It is submitted that the industry were granted consents to operate under the Water Act, 1974 and Air Act, 1981 vide nos. CTOW/Renewal/FZL/2017/6269222 & CTOA/Renewal/FZL/2017/6269079 dated 18/10/2017, expired on 30/06/2021 for manufacturing of Refined Lubricant oil @ 3.5 KL/day and Light Diesel oil @ 1.5 Kl/day by using waste/used oil @ 5 KLD, subject to certain conditions mentioned therein, in the name of M/s Gursewak Oil Industry, D-5P, Industrial Focal Point, Abohar, District Fazilka.                        Thereafter, the industry has applied for renewal of consents to operate under the Water Act, 1974 & Air Act, 1981 on 04.01.2022 / 05.01.2022, however, the same were returned by the Board due to incomplete applications.                        Thereafter, the industry has again applied for renewal of consents to operate under the Water Act, 1974 and the Air Act, 1981 on 21.09.2022/ 27.09.2022. The applications of the industry have been perused and it was observed as under:- 1.    The industry has changed its name from M/s Gursewak Oil Industry to M/s Gursewak Oil Industries and has changed its proprietorship firm to partnership firm with 3 partners induced through partnership deed on 01.04.2021. The industry was required to apply for varied consents to operate and not renewal of consents as clearly pointed out in the earlier returned applications. 2.    The industry was granted consents to operate for 3 nos. burners / kettles where dehydration/distillation takes place without any APCD / dust extraction system and only common stack of adequate height. However, the industry has made no provision for control of fugitive emissions to be generated during opening/closing/cleaning of these burners/kettles, especially keeping in view that some persons died inside the industry during the cleaning of these tanks on 26.09.2019. 3.    As per the SOPs framed by CPCB for utilization of used / waste oil, such types of industries are required to install firefighting system especially in the used oil handling area, used oil and its recycled product shall be handled in compatible containers with an unbroken screw top lid etc. and other points. However, the industry has not submitted compliance / SOPs. 4.    The industry has not submitted compliance of the conditions of the earlier granted consents to operate obtained by it. 5.    The industry has procured hazardous waste i.e. used / waste oil even after expiry of consents to operate for more than one year and has disposed off its hazardous waste generated on 17.09.2022, even after the expiry of its hazardous waste authorization.                          As the industry is not complying with provisions of the Water Act, 1974 & the Air Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, it was decided that the applications for consents to operate under the Water Act, 1974 & Air Act, 1981 may be returned to the industry due to above said reasons and SCNs under the Water Act, 1974, Air Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 along with an opportunity of P.H. at ZO level may be issued to the industry.                        In compliance, this office has returned the CTOs applications of the industry on 13.10.2022. Further, SCN under the provisions of the Water Act, 1974, Air Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 has been issued vide letter no. 4981 dated 18.10.2022 with an opportunity of personal hearing at ZO level on 04.11.2022.                        <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">During hearing, the partners of the industry stated as under:- 1.    The industry has applied for varied consents to operate under the Water Act, 1974 & Air Act, 1981. 2.    The industry has now installed wet scrubber as APCD for control of fugitive emissions generated from the burners / kettles. 3.    The industry has complied with the SOPs framed by CPCB for utilization of used / waste oil and has installed fire extinguishers in the oil handling area etc. 4.    The partners of the industry assured that they will not procure any hazardous waste for its utilization till it obtains registration-cum-passbook and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 as well as valid consents to operate under the Water Act, 1974 & Air Act, 1981.   <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">                        After hearing the partners of the industry as well as officer of the Board, it has been decided that:- 1.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Regional Office shall immediately visit the industry to verify the submissions / compliance(s) made by the industry and thereafter send report/recommendations regarding disposal of consent applications submitted by the industry within one week. 2.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 as well as registration-cum-passbook within one week. 3.    It was made clear to the industry that in case of non-compliance of decision of hearing within stipulated period, further action as deemed fit shall be taken against the industry.                        Also, proceedings of the hearing dated 04.11.2022 were conveyed to the industry vide Zonal Office letter no. 5398 dated 14.11.2022.                          Now the industry has applied in the name of M/s Gursewak Oil Industry, D-5P, Industrial Focal Point, Abohar, District Fazilka for obtaining varied consents to operate under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Refined Lubricant oil @ 3.5 KL/day and Light Diesel oil @ 1.5 Kl/day by using waste/used oil @ 5 KLD on 03.11.2022. The detail of case is as under:- ·         The industry has submitted partnership deed executed on dated 01.04.2021 between Sh. Gursewak Singh S/o Sh. Sher Singh, R/o Hanuman Road, Abohar, Sh. Gurpreet Singh S/o Sh. Shamsher Singh, R/o Abohar, Sh. Rajinder Kumar S/o Sh. Vijay Kumar, R/o Abohar and Sh. Lalit Mohan Bansal S/o Sh. Ashok Kumar, R/o Abohar have decided to carrying on the business under the name & style of M/s Gursewak Oil Industries, D-5, Focal Point, Abohar, District Fazilka. ·         The industry has submitted copy of passbook under rule 6 of the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 issued to the industry by the Board vide registration no. Reg/PPCB/2017-22/F-125 dated 15/09/2017, expired on 14/09/2022 for procurement & recycling of used oil @ 1,500 KL/Annum with certain condition mentioned therein. The industry has also applied for authorization under HWM Rules, 2016, which is under process. ·         The industry has submitted CA certificate showing the gross fixed as on 31.03.2022 is Rs. 83.15 Lakhs. Accordingly, the industry has deposited consent fee, which is adequate upto 30/06/2029 under the both Acts.                    To verify the facts, the industry was visited by undersigned on 09.11.2022 it was observed as under:- 1.     The industry was not in operation during visit. 2.     The industry has installed 03 no. burners and water scrubber has been installed as APCD with it and stack of 15 mtr height above roof level to disperse the emission into atmosphere has been provided. 3.     The industry has provided Oil and Grease tank as ETP for the treatment of trade effluent and provision has been provided to re-circulate the same in the cooling tower. 4.     The industry has provided separate hazardous waste storage room for storage of hazardous waste. The industry has provided danger sign on the front wall of the Hazardous Waste storage room. The industry has lifted spent clay @ 3825 kg and oily sludge @ 15300 kg to M/s Bharat Oil Company, Ghaziabad. 5.     The industry has provided fire extinguisher in the industrial premises for fighting arrangements. 6.     The industry has not been covered under PLI and requested for 15 days to submit the compliance.                      From above, it is clear that the industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981.                      Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may please be granted to the industry for a period upto 30.06.2027 with suitable conditions as per the policy of the Board and special condition that the industry will submit cover under Public Liability Insurance, within 15 days.
