CTOW/Renewal/LDH3/2021/16001974 dated 09.08.2021 expired on 30.09.2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH3/2019/10073027 dated 22.08.2019, valid upto 30.09.2023 for manufacturing of premix @ 90 TPH and RMC @ 60 m<sup>3</sup>/h subject to the conditions mentioned therein.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 81.0pt; line-height: 150%; tab-stops: 81.45pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The HMP was found emitting</span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> thick smoke during visit to the area on 04.10.2021. To verify the same, the hot mix plant was visited by officer of the Board and it was observed as under:- </span></p>
<p class="MsoBodyTextIndent3" style="text-align: justify; text-indent: -18.75pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0in 0in .0001pt 18.75pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The hot mix plant was in operation, however the representative of the HMP immediately stopped its plant on arrival of the visiting officer. </span></p>
<p class="MsoBodyTextIndent3" style="text-align: justify; text-indent: -18.75pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0in 0in .0001pt 18.75pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The hot mix plant has installed Gravity Settling Chamber followed by wet scrubber as APCD with asphalt drum. The HMP has provided water re-circulation system with wet scrubber. The water recirculation tanks were found choked and thick sludge removed from water re-circulation system was found placed in open near the ETP area in large quantity.</span></p>
<p class="MsoBodyTextIndent3" style="text-align: justify; text-indent: -18.75pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0in 0in .0001pt 18.75pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The metalled road provided by the hot mix plant in movement area was found covered with dust and raw material storage / handling was also not proper. </span></p>
<p class="MsoBodyTextIndent3" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 and is not complying with the code of practice prescribed for such type of units vide Board’s notification dated 26.04.1999. </span></p>
<p class="MsoBodyTextIndent3" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Accordingly, show cause notice for cancellation of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was issued to the HMP with personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 18.11.2021 and it was decided as under:- </span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo3; margin: 0in 0in .0001pt 32.15pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The hot mix plant shall operate and maintain its air pollution control device (APCD) regularly and efficiently, so as to achieve the stack emission standards, consistently as prescribed by the Board/ MoEF&CC and as amended from time to time. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo3; margin: 0in 0in .0001pt 32.15pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The hot mix plant shall ensure that no black smoke is emitted from its stack under any circumstances. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo3; margin: 0in 0in .0001pt 32.15pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The hot mix plant shall comply with the code of practice as prescribed for such type of units in true letter and spirit at all the times.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo3; margin: 0in 0in .0001pt 32.15pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Environmental Engineer, Regional Office-3, Ludhiana shall verify the contentions of the reply and compliances made by the hot mix plant. He shall carry out stack emission sampling of the hot mix plant and submit the report/ recommendations, within 20 days. </span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l4 level1 lfo3; margin: 0in 0in .0001pt 32.15pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Further action in the matter will be taken after receipt of report from Environmental Engineer, Regional Office-3, Ludhiana.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 81.0pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Thereafter, the HMP was visited by AEE of this office on 29.12.2021 alongwith scientific staff to collect stack emission samples, however, HMP was not in operation and its premises was found locked. Thereafter, during visit to the Humbran Noorpur area, the HMP was found not in operation. <span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 81.0pt; line-height: 150%; tab-stops: 81.45pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Now, the industry has applied for Varied ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for production of Curve Stone, Bridge, Paver & Tiles @ 5000 no./day in addition to the existing production of premix @ 90 TPH and RMC @ 60 m<sup>3</sup>/h.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 81.0pt; line-height: 150%; tab-stops: 81.45pt;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The industry has deposited Rs. 42,840/- vide UTR No. AXIC223138000639 dated 09.11.2022 under the Water Act, 1974 and Rs. 33,600/- vide UTR No. AXIC223137999767 dated 09.11.2022 under the Air Act, 1981, which is adequate for period upto 30.09.2027 under both acts. The industry has also deposited </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">Rs. 1800/- vide UTR No. AXIC223138000639 dated<span style="letter-spacing: .05pt;"> </span>09.11.2022 as NOC regularization fee for increase in fixed assets. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>T<span style="color: black;">he industry was visited by AEE of this office on 15.11.2022 and it was observed as under:-</span></span></p>

<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was not in operation. However, presence of raw material indicated that it will also operate in upcoming days. </span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has installed one no. hot mix plant and has provided Gravity Dust Settling Chamber followed by Water Scrubber as APCD with asphalt drum of hot mix plant. Stack of adequate height along with sampling platfarm provided after APCD. Water re-circulation tanks provided with wet scrubber were cleaned and proper re-circulation system is provided.<span style="mso-spacerun: yes;"> </span></span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has installed one no. DG set of capacity @125KVA, equipped with canopy along with adequate stack height.</span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">There is no generation of trade effluent and only domestic effluent is generated from the premises. The industry has provided septic tank for treatment of its domestic effluent.</span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has provided plantation for discharge of its domestic effluent. </span></li>
<li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo1;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has now stabilized its movement area to suppress dust emissions. </span></li>

<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 0in .0001pt .5in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 1;"> </span>As such, the industry is now complying with the provisions of the Water Act, 1974 and the Air Act, 1981, decisions of personal hearing dated 18.11.2021 and code of practice prescribed for such type of units vide Board’s notification dated 26.04.1999.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;"><span style="mso-spacerun: yes;"> </span><span style="mso-tab-count: 1;"> </span></span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span>Keeping in view of the above, it is recommended that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo4;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Varied ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 may be granted to the industry upto 30.09.2027 for <span style="mso-bidi-font-weight: bold;">Curve Stone, Bridge, Paver & Tiles @ 5000 no./day, premix @ 90 TPH and RMC @ 60 m<sup>3</sup>/h</span> with suitable conditions. </span></p> |
