It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. R15SGRCTOW325355 dated 25/10/2015 valid upto 30/6/2020 and under the Air Act, 1981 vide no. R15SGRCTOA3235128 dated 25/10/2015, valid upto 30/06/2020, for manufacturing of Sorted Raw Rice (without drier) @ 1.5 TPH by processing of Paddy @ 2.25 TPH, as raw material under orange category. Now, the industry has applied for renewal of consents to operate under the Water Act, 1974 & the Air Act, 1981, for production of Sorted Raw Rice (without Dryer) @ 1.5 TPH by processing of Paddy @ 2.25 TPH, as raw material under orange category. The industry has deposited consent fee on account of Water (Prevention & Control of Pollution) Act 1974 for Rs. 15,300/- (Rs. 11,700/- vide UTR no. SBIN421260896866 dated 17/9/2021 and Rs. 3600/- vide UTR no. 750832106 dated 22/8/2022) and Rs. 15,300/- (Rs. 11,700/- vide UTR no. SBIN421260901052 dated 17/9/2021 and Rs. 3600/- vide UTR no. 548085320 dated 22/8/2022) on account of Air (Prevention & Control of Pollution) Act 1981.  The fee deposited is adequate up to 30/09/2024 against the value of fixed assets increase from Rs. 58 lacs as on 22/8/2022. The industry has deposited Rs. 21,600/- as penalty fees (Rs. 11300/- vide UTR no. 750832106 dated 22/8/2022 and Rs. 10,300/- vide UTR no. 548085320 dated 22/8/2022), which is adequate. The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time,  in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets. No complaint is pending against the industry. However, the industry has not submitted latest stack emission sampling report.           Keeping above in view, it is recommended that: 1.        Consent to operate under the Water (Prevention & Control of Pollution) Act 1974 may be renewed upto 30/9/2024 for production of Sorted Raw Rice (without Dryer) @ 1.5 TPH by processing of Paddy @ 2.25 TPH, as raw material under orange category. 2.        Consent to operate granted under the Air Act, 1981 may be renewed for a shorter period of one year i.e. upto 30/09/2023 for production of Sorted Raw Rice (without Dryer) @ 1.5 TPH by processing of Paddy @ 2.25 TPH, as raw material under orange category , subject to certain conditions to be mentioned therein.
