CTOW/Fresh/SAS/2019/10969659 dated 22.10.2019 which is valid upto 30.06.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2019/10969534 dated 22.10.2019 which is valid upto 30.06.2023 for manufacturing of Nut, bolts & fasteners with Electroplating @ 1.0 MTD by using MS wire @ 1.1 MTD, Zinc @ 3 Kgs/day, Hydrochloric acid @ 20 Kgs/day, Zinc Chloride @ 8 Kgs/day under the name and style of M/s Fixwell Fasteners, E-30, Industrial Focal Point, Derabassi, SAS Nagar subject to certain terms and conditions mentioned therein.</span></p>

<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was given personal hearing before the Environmental Engineer of the Board on 23.02.2022, wherein it was decided as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l7 level1 lfo2; margin: 0in .7pt 6.0pt .5in;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">Action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 shall be recommended to Zonal Office-1, Patiala.</span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The above violation was recommended to the Competent Authority of the Board through E-noting no. 18153098.</span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was issued SCN for revocation/ cancellation of consent to operate granted under the Water Act, 1974 and the Air Act, 1981 alongwith an opportunity of personal hearing before the SEE (ZP-1) of the Board on 12/4/2022 vide Board's letter no. 1991-92 dated 24/3/2022. The industry was given personal hearing before the Senior Environmental Engineer of the Board, wherein, it was decided as under:</span></p>

<p class="MsoBodyText" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo8; margin: 0in .7pt 6.0pt .5in;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The application to be submitted by the industry shall be processed on merits after the visit of the site.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The above violation was recommended to the Competent Authority of the Board through E-office file no. E-103006.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was issued show cause notice for violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 2022-23 dated 25.03.2022 alongwith an opportunity of personal hearing before the SEE (ZP-1) of the Board on 12.04.2022. The industry was given personal hearing before the Senior Environmental Engineer (ZP-1) of the Board, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo4;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry shall not start any polluting process without the prior permission of the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo4;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry shall obtain consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for its existing processes being carried out in its premises.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo4;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The Environmental Engineer Regional Office, SAS Nagar shall visit the industry and verify the statements of the industry made during the hearing and send his report/recommendations in the matter.</span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><u><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">M/s Fixwell Fasteners, E-28, E-29 & E-30, Industrial Focal Point, Derabassi</span></u></strong></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">Now, the industry has applied for obtaining varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of NUT, BOLT & FASTENERS @ 3.5 MTD, Electroplating of nut, bolt & fasteners @ 1.5 MTD by using Zinc @ 4.5 Kgs/day, Hydrochloric acid @ 30 Kgs/day, Zinc Chloride @ 12 Kgs/day, MS wire @ 4 MTD, H2SO4 @ 25 Kgs/day as a raw material under the name and style of M/s Fixwell Fasteners, E-28, E-29 & E-30, Industrial Focal Point, Derabassi.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry had earlier deposited Rs. 18,600/- (Rs. 9000/- each under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 600/- as application form fees) vide R. no. 83/4613 dated 25/04/2018. Rs. 8900/- (Rs. 4200/- each under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and Rs. 500/- as application form fees) vide R. no. 54/4864 dated 20/09/2019. The fee deposited is adequate upto 31/01/2024, under both the Acts. (20.722 lacs)</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has deposited Rs. 16700/- vide R. No. 640616367 dated 12.03.2022 and Rs. 30300/- vide R. No. 142506508 dated 03.11.2022 under Water (Prevention & Control of Pollution) Act, 1974. The total fee deposited by the industry under Water (Prevention & Control of Pollution) Act, 1974 is adequate upto 31.01.2027 (Rs. 2800/- under Water (Prevention & Control of Pollution) Act, 1974 additional / extra) against the total cost of the industry Rs. 92.61 lacs.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has deposited Rs. 11300/- vide R. No. 637888244 dated 12.03.2022 and Rs. 28000/- vide R. No. 2227224 dated 28.10.2022 under Air (Prevention & Control of Pollution) Act, 1981. The total fee deposited by the industry under Air (Prevention & Control of Pollution) Act, 1981 is adequate upto 31.01.2027 (Rs. 1500/- under Air (Prevention & Control of Pollution) Act, 1981 additional / extra) against the total cost of the industry Rs. 92.61 lacs.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under the name and style of M/s Fixwell Fasteners, E-30, Industrial Focal Point, Dera Bassi, Distt. SAS Nagar.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; margin: 12.0pt 0in 12.0pt 0in;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry i.e. plot no. E-28 falls in Industrial Focal Point, Dera Bassi. PSIEC vide its letter no. PSICE/ESTATE/EO/4654 dated 25.05.2018 transferred plot no. E-28, IFP, Derabassi measuring 1001.38 sq. yards favour of Sh. Satbir Singh S/o Sh. Om Prakash,, of the industry with subject to certain conditions mentioned therein on 99 years lease hold basis for manufacturing of “manufacturing of Unit for Screws”.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; margin: 12.0pt 0in 12.0pt 0in;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry i.e. plot no. E-29 falls in Industrial Focal Point, Dera Bassi. PSIEC vide its letter no. PSICE/ESTATE/8735 dated 30.07.2020 transferred plot no. E-29, IFP, Derabassi measuring 1002 sq. yards favour of Sh. Satbir Singh S/o Sh. Om Prakash, Prop. of the industry with subject to certain conditions mentioned therein on 99 years lease hold basis for manufacturing of “Screw, Nut Bolts, MS & SS Wire and Plating Plant on Fasteners”.</span></p>
<p class="MsoNoSpacing" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; margin: 12.0pt 0in 12.0pt 0in;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry i.e. plot no. E-30 falls in Industrial Focal Point, Dera Bassi. PSIEC vide its letter no. PSICE/ESTATE/EO/8541 dated 05.11.2015 transferred plot no. E-30, IFP, Derabassi measuring 1002 sq. yards favour of Sh. Satbir Singh S/o Sh. Om Prakash, of the industry with subject to certain conditions mentioned therein on 99 years lease hold basis for manufacturing of “Screw, Nut Bolts, Draw MS & SS Wire and Hard Plating”.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has submitted rent agreement of plot no. E-28, E-29 & E-30 between Sh. Satbir Singh S/o Sh. Om Parkash R/o # C-4, Panchsheel Enclave, Zirakpur, Sub-Tehsil Zirakpur, Tehsil Derabassi, Distt. SAS Nagar (hereinafter referred to as landlord which term shall where the context so admits include his/her, assigns, executors, successors legal representative and Id administrators) of the Part and Mrs. Preeti Prop. M/s Fixwell Fasteners R/o # C-4, Panchsheel Enclave, Zirakpur, Sub-Tehsil Zirakpur, Tehsil Derabassi, Distt. SAS Nagar (hereinafter referred to as tenant/s which term shall where the context so admits include his/her, assigns, executors, successors legal representative, administrators of the other Part.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has submitted a letter in which mentioned that:</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">“Liquid Effluent:</span></em></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><em><span style="font-family: Tahoma, 'sans-serif';">There is existing generation of trade effluent from the process is 0.2 KL/day and for the treatment and disposal of this trade effluent earlier we have an agreement with M/s. JBR Technologies, Ludhiana. They lift this trade effluent and treat the same at their treatment facility. We have already provided a tank for collection of this effluent. There is increase of trade effluent from increase of electroplating from 1 MTD to 1.5 MTD is 0.2 KLD. Hence, there is total generation of trade effluent will be 0.4 KLD for which we already have an agreement of 15 Kl/month with M/s Water Bantech Pvt. Ltd. (Chanalon). Therefore there is no ETP required from our end.</span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">Domestic Effluent:</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: normal;"><em><span style="font-family: Tahoma, 'sans-serif';">There will be domestic effluent being generated will be around 1.6 KL/day. (0.8 KLD from the existing and 0.8 KLD from the addition). The same will be discharged into PSIEC Sewer.”</span></em></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry has submitted site plan of plot no. E-28, E-29 & E-30 approved by Er. Jasvir Singh, Competent Person approved under, Punjab Factory Act. The industry has submitted an agreement with M/s Bantech Water Private Limited, Chanalon for the lifting of trade effluent @ 15000 liters per month.</span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The site of the industry was visited on 10.11.2022. During the visit, it was observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry is engaged in the business of manufacturing of nuts, bolts and fasteners alongwith surface treatment i.e. zinc / nickel electroplating over the manufactured products in its plot no. 28, 28 & 30.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The source of fresh water is PSIEC. The industry is maintaining the record regarding the consumption of fresh water.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry has installed 07 no. zinc barrels, 05 number nickel polish barrels i.e the industry has increased its production without the prior permission of the board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry has started maintaining the record regarding the generation and disposal of effluent. The industry getting its trade effluent lifted through authorized recycler.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry has installed hardening furnace as well as tempering furnace separately.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l8 level1 lfo10;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry has complied with the observations of the earlier visits and complying with the decisions of the personal hearing held before the Senior Environmental Engineer of the Board.</span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2026 subject to suitable terms and following additional conditions:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo5;"><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-IN" style="font-family: Tahoma, 'sans-serif';">The industry shall maintain the record of trade effluent generated, got lifted by M/s Bantech Water Private Limited, Chanalon & balance quantity of trade effluent remained collected in the collection tank and submit the record of same to this office on monthly basis to the Board.</span></p>
