RO has reported that the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/TRT/2018/7065017 and under Air (prevention & Control Act, 1981 vide no. CTOA/Renewal/TRT/2018/7064752 dated 20/03/2018, which are valid upto 30/09/2022 for manufacturing of Industrial Valves @3200MT/Year. The industry was issued SCN for revocation of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 along with opportunity of personal hearing before the Chief Environmental Engineer, Jalandhar on 12.07.2019. After hearing the officer of the Board and representative of the industry, the Chief Environmental Engineer decided as under:- <p class="MsoListParagraphCxSpFirst" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">1.    The Authority shall submit a Bank Guarantee of Rs.  05 lacs with validity for one year within 07 days as assurance to comply with the various provisions under the Water (Prevention & Control of Pollution) Act, 1974 if the last sample collected fails to meet with prescribed standards, the Bank Guarantee of Rs. 05 Lacs will be encashed.  <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">2.    The Authority shall submit fresh Bank Guarantee of Rs. 05 lac with validity for one year within 07 days as assurance to comply with the various provisions under the Water (Prevention & Control of Pollution) Act, 1974. <p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">3.    The Authority shall install OCEMS & CCTV cameras as per the time schedule given in the action plan of clean river of Beas. Thereafter the industry was visited by then AEE on 23.12.2019 and effluent samples were collected from the outlet of STP installed by the industry for treatment of domestic effluent generated from its premises. As per analysis reports of Board Lab, the concentration of parameters, pH,COD, BOD, TSS. TDS and O &G is 7.8, 260 mg/l, 48 mg/l, 118 mg/l, 834 mg/l and 7.2 mg /l respectively i.e. within permissible limits as the prescribed standard. The industry had submitted bank guarantee, bearing no. 11201LG0119 dated 31.08.2019 amounting to Rs. 05 lacs, with validity upto 28.02.2020, as an assurance to comply with the decisions of personal hearing. However it has failed to submit the extended bank guarantee till date after repeated persuasion by this office. The industry was visited  on 05.04.2022 and effluent samples were collected from the outlet of the STP and per analysis reports of Board Lab, the concentration of parameters, pH,COD, BOD, TSS. TDS and O &G is 8, 68 mg/l, 16 mg/l, 11 mg/l, 428 mg/l and BDL respectively i.e. within permissible limits as the prescribed standard.              Now the industry has applied for renewal of consents to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. Details of the case are as under:- <p class="MsoListParagraphCxSpFirst" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">1.    The industry has submitted a CA certificate of Rs. 34.78 as on 31.03.2022. The industry has deposited Rs. 2,18,900 /- vide UTR No. SBIN322220803346 dated 08/08/2022 (Rs 2,10,000/- as consent fee under Water Act, 1974, Rs 500/- as application form fee and Rs 8400/- as NOC regularization fee) & Rs. 2,10,500/- vide UTR No. SBIN322220802152 dtd 08/08/2022 as consent fee under Air Act, 1981, which are adequate up to 30/09/2027 under both Acts. <p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">2.    The industry has already submitted compliance of the directions issued to it vide letter 811 dated 26.04.2022 regarding the operation of OCEMS system. The industry was visited on 25.08.2022 and it was observed as under:- <p class="MsoListParagraphCxSpFirst" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">1.    The industry was in operation for finishing of industrial valves and fitting. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">2.    The industry has installed 04 no. electric furnaces for heating of castings. The industry has installed 01 no. shot blasting machine within built bag filter house as APCD.  <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">3.    The process involved in the finishing of Industrial valves are shot blasting, machining, heating, welding, assembling, hydro-testing and spray painting. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">4.    The industry has provided separate booth for spray painting process. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">5.    The industry has installed sewerage treatment plant and the same was in operation. The industry has installed mechanical flow meter at the outlet of STP along with separate energy meter. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">6.    The industry has installed D.G. set of capacity 250 KVA & 380 KVA with canopies and adequate height of stacks. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -18pt; line-height: normal;">7.    OCEMS system installed at the STP was in operation and same is also being checked online on regular basis. <p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; line-height: normal;">The industry has submitted record for operation of STP for the month of August 2022, wherein the average treated water from outlet of STP is about 15 KLD and has also submitted record regarding using this treated water for plantation/irrigation purpose in the industrial premises. As per representative, due to decrease in demand, the industry has been operating under capacity and accordingly there has been decreased in the manpower/effluent generated from the premises. <p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; line-height: normal;">The industry was perused to submit extended bank guarantee with minimum validity of 01 year for processing the application further, however the industry informed that they have carried out all the necessary compliance as directed during personal hearing and have requested many times for return of the Bank guarantee. The consent applications cannot be processed further with expired bank guarantee as policy of the Board. RO has recommended that show cause notice for refusal of the consent to operate under the Water Act, 1974 may be issued to the industry for failing to submit  extended bank guarantee despite repeated persuasion.  In view of above, may if approved, show cause notice for refusal of the consent to operate under the Water Act, 1974 may be issued to the industry for 07- days.
