File Note: <p class="MsoNormal"><span lang="EN-US">Online agenda is generated, the detail of the case are as under : -</span></p> <p class="MsoNormal"><span lang="EN-US">The colony was granted consent to establish (NOC) vide no. CTE/Fresh/BTI/2020/12060634 dated 06.02.2020 valid upto 03.02.2021 for Development of Residential colony namely &lsquo;New Janta Colony, having 75 Residential Plots and 14 Commercial Plots in an area of 6.28 Acres, subject to the suitable conditions and special condition that the colony will obtain change of land use from the concerned Department, within 3 months. </span></p> <p class="MsoNormal"><span lang="EN-US">Now the colony has applied in the extension of the validity of consent to establish (NOC) under the Water Act, 1974 &amp; Air Act, 1981. </span></p> <p class="MsoNormal"><span lang="EN-US">The colony has deposited Rs. 25200/- vide online R. No. </span><span lang="EN-US" style="font-size: 8.0pt; line-height: 107%; font-family: 'Verdana','sans-serif'; color: #2b4973; background: #E8F6F9;">N309222193079931 </span><span lang="EN-US">dated 5.11.2022 as NOC regularization fees. </span></p> <p class="MsoNormal"><span lang="EN-US">The project promoter has earlier submitted that the project report as per which the development cost including the cost of land will cost of Rs. 4.69 crore approx. Therefore, the competency to grant the application lies with the SEE, Zonal Office, Bathinda.</span></p> <p class="MsoNormal"><span lang="EN-US">The project promoter has submitted provisional regularization certificate for approval of an unauthorized colony i.e. New Janta Colony, RampuraPhul vide no. DDLG-19/2655 dated 29.07.2019 for an area; measuring 6.28 acres.</span></p> <p class="MsoNormal"><span lang="EN-US">The colony has earlier submitted the plan showing the plots alongwith commercial shops with the signature / stamp of EO, MC, RampuraPhul and Senior Town Planner, Bathinda region, Department of local government. </span></p> <p class="MsoNormal"><span lang="EN-US">The industry has earlier submitted the approval from the Competent Authority, Deputy Director, local government, Bathinda obtained on 29.07.2019 for the unauthorized colony. </span></p> <p class="MsoNormal"><span lang="EN-US">The colony has obtained permission from MC RampuraPhul regarding sewer connection and discharge of treated effluent in to sewer.<a name="_GoBack"></a></span></p> <p class="MsoNormal"><span lang="EN-US">The site of the colon was visited by the AEE of this office on 12.11.2022 and observed as under:</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">1. The colony is situated inside the MC limit of the RampuraPhul on the phul Road.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">2. The PP has developed the road network, drinking water network, sewage system and other basic facilities inside the colony. </span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">3. No house has been completed inside the colony. However, 4-5 houses are under construction.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">4. The colony has installed STP consisting of components such as Collection tank- Oil &amp; Grease &ndash; Bio-reactor &ndash; Secondary settler &ndash;sand filter- Chlorine dosing &ndash;outlet. Since there is no generation of the effluent the STP was non-operational.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">5. The colony has not installed any D.G. set. </span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">6. The colony has provided 0.3 acres of land under parks and green area wherein treated effluent can be utilized. </span></p> <p class="MsoNormal"><span lang="EN-US">Recommendation: </span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US">Keeping in view of above, it is recommended that the validity of Consent to Establish (NOC) granted to the project promoter for development of a residential colony with 75 no. residential plots of different sizes and 14 no. commercial plots in the revenue estate of RampuraPhul may be extended for a period of 1 year, subject to suitable conditions and special conditions that with the condition that</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US">The Colony shall make provisions for in-house management of Solid Waste as per SWM Rules, 2016.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US">The colony shall lay the pipeline for reuse of the treated effluent.</span></p>
