The complainant also alleged that the industry is in the process of expansion, which leads to parking of vehicles on the road leading to traffic congestion in the area.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 70.9pt; line-height: 12.65pt;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Calibri; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">The site of the industry located at F-434, Phase-8B, Mohali was visited by the AEE of this office on 19.03.2021 and Sh. Satish Dattana, Proprietor of the unit was contacted and it was observed as under:-</span></p>

(Plate 1). The industry has also provided one no baking oven.</span></li>

It is pertinent to mention here that only green category of the industries are allowed to step up in Industrial Area, Phase-8B. As per record of this office, the industry has not obtained Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 from the Board.</span></p>

Birdevender Singh in order to ensure compliance of the decisions of the personal hearing given to the Industry on 29.04.2021 and contacted Sh. Satish Dattana, Proprietor. During visit, the Proprietor don't allowed the officers of the Board to seal the machinery installed in the industry (not covered under green category) and DG set. Accordingly, the report was sent to Competent Authority of the Board.</span></p>

Accordingly, a written reply was sent by their industry on 27.04.2021. However, without hearing the industry, the Board released the order of sealing of process. The plot is allotted by PSIEC vide letter no. 29133 dated 21.02.2018 to them. The industry requested to provide an opportunity of personal hearing to present their case.</span></p>

The project proponent has installed DG set of adequate stack height provided with canopy.</span></p>

F-434 Phase VIII-B at focal point, Mohali, under general scheme in general category approved by PSIEC vide no. PSIEC/ESTATE/ 31997 dated 28.03.2018. The project proponent has submitted allotment letter for additional land falling behind to industrial plot nos. F-433 & F-434, Phase VIII-B, Focal Point, SAS Nagar approved by PSIEC vide no. PSIEC/ESTATE/27613-17 dated 13.12.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The industry was visited by under-signed on 27.10.2022 and contacted Sh. <p class="MsoListParagraphCxSpLast" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The industry is located adjoining to residential township namely Janta Township, Sector-90-91, Mohali and one group namely K C land and finance limited, Gh-1, sector-90- 91, Mohali is located within 100 mtr of the industry , however the construction work of the group housing has been found stopped as observed during visit dated 27.09.2022 & visit dated 27.10.2022. Further, the industry is located at a distance of around 100-120 mtr from residential plots of sector 90-91, Mohali.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Hence, the industry is not complying with the hearing decision no. 1 dated 05.10.2022, however PSIEC has allotted the plot to the project proponent for manufacturing of tractor parts in 2008 but the activities which are allowed is not mentioned. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Regarding whether the site is suitable for establishment of such type of industries, it is submitted that regarding establishment of green categories industries, Industrial focal point Phase-8 B, Mohali, Member Secretary, Punjab Pollution Control Board vide its letter no. MHL/24/2008/591-92 dated 18/02/2008 has written to principal secretary Department of Industry & Commerce, and Managing Director, PSIEC, stating that a meeting was held in the office of Principal Secretary Department of Industry & Commerce on 19/12/2007 in connection with the matter of establishment of green category industries in industrial focal point Phase-8 (B), Mohali, wherein, it was informed that the industries of only low-polluting nature are allowed to be setup in the above said Focal Point and the PSIEC has also allowed residential pockets in this Focal Point. Hence, it is requested to ensure that allotment of plots is made only to green categories of industries in the said Focal Point.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">As per master plan of SAS Nagar dated 05/12/2016, sector 74 (phase 8B) is classified as industry and warehouse zone intended for intended to be used for green industry, orange industry and warehouse uses such as Computer software development, Knowledge Park, Assembly and repair of computer hardware and electronic equipment, Printing, publishing and allied industries, Packing of dried foodstuff and Warehouse except for storage of chemicals.</span></p>
<p class="MsoNormal">In view of above, it is recommended that show cause-cause notice for refusal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing may be issued to the industry.</p>
