<p class="MsoNoSpacing" style="margin-left: 1.0in; text-align: justify; text-indent: -1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">No one attended the hearing.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">It was brought out that the industry was granted consents to operate under the Water Act, 1974 and Air Act, 1981 on 06.09.2019 (valid upto 29.02.2020) for manufacturing of card board @ 2.5 TPD subject to one of the condition that the industry shall not procure/process any waste as prescribed in schedule-IV appended to the HOWM Rules, 2016 till it gets the certificate of registration/passbook as recycler/re-processor. </span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The industry was issued show cause notice with an opportunity of personal hearing before the Chief Environmental Engineer (B) on 08.07.2021, wherein it was decided that:</span></p>
<p class="ListParagraphCxSpFirst" style="text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry shall not restart its unit without obtaining valid consents to operate under the Water Act, 1974 & Air Act, 1981. </span></p>
<p class="ListParagraphCxSpLast" style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry shall not use ETP sludge without obtaining prior authorization / passbook under the HOWM Rules, 2016.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The industry has applied for renewal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 for manufacturing of card board @ 2.5 TPD.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">The industry was visited<span style="mso-spacerun: yes;"> </span>by the officer of the Board on 28.09.2022 and it has been reported as under:-</span></p>
<p class="ListParagraphCxSpFirst" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry was in operation.</span></p>
<p class="ListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has procured and stored primary ETP sludge of pulp & paper mill (cat 32.3 of schedule-I) and was found using the same for production of card board, without obtaining passbook/registration as well as authorization under the HOWM Rules, 2016. </span></p>
<p class="ListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has provided brick paved (without cement/concrete mortar) platform for the storage of ETP sludge, which was found distorted and its slope is such that the leachate generated from the sludge leads to stagnation. Also, some quantity of ETP sludge was found stored on the kaccha ground and near the ETP section. </span></p>
<p class="ListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry failed to produce any record regarding procurement of ETP sludge. </span></p>
<p class="ListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The effluent generated from the process was found stagnated in the form of katcha pit and into the adjoining area. </span></p>
<p class="ListParagraphCxSpLast" style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry has not provided any boundary wall, however fencing provided along two sides of the site.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">In view of above, the industry has been issued show cause notice before refusal of 'consents to operate' under the Water Act, 1974 & Air Act, 1981 and notice u/s 33-A of the Water Act, 1974 with an opportunity of personal hearing on 17.10.2022.</span></p>
<p class="MsoPlainText" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;">During hearing, neither any representative of the industry attended the hearing nor submitted any reply in the matter. </span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; font-style: normal;"><span style="mso-tab-count: 2;"> </span>After considering the material facts on the file, it has been decided by Chief Environmental Engineer (B) that:-</span></p>
