<p class="MsoNormal" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is submitted that the industry was earlier granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2018/8041056 dated 25/07/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2018/8041038 dated 25/07/2018, both of which were expired on 30/09/2022 for operation of Crusher only @ 7,000 CFT/day subject to the suitable conditions mentioned therein. </span></p>
<p class="MsoNormal" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for obtaining renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of Crushing & Screening of Aggregates @ 7000 CFT/Day. However, earlier, the unit was granted consent only for operation of crusher for which a clarification has been raised. In reply to the clarification, the unit has submitted an undertaking, wherein, it has mentioned that the unit has wrongly applied for obtaining consent to operate for operation of screening plant. Further, the applicant has requested to grant consent to operate for operation of crusher only.</span></p>
<p class="MsoNormal" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The unit has submitted undertaking regarding code of practice and regarding legal mining, raw material slips from mining site Bari Haveli, compliance of previous consent, and consent fee. The unit has submitted the CA certificate wherein the value of fixed assets of the industry as on 16.09.2022 is of Rs. 95.57 Lakhs with the value of plant and machinery of Rs. 92.22 lakhs. Further, as per record file, the fee deposited by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was adequate upto 30.06.2023 as per circular dated 18.07.2013.</span></p>
<p class="MsoNormal" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the unit has deposited Rs. 28,000/- vide UTR No. FDRLH22265437847 dated 22.09.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 28,000/- vide UTR No. FDRLH22265437658 dated 22.09.2022, Rs. 500/- as application form fee under the Air (Prevention & Control of Pollution) Act, 1981. As such, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 is adequate upto 31.03.2028 as per circular dated 29.10.2018. </span></p>
<p class="Default" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: 'Bookman Old Style', 'serif'; color: windowtext;">It is added here the unit has also submitted Rs. 7198/- vide R. No. 46/5324 dated 27.09.2022, as advance fee w.r.t the stack emission samples and has requested to conduct the sampling through the Board, which shall be conducted shortly.</span></p>
<p class="Default" style="text-align: justify; margin-bottom: 6pt; text-indent: 1in; line-height: 24px;"><span style="font-size: 11pt; line-height: 22px; font-family: 'Bookman Old Style', 'serif'; color: windowtext;">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar has informed through e-mail dated 20.10.2022 that there are 03 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur and Bari Haveli for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bari Haveli de-silting site.</span></p>
<p class="MsoBodyText" style="margin: 5.95pt 0in 6pt 5pt; text-indent: 67pt; line-height: 155%; text-align: justify;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, as per circular no. 443 dated 09.08.2021, the case for renewal of NOC/Consent to operate for Red, Orange and Green category of small scale industries/projects, without inspection/physical verification of the environmental parameters at the time of submission of such applications is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. As such, the stone crusher unit covers under orange category and was not visited to verify the compliance before processing the current application.</span></p>
<p class="MsoBodyText" style="margin: 5.95pt 0in 6pt 5pt; text-indent: 67pt; line-height: 155%; text-align: justify;"><span style="font-family: 'Bookman Old Style', 'serif';">In view of the above facts, may if approved, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">This consent is granted for operation of Crusher @ 7,000 CFT/Day only.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit shall intimate this office within 15 days after starting its operation so that ambient air sampling can be carried out.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The unit shall obtain raw material from the Govt. approved mining sites only and shall not indulge itself into any kind of illegal mining. If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry will comply with the guidelines/code of practice issued by the Govt. of Punjab, Department of Science, Technology and Environment Vide dated 17.03.1988, amended in 01.02.2006 and lastly amended vide no. 3/35/2013-STE(4)734 dated 30.07.2013 at all<span style="letter-spacing: 2.85pt;"> </span>time.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0.05pt 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry will comply with all the provisions under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,<span style="letter-spacing: 1.05pt;"> </span>1981.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The stone crusher shall maintain a stock register to justify the legitimate source of mining material, its availability, usage and sale etc.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 59pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry will submit half yearly return to this office duly verified by the Mining officer by 15th of July and 15th Jan of every year.</span></p>
<p class="MsoListParagraph" style="text-align: justify; margin: 0in 0in 0.0001pt 58.5pt; text-indent: -23pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">This consent does not bestow any ownership rights with the consent holder and further the CTO is being granted only from pollution angle and cannot be used as any legal tool/document to ascertain/confirm proprietary rights</span><span style="font-family: 'Bookman Old Style', 'serif';">.</span></p> |
