<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">Earlier, Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was granted to the industry for processing and production of Rice@ 13 TPH which were valid upto 30.09.2022. The industry has installed 4 shelling section of capacity 13 TPH and 1 Dryer of capacity 1.2 TPH.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">Thereafter, the industry has obtained Consent to Establish for Expansion under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of two standby drier of capacity 1.2 TPH with bag house as APCD which was valid upto 23.01.2021 and was further extended upto 28/02/2023 subject to suitable conditions based on the visit on 02/03/2022.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">The industry has now applied for Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 by the name of M/s Innova Food Industries.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">The industry has submitted Lease agreement between Smt. Narinder Kaur and M/s Innova Food Industries Ltd. The industry has also submitted CA Certificate for total investment made by the firm as on 30.09.2022 and sale of Machinery from M/s Ganeshay Overseas to Narinder Kaur C/o Innova Food Industries. The license granted to the firm by Punjab State Agricultural Marketing Board is also attached.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">As the industry has submitted the sale of machinery to Narinder Kaur C/o Innova Food Industries but the lease deed have been submitted between Narinder Kaur and Innova Food Industries which is not in order. The industry is non-operational from long time due to which air emission samples could not be collected but obtaining Consent to Operate from the Board for short terms regularly.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">Accordingly, show-cause notice for refusal of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry to explain above said reasons along with opportunity of personal hearing.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">The representative of the industry has appeared for the hearing and submitted that Smt. Narinder Kaur is the partner of the Industry in M/s Innova Food Industries Ltd. The land is in the name of Smt. Narinder Kaur and the machinery is in the name of Innova Food Industries. The amended CA Certificate mentioning the cost of land has been prepared and will be submitted. They also submitted that the industry is non-operational from long time due to finance constraints and will be operational soon.</p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in;">After the hearing, it was decided as under: -</p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -0.25in;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry will submit the amended CA Certificate mentioning the value of land and will submit the consent fee accordingly.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The industry will inform in writing as and when it comes in operation so that air emission samples could be taken.</p>

<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span>The Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 will be granted for short term i.e. six months period subject to suitable conditions after the industry complies with point ‘1’ above.</p>
