The industry was granted consent to operate under the Air Act, 1981 vide no. CTOA/Renewal/FGS/ 2021/15298950 dated 07/06/2021 valid upto 30/09/2021 for the manufacturing of Billets/Ingots/Stainless Steel/Special Steel @ 600 T/Day, Rolled Steel Products@ 400 T/Day, Oxygen Gas @ 400 m3/hr, Crank Shaft @ 12 Lac No. /Day, Kick Assembly @ 6 Lac No. /Day, Bridge Fork Bottom @ 6 Lac No./Day & Gears @ 12 Lac No./Day with certain conditions mentioned therein.</span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">The industry had applied for obtaining consent to operate under the Air Act, 1981 in the name & style of M/s Arjas Modern Steel Pvt. Ltd. The industry was visited by the officers of the Board on 25/02/2022 for monitoring of APCD& on 20/4/2022 to verify the contents of the consent case and observed as under:</span></p>

However, the industry is not operating the same, due to low production demand since July, 2020. As informed by the representative of the industry, the second induction furnace of capacity 6 TPH has also not been operated from last 3 years. </span></p>

But, the industry has not shifted its 3 nos. ladle pre-heaters of capacity 30 Ton each, 2 nos. tundish pre-heaters of capacity 5 Ton each and 1 no. Boiler of capacity 8 TPH to PNG.</span></p>
<p class="MsoBodyTextIndent" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-language: PA;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">The industry was advised to clear the stock of hazardous waste generated from the earlier operation of re-heating furnaces on fuel other than PNG, within 1 week.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt 0in 6.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">The reply submitted by the industry vide its letter dated 27/05/2022 was considered by the Competent Authority and found unsatisfactory, as the industry has admitted that the work regarding shifting of fuel to PNG for 3 nos. ladle pre-heaters of capacity 30 Ton each, 2 nos. tundish pre-heaters of capacity 5 ton each and 1 no. Boiler of capacity 8 TPH is in progress. Regarding the efficiency of the fume extraction system installed on the ARC furnace, the industry has submitted that it has decided to upgrade the existing Fume Extraction System (Primary and Secondary both) by investing Rs. 20 crores in 2 phases to provide bench mark fume extraction system. The industry has started techno-commercial discussions with some of the FES designers and manufacturers. No time line to complete the aforesaid work was given by the industry.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt 0in 6.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">The Competent Authority of the Board decided that the application for obtaining fresh consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 be refused, due to aforesaid violations and also issue notice u/s 31-A of the Air Act, 1981 proposing for closure of the unit. Accordingly, the air consent applied by the industry was refused vide letter no. 1900 dated 04/07/2022, due to the reasons mentioned therein. In view of facts mentioned above, notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981has been issued to the industry with an opportunity of personal hearing before the Chairman of the Board on 11/08/2022, which was postponed to 17/08/2022.</span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt 0in 6.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">The representatives of the industry submitted the written reply which was taken on record. They further stated that high efficiency bag filter has been installed on the electric Arc furnace. During visit/sampling by the Board Officer, one of the bags got damaged/choked causing air pollution. They have replaced it and now the system is working properly. The stack emission monitoring has been carried out by NABL Accredited Lab. on 4.5.2022 and the concentration of the particulate matter was found 33 mg/Nm³ against 150 mg/Nm³. </span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt 0in 6.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">They further stated in order to address the fugitive emission issue, the new management has taken up to three phase action plan. In phase first, 3 number ladle pre heaters of capacity 30 ton each, 2 number tundish pre heaters of capacity 5 ton each will be shifted to PNG by 30.10.2022. In second phase boiler of capacity 8 TPH will be shifted on PNG by 31.12.2022. In third phase they have planned to go for heavy duty secondary suction system with a capacity of 5,50,000 AM hr and 700 mmWC. As per the capacity of the furnace 4,00,000 AM³/hr suction capacity would have been sufficient. However, in order to set a bench mark, they have decided to go far additional suction capacity and placed order to M/s Doshi Technologies Pvt. Ltd., Badodara (Gujrat). This is going to be a very huge project because of heavy duty ID Fan and Glant Bag House and approximate 23 Crores will be incurred. The project is likely to be completed by 20.02.2023.</span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">After hearing the representatives of the industry and officers of the Board, the Chairman of the Board decided as under: </span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; mso-list: l0 level1 lfo2; margin: 0in 0in .0001pt 27.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-language: PA;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">Environmental Compensation amounting to Rs. 3.50 lacs shall be deposited by the industry within a week at Regional Office, Fatehgarh Sahib for the violation caused by the industry from 25.2.2022 to 5.5.2022 (70 days).</span></p>

The industry shall shift its boiler of capacity 8 TPH to PNG by 31.12.2022, in second phase.The industry shall provide heavy duty secondary suction system with a capacity of 5,50,000 AM3/hr and 700 mmWC as per the proposal submitted by M/s Doshi Technologies Pvt. Ltd., Badodara (Gujrat) by 20.02.2023 in the third phase. </span></p>

After the completion of activity in First Phase, the Industry shall deposit reduced EC amounting to Rs. 12 lac per month, till the completion of activity in second phase and thereafter the industry shall deposit reduced EC amounting to Rs. 6 lac per month, till the compliance of activity in phase third and achievement of prescribed standards.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-language: PA;">Accordingly, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 under the name of </span><strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">M/s Arjas Modern Steel Pvt. ltd.</span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-language: PA;"> with requisite documents.<span style="color: red;"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry has earlier deposited Rs. 22,600/- vide UTR no. CMS2483143395 dated 30/03/2022 </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-language: PA;">on account of Air consent fee </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">against the un-depreciated fixed assets of Rs. 7135.01 Lacs as on 15/03/2022 as per CA certificate dated 15/03/2022 which is adequate <strong>upto 30/09/2023</strong> as per Board’s Office Order dated 29/10/2018 after deducting penalty charges 10 % as per PPCB circular no. 484 dated 13/09/2021.<span style="color: red;"> </span></span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Accordingly, the industry was visited on <strong>28.09.2022</strong> by undersigned alongwith Environmental Engineer and observed as under:</span></p>

In addition to this, there is forging unit, 1 vaccum de gasifier (VD), 1 laddle refining furnace (LRF) and 1 continuous concast machine (CCM).</span></p>

Laying down conditions for EC based on appraisal is not enough unless compliance thereof is duly monitored and ensured with a view to achieve the said object. The Hon'ble NGT vide the said order dated 01.02.2021 had issued certain directions to Ministry of Environment, Forest & Climate Change and also directed that the Central Pollution Control Board and the State Pollution Control Boards may take measures to conduct monitoring of EC conditions.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi;">It is submitted that CPCB vide letter no. 18288 dated 28.03.2019 had already referred to Horble Supreme Court of India's orders dt. 14.10.2003 in the matter of Writ Petition (C) No. 657/1995: Research foundation for Science, Technology and Natural Resource Policy Vs Union of India & Ors, and had requested all the SPCBs to direct all the industries involved in hazardous chemicals and generating hazardous wastes to display data of hazardous waste outside the main factory gate. Accordingly, PPCB, Head Office, Patiala vide letter no. 12267-80 dated 15.04.2019 & reminder letter no. 21166-79 dated 16.07.2019, 33117-130 dt 25.10.2019 had requested all the ROs of the Board to ensure compliance of the above said orders. Meanwhile, clarifications had been sought by SPCBs of Odisha/Madhya Pradesh, Maharashtra on the applicability of mandatory online display board as mentioned in the above said orders. PPCB vide letter no. 6332 dated 25.02.2020 had also intimated CPCB that the sample display board was very exhaustive which need to be precise and bilingual and old format should be continued. Further, CPCB has clarified that the installation of the Online Display Board be strictly regulated to all the large scale units, whereas, medium and small units may be regulated for installation of appropriate size of manual environmental data display boards outside the factory gate to ensure compliance with the aforesaid orders.</span></p>
