<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 10.0pt; mso-add-space: auto; text-align: justify; line-height: 115%;"> It is submitted that the industry is a dairy unit which falls under orange category and is a small scale unit. The industry was earlier granted consents to operate under the Water Act, 1974 and the Air Act, 1981 vide nos. CTOW/Renewal/FZL/2020/13296067 dated 19/08/2020, valid up to 30/09/2021 and CTOA/Renewal/FZL/2021/17240598 dated 21/11/2021, valid up to 31/03/2023, for processing of milk @ 30 KLD, subject to the conditions mentioned therein.</p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; line-height: 115%;"> Earlier, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974. Accordingly, the <span style="font-family: Tahoma, 'sans-serif';">industry was visited by officer of the Board on 10.11.2021 and it was observed that effluent treatment plant (ETP) installed by the industry was found in redundant condition and its physical condition indicated that the same has not been operated by the industry. The industry has not developed adequate plantation area for utilization of effluent generated by it.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">Notice before refusal of renewal of 'consent to operate' under Water Act, 1974 was issued to the industry with an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 29.11.2021, wherein it was decided that : -</span></p>
<p class="MsoNormal" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-line-height-alt: 9.7pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">1.</span><span style="font-size: 7pt; font-family: 'Times New Roman', 'serif';"> </span><span style="font-family: Tahoma, 'sans-serif';">The industry will make the ETP fully functional & operational as well as will develop adequate area for utilization of entire treated effluent for plantation purposes, within 15 days.</span></p>
<p class="MsoNormal" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-line-height-alt: 9.7pt; background: white;"><span style="font-family: Tahoma, 'sans-serif';">2.</span><span style="font-size: 7pt; font-family: 'Times New Roman', 'serif';"> </span><span style="font-family: Tahoma, 'sans-serif';">Regional Office shall visit the industry immediately after 15 days to verify the compliance made at site and thereafter submit report alongwith afresh recommendations for disposal of pending consent application of the industry.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">The industry was visited by officer of the Board on 23.12.2021 and it was observed that ETP installed by the industry was still found in redundant condition and no up-gradation of the same was carried out. The untreated effluent was collected in a collection tank and the possibility of disposal of the effluent in an unscientific manner cannot be ruled out. The industry has developed adjacent land area under plantation, however failed to submit any record regarding ownership of the said site. Thereafter, the consent applied by the industry under the provisions of the Water Act, 1974 was refused by the Board on 30.12.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">The industry was again visited by the officer of the Board on 12.07.2022 and it was observed that the ETP installed was still in redundant condition and also no record regarding ownership of the land area developed under plantation submitted by the industry. </span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">In view of above, notice u/s 33-A of the Water Act, 1974 was issued to the industry vide Board's letter no. 3963 dated 12.08.2022 alongwith an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 18.08.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">Sh. Ravinder Kumar, Prop. of the industry attended the hearing, but he failed to justify the failure on part of the industry regarding non-installation / operation of adequate effluent treatment plant as well as operation of the industry since 01.10.2021 without having valid consent of the Board under the Water Act, 1974.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">During hearing, it was observed by the Chief Environmental Engineer (B) that the industry has been afforded no. of opportunities by way of issuing show cause notices / affording opportunity of personal hearings in the last more than 8 months to install / operate adequate effluent treatment plant as well as submission of application for renewal of consent under the Water Act, 1974, but the industry has failed to do the needful. This indicates casual attitude of the industry towards compliance of the provisions of the Pollution Control Laws and thus violated the provisions of the Water Act, 1974.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">Therefore, after considering the material facts on file, it has been decided by the Chief Environmental Engineer (B) that directions u/s 33-A of the Water Act, 1974 be issued for closure of the industry and simultaneously, PSPCL authorities be asked to disconnect the electric connection of the industry with immediate effect.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-line-height-alt: 9.7pt; background: white;"> <span style="font-family: Tahoma, 'sans-serif';">The proceedings of the hearing dated 18.08.2022 were conveyed to the industry for compliance.</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; line-height: 115%;"> Now, the industry has again applied for renewal of consent to operate under the Water Act, 1974 on 06.09.2022 alongwith compliance report-cum-declaration that it is complying with the conditions of CTOs granted to it earlier and is complying with the provisions of the Water Act, 1974 and the Air Act, 1981. The industry has earlier deposited Rs. 63,000/- under both the Acts separately. Now, the industry has deposited Rs. 21,000/- deposited vide UTR/Ref. No. SBIN122264381861 dated 21.09.2022 as consent to operate fee under the Water Act, 1981, the consent fee deposited by the industry is adequate up to 30.09.2024 against fixed assets of Rs. 142.24 lacs as on 31.03.2022 mentioned in CA certificate dated 26.08.2022. The industry has submitted revenue record for the plantation area.</p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; line-height: 115%;"> The industry has submitted reply to the show cause notice that the industry is now removed the shortcoming observed earlier.</p>
<p class="MsoNormal" style="text-align: justify;"> To verify the facts, the site of the industry was visited by undersigned on 27.09.2022 and it was observed as under:-</p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry was not in operation and engaged in manufacturing of dairy product (desi ghee) and chilling of milk.</p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry has now made ETP of the industry in working condition and ETP was under stabilization. During visit no wastewater was coming in the inlet of ETP. The industry has now developed plantation area of 1 kanal inside the industry and about 1 acre, which is sufficient for handling of treated wastewater for the industry.</p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry has now maintained record of ETP operation as per which on an average 2 to 3 KLD is treated in ETP and the maximum quantity of wastewater discharged is 4 KLD. The representative of the industry due to production of desi ghee only and chilling of milk, maximum quantity of wastewater can be generated is 6-7 KLD. .</p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry has provided wood fired baby boiler of capacity 0.8 TPH, which has adequate stack height.</p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry has installed 25 KVA D.G set in its premises with adequate stack and canopy.</p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 10.0pt .25in;"><!-- [if !supportLists]-->6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->The industry has provided septic tank for the treatment of domestic effluent with discharge onto plantation area of about 1 kanal inside the industry. </p>
<p class="MsoNormal" style="text-align: justify;"> From above, it is clear that the industry is complying with the provisions of the Water Act, 1974.</p>
<p class="MsoNormal" style="margin-right: .05in; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> </span> <span style="font-family: 'Tahoma','sans-serif';"> </span> Keeping in view of above, it is recommended as under:</p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; margin: 0in .05in .0001pt .5in;"><!-- [if !supportLists]-->1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->Consent to operate under the Water Act, 1974 may be renewed to the industry for a short period of six months with suitable conditions.</p>
<p class="MsoListParagraph" style="margin-left: .5in; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]-->2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span><!--[endif]-->Directions issued u/s 33-A of the Water Act 1974 may be restored temporarily please.</p>
