading / unloading areas of rice husk.</span></p>

<p class="MsoListParagraph" style="text-align: justify; text-indent: -.25in; line-height: 130%; mso-list: l0 level3 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">e.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">Wherever the height of rice husk is 3' or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk. </span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -.25in; line-height: 130%; mso-list: l0 level3 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 1.0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">f.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds. </span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; line-height: 130%; mso-list: l2 level1 lfo1; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).</span></p>

<p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; line-height: 130%; mso-list: l2 level1 lfo1; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">The industry shall not install mechanical drier in any case in its premises without the written permission of the Board and this consent is valid for dry rice shelling unit without mechanical drier. </span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -27.0pt; line-height: 130%; mso-list: l2 level1 lfo1; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in 3.0pt 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 130%; font-family: 'Bookman Old Style','serif';">The rice sheller shall put in place all the hoods, ductings & enclosures and other components of the APCD well before commissioning of the unit for the upcoming paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit. </span></p>

CTOW/Fresh/PTA/2019/8904140 dated 03/01/2019 and under the Air Act, 1981 vide no. CTOA/Renewal/PTA/2019/8903961 dated 03/01/2019, both valid upto 30/09/2023. </span></p> |
