It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2021/17231951 dated 02/11/2021 valid upto 30/09/2023 and the Air Act, 1981 vide no. CTOA/Renewal/SGR/2021/17231954 dated 02/11/2021 valid upto 30/09/2022, for manufacturing of Sorted Raw Rice (without Dryer) @ 3.0 TPH by processing of Paddy @ 4.5 TPH, as raw material under orange category on the name of M/s Bansal Cotton Mills, Village Bhutal Kalan, Jaloor, Tehsil Lehra, Distt. Sangrur in the name of Smt. Rashmi Bansal (Partner). Now, the industry is purchased by new firm namely M/s Divia Shine Foods, Village Bhutal Kalan, Jaloor, Tehsil Lehra, Distt. Sangrur and the sale certificate submitted by the new firm which is duly attested by authorized officer of PNB Bank, wherein it is mentioned that the industry is sold on behalf of the PNB, Patiala in favour of Sh. Raj Kumar S/o Sh. Krishan Gopal and Sh. Inder Sain S/o Sh. Jagan Nath. The industry has also submitted partnership deed executed on 27.05.2022, wherein the details of all the partners is mentioned as below: - 1.    Sh. Raj Kumar S/o Sh. Krishan Gopal 2.    Sh. Inder Sain S/o Sh. Jagan Nath Accordingly, the industry applied for obtaining fresh consents to operate under the Water Act, 1974 & the Air Act, 1981, for the production of Sorted Raw Rice (without Dryer) @ 3.0 TPH by processing of Paddy @ 4.5 TPH, as raw material in new name & style of M/s Divia Shine Foods, Village Bhutal Kalan, Jaloor, Tehsil Lehra, Distt. Sangrur under the name of Sh. Inder Sain (Partner). The industry had deposited Rs. 9000/- Vide R.No. AXSK222590000965 dated 16/09/2022 under the Water Act, 1974 and Rs. 9000/- Vide R.No. AXSK222590000959 dated 16/09/2022 under the Air Act, 1981, fee in previous returned applications.  Now, the industry has deposited Rs. 2900/- Vide R.No. 349327949 dated 09/11/2020 as NOC regularization fee under the Air Act, 1981, against the value of fixed assets of Rs. 98.10 lacs as per CA certificate dated 07/10/2022. The aggregate fee after considering the fact of change in value of fixed assets after purchasing the firm, after deduction the penalty the adequacy of the fee becomes upto 31.12.23 under both the Acts. The industry has not got analyzed its stack emission sample from Board/Board's approved lab.                    The industry has also submitted compliance report of consent conditions earlier granted to it under the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time, in future as and when required by PPCB or Punjab Govt.                    Accordingly, the industry was visited by undersigned on 11/11/2022 and it was observed as under:- <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">1)    The industry was not in operation and has installed the machinery in its premises for the production of sorted raw rice without dryer. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">2)    The industry has covered all the processing sheds. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">3)    The industry has installed cyclone as APCD for shelling section. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">4)    The industry has provided brick wall of 15 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">5)    The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided jali of height 5 ft above this wall. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">6)    The industry has no source of trade effluent generation. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">7)    The industry has provided sampling arrangements with the stack of the APCD. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">8)    The industry has constructed septic tank for treatment of domestic effluent of the toilet section and disposal onto land for plantation. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 21.3pt;">9)    The industry has planted sapling of trees along the boundary wall. 10) The industry has stabilized the movement area of vehicles from gate to husk area and rice room to prevent the generation of dust emissions.                    From above, it is found that the industry is complying with the consent conditions earlier granted to the industry & the industry is complying with the code of practice notified by the Govt. of Punjab, Deptt. of Science, Technology & Environment.                    The competency for grant of consents to the rice shellers with or without dryer lies with the Environmental Engineer of the Regional Office. Keeping above in view, it is recommended that fresh consent to operate granted under the Water Act, 1974 may be granted upto 30.09.2023 and under the Air Act, 1981 may be granted for one year i.e. upto 30/09/2023 for manufacturing of Sorted Raw Rice (Without Dryer) @ 3.0 TPH by processing of Paddy @ 4.5 TPH under orange category in name & style of M/s Divia Shine Foods, Village Bhutal Kalan, Jaloor, Tehsil Lehra, District Sangrur, subject to certain conditions to be mentioned therein.
