<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; color: black;">The industry was granted ‘consent to operate’ under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH2/2020/11896439 dated 22.01.2020 valid upto 30.09.2022 for manufacturing of Bricks & Tiles @ 26700 No/day from Clay & Sand @ 80 MTD </span><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1;">alongwith Induced draft technology with zig-zag firing using Coal @ 5 Metric Tonnes/Day<span style="mso-spacerun: yes;"> </span>as fuel, subject to conditions mentioned therein.</span><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; color: black;"> </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><strong><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Consent fees details:</span></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry has submitted the CA Certificate for un-depreciated value fixed assets of Rs.12.61 Lacs as on 31.03.2022. The industry has deposited the consent fees as under:</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><strong><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Under the Air Act, 1981(including penalty, NOC Regularization fee, balance Water Act, 1974 fee):</span></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Rs. 11000/- vide R.No 947145034 dated 07.10.2022. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Rs. 9000/- vide R.No. 976329896 dated 01.11.2022. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The consent fee (collectively under both the Acts) deposited by the industry is adequate upto <strong>30.09.2027</strong> under both the Acts. The NOC Regularization fee is adequate for one year.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry has proposed submersible pump as source of fresh water. The industry has proposed not to generate any trade effluent and to generate domestic effluent @ 2.6 KLD for which septic tank is installed for its treatment and treated waste water to be discharged onto land for plantation.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Accordingly, the industry was visited by the undersigned on 11.11.2022 and contacted Sh. Jagjit Singh, representative of the industry. The observations made during visit and detail of the case is as under:</span></p>

However, same is not safe. Further, port hole with the stack is not provided.</span></p>

No outlet observed with these tanks. Further, sullage water is discharged into unlined pit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">16.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry has not submitted the emission analysis report.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; margin: 0in 0in .0001pt 27.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The representative of the industry informed that it shall be operated in next year season.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; margin: 0in 0in .0001pt 27.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The copy of visit report is given to the industry.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-indent: 27.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">From above it is clear that the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-indent: 27.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">In view of above, if approved, the application for grant of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused please.</span></p>
