File Note: <p>RO has reported that earlier, the industry was granted consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for the production of industrial packing material vide online reference no. CTOW/Renewal/GRP/2018/7024086 &amp; CTOA/Renewal/GRP/2018/7024072 dated 27/02/2018 which were valid upto 31/12/2022.</p> <p>The industry was visited by officer of this office on 28/02/2022 to verify the latest status of the industry and observed that the industry was in operation and was engaged in manufacturing of plastic carry bags by using recycled plastic granules as raw material. The industry has installed 05 no extruding machines out of which 01 no. extruding machine was not operational. The industry has installed 03 no. sealing/cutting machines.</p> <p>The industry was violating the directions earlier issued by the Board u/s 31-A of Air (Prevention &amp; Control of Pollution) Act, 1981 and 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. 2242 and 2241 dated 26/05/2016. Accordingly, it was recommend to Zonal Office, Amritsar to initiate action against the industry for its closure. SCN vide letter no. 1173-74 dated 21/04/2022 was issued to the industry but the industry was failed to submitted any reply regarding SCN issued to this office. SCN was issued vide letter no. 2078-79 dated 21/06/2022 with an opportunity of personal hearing at zonal office, Amritsar.</p> <p>After hearing dated 30/06/2022 Senior Environmental Engineer, Zonal Office, Amritsar has decided to seal 02 extruders of the industry and directed to this office to submitted compliance immediately. In compliance of the decisions of the proceedings of the personal hearing before the Senior Environment Engineer, at Amritsar, the industry was visited by AEE of this office on 20/07/2022 and it was observed as under:-</p> <p>1.&nbsp;&nbsp;&nbsp;&nbsp; The industry was not in operation during visit.</p> <p>2.&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed 05 nos. extruders out of which 01 no. was out of order.</p> <p>Report of the compliance of the decisions of the personal hearing was sent to zonal office, Amritsar vide e-note dated 01/08/2022. As the industry was installed 05 nos. extruders for manufacturing of plastic sheets which are being further used for manufacturing carry bags and remaining machinery was sealed after obtaining approval from zonal office, Amritsar. Report of the same was sent to zonal office, Amritsar for information. The Higher Authority has also imposed Environmental Compensation of Rs. 2.0 Lakh to the industry for violations of the provisions of the Environmental Acts.</p> <p>Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for the production of Industrial Packing Material @ 170 Kgs/Day from Virgin Plastic &amp; Granules @ 30 Kgs/Day from Waste Plastic sheet from process. The project proponent has submitted various documents, which are enclosed along with the application, which may kindly be pursued.</p> <p>The industry has deposited Rs. 9500/- vide UTR No. 917794289 dated 10/10/2022 under Water Act, 1974 including Rs. 500/- as application fee &amp; Rs. 9000/- vide UTR No. 634575032 dated 10/10/2022 under Air Act, 1981 which are adequate upto 30/09/2027 under both Acts.</p> <p>The industry is an existing unit and falls in focal point area, the industry has submitted allotment letter issued from allotting authority i.e. the Directorate of Industries, Punjab. The industry has already submitted approved building plan. The industry has already submitted copy of registration under small scale industries.</p> <p>The industry has submitted an affidavit for operation of the unit as per guidelines framed by the Govt. and has submitted that they will not manufacturing plastic carry bags in future or any other item which has already banned by the Govt.</p> <p>It is further intimated that the industry has deposited Rs. 50,000/- vide R.No. 91/5398 dated 13/09/2022 &amp; Rs. 50000/- vide R/No. 98/5398 dated 20/10/2022 as Environmental Compensation imposed by the Board (01 Lakh out of 2.0 Lakh) and the industry has requested to allow to deposited remaining amount of Environmental Compensation in installments due to his financial problems.</p> <p>The industry was visited by AEE of this office on 10/11/2022 and observed that the industry was not in operation and machinery sealed earlier by the Board found intact.</p> <p>RO has recommended that:-</p> <p><span lang="EN-IN">1.&nbsp;&nbsp;</span><span lang="EN-IN">The consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted to the industry for a period upto 30/09/2027 for the production of Industrial Packing Material @ 170 Kgs/Day from Virgin Plastic &amp; Granules @ 30 Kgs/Day from Waste Plastic sheet from process as per policy of the Board.</span></p> <p><span lang="EN-IN">2.&nbsp;&nbsp;</span><span lang="EN-IN">Necessary directions may be issued to the industry for de-sealing of machinery.</span></p> <p><span lang="EN-IN">3.&nbsp;&nbsp;</span><span lang="EN-IN">The industry shall permit to deposit remaining amount of Environmental Compensation @ 1.0 Lakh on instalments.</span></p> <p>4. The industry shall apply for obtaining registration under Plastic Waste Management Rules, 2016 within 02 months.</p> <p>&nbsp;</p> <p>In view of above, it is recommended that:-</p> <p><span lang="EN-IN">1.&nbsp;&nbsp;</span><span lang="EN-IN">The consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted to the industry for 06-months for the production of Industrial Packing Material @ 170 Kgs/Day from Virgin Plastic &amp; Granules @ 30 Kgs/Day from Waste Plastic sheet from process as per policy of the Board.</span></p> <p><span lang="EN-IN">2.&nbsp;&nbsp;The d</span><span lang="EN-IN">irections u/s 33-A of Water Act and u/s 31-A of Air Act may be issued to the industry for de-sealing of machinery.</span></p> <p><span lang="EN-IN">3.&nbsp;&nbsp;</span><span lang="EN-IN">The industry shall permit to deposit remaining amount of Environmental Compensation @ 1.0 Lakh in two equal instalments of Rs. 50,000/- on monthly basis.</span></p> <p>4.
