It is submitted that the industry was earlier granted consents to operate vide no.    CTOW/Varied/FZR/2018/8558106 dated 01/10/2018 and vide no.    CTOA/Varied/FZR/2018/8557908 dated 01/10/2018 under the Water Act, 1974 and the Air Act, 1981, respectively for operation of rice sheller unit to manufacture Raw Rice with Dryer @ 3 TPH and Sorted Rice @ 2 TPH, both are valid upto 30/09/2022, subject to the certain conditions mentioned therein.                   Thereafter, the industry has applied for renewal of consents to operate under the Water Act, 1974 and the Air Act, 1981 for operation of rice sheller unit to manufacture Raw Rice with Dryer @ 3 TPH and Sorted Rice @ 3 TPH, under Orange category, but the same was returned due to increase in the capacity of sortex machinery, accordingly clarification was raised to submit adequacy/capacity bill of its sortex machinery. But the industry has failed to submit any reply within stipulated time period.                    Now, the industry has again applied for renewal of consents to operate under the Water Act, 1974 and the Air Act, 1981 for operation of rice sheller unit to manufacture Raw Rice with Dryer @ 3 TPH and Sorted Rice @ 3 TPH, under Orange category alongwith reply of previous clarification. In reply, the industry has submitted registration with Deptt. of Food, Civil Supplies & Consumer Affairs, Govt. of Punjab, which shows that the industry has installed sortex machinery having capacity 3 TPH and also attached bill in the name of the industry for the color sortex machine of capacity 3-4 TPH. The industry has also submitted compliance reports of consent conditions imposed in the consents to operate granted under the Water Act, 1974 and the Air Act, 1981.                    The industry has already deposited Rs. 23500/- each vide R. no. 37/4841 & 38/4841 dated 24.09.2018 each under the Water Act, 1974 & Air Act, 1981, respectively, which is adequate upto 31.03.2023 under each act, under orange category, against the fixed assets of Rs. 97.90 Lacs as on 19.09.2018 as per earlier CA certificate submitted by it. Now, the industry has deposited Rs. 28,000/- vide UTR/Ref. No.  SBIN222231213741 dated 19.08.2022 and Rs. 28,000/- vide UTR/Ref. No.   SBIN222231213789 dated 19.08.2022 as consent to operate fees under the Water Act, 1974 and Air Act, 1981, against the fixed assets of Rs. 97.90 Lacs as on 18.08.2022 as per CA certificate submitted by it, which is adequate upto 31/03/2028 under the both Acts.                    To verify the facts, the industry was visited by undersigned on 29.09.2022 it was observed as under:- 1.           The industry was not in operation during visit. The industry has installed machinery for the production of sorted rice and raw rice with dryer. 2.           The industry has covered all the processing sheds. 3.           The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 4.           The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as dryer. 5.           The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided jalli of 5 feet height above the brick wall in front of the discharge point of rice husk area. 6.           The industry has no source of trade effluent generation and the industry has provided septic tank for treatment of domestic effluent to be generated from toilets / washrooms. It has also made plantation along boundary wall to utilize treated domestic effluent after septic tank. 7.           The industry has planted trees along its boundary wall. 8.           During visit, it was observed that the industry has installed sortex machinery. The representative of the industry informed that they have installed already sortex machinery of capacity 3 TPH however, we wrongly got consents from the Board of sortex machinery of capacity 2 TPH earlier. He further requested that grant consents for sortex machinery of capacity 3 TPH.    <a name="_Hlk115859833"></a>                        The industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981 for operation of parboiling plant / rice sheller unit as well as code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                    <a name="_Hlk115859849"></a>Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be renewed to the industry for a period upto 30/09/2027 for operation of rice sheller unit to manufacture Raw Rice with Dryer @ 3 TPH and Sorted Rice @ 3 TPH, subject to the suitable conditions and a special condition that the industry will get its emissions analyzed from Board's lab during upcoming paddy season 2022-23 and submit the report within one month after re-commissioning of the industry.
