<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">It is submitted that the industry was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. RO/PTA/Water/06/392 dated 16/01/2007, valid upto 15/01/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. RO/PTA/Air/06/316 dated 16/01/2007, valid upto 15/01/2022 for production of CRW/ ERW Pipes@ 8.0 MTD.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Accordingly, the industry has applied for obtaining varied 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under green category for manufacturing of CRW/ ERW Pipes@ 80 MT/year by using Cold Rolls Strips @ 85 MT/year as raw material. The industry has deposited consent fee of Rs. 32000/- vide UTR no. N232222085656289 dated 20.08.2022 on account of water consent fee and Rs. 32000/- vide UTR no. N232222085644506 dated 20.08.2022 on account of air consent fee against the un-depreciated fixed assets of Rs. 125.06 lacs, as on 31.07.2022 CA certificate dated 08.08.2022, which is adequate upto 15.07.2026 as per Board's Office Order dated 29/10/2018. The industry has also deposited NOC regularization fee of Rs. 6400/- vide UTR no. N232222085661567 dated 20.08.2022 for increase in the fixed assets, which is adequate.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">The industry was visited by the A.E.E. of this office on 5.9.2022 and it was observed as under:</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">1. The industry was in operation.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">2. The industry has already stabilized its movement area.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">3. The industry has not installed any D.G. set.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">4. No water will used in the process; therefore, there will be no generation of any trade effluent.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">5. Entire cooling water is being re-circulated.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 27.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: normal; background: white;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">6. There is only generation of domestic effluent, which is being discharged onto landfill after passing through septic tank.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; background: white; margin: 12.0pt -.9pt 10.0pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 15/07/2026</strong>.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-justify: inter-ideograph; line-height: 150%; background: white;"><strong><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring.</span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal; background: white; margin: 12.0pt -.9pt .0001pt 0in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: normal; background: white; margin: 12.0pt -.9pt .0001pt 0in;"><strong><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; background: white; margin: 12.0pt 0in .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">In view of above, it is recommended that the 'consent to operate' under the Water Act, 1974 & Air Act, 1981 may be granted for one year i.e. <strong>31/12/2025 </strong>with suitable conditions.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">a) The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">b) <span style="background: white;">The entrepreneur/industry shall obtain necessary statutory permissions /clearances from all other concerned departments.</span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">c) <span style="background: white;">The industry shall not generate and discharge any kind of trade effluent.</span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">d) <span style="background: white;">The industry shall not start wet process without prior approval of the Board.</span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">e) <span style="background: white;">The industry shall not install boiler, furnace without prior approval of the Board.</span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.5in; line-height: normal; background: white; margin: 12.0pt 0in .0001pt .5in;"><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">f) The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-justify: inter-ideograph; line-height: normal; background: white;"><strong><span style="font-size: 12.0pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> (Competency E.E.)</span></strong></p> |
