CTOW/Renewal/SAS/2019/9601929 dated 12.08.2019 which was valid upto 11.08.2020 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2019/9601054 dated 12.08.2019 which was valid upto 11.08.2020 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The industry applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was processed through OCMMS.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The industry was given personal hearing before the Chief Environmental Engineer (P) of the Board on 15.12.2020, wherein it was decided as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall ensure compliance of the provisions of Water Act, 1974; Air Act, 1981; Hazardous & Others Wastes (Management & Transboundary Movement) Rules, 2016 and Pollution Control Laws.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall submit the bank guarantee amounting to Rs. 1.0 lac as assurance to comply with the provisions of the various Pollution Control Laws, within 7 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry shall not procure and use spent solvent as raw material it obtains consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and authorization under the HoWM Rules, 2016 of Board as well as registration / pass book as required under the provisions of HoWM Rules, 2016.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is allowed to manufacturing thinner @ 8.33 MTD only at this stage and shall not manufacturing API / Intermediate and any other products mentioned in the application form and shall not carry out recovery of spent solvent, without the prior consent to operate of the Board under the provisions of Water Act, 1974 and Air Act, 1981.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">Meanwhile, the industry shall ensure to comply with the SOPs / guidelines framed by the CPCB for the recovery of spent solvent. Further action, to allow the recovery of solvents shall be taken after the verification of compliances by the Board.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">Environmental Engineer, Regional Office, SAS Nagar shall visit the industry to verify the contentions of the industry made during the hearing and submit his detailed report / recommendations, within 15 days to decide the consent / authorization applications, accordingly.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/13642337 dated 24.03.2021 which was valid upto 22.03.2022 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/13643105 dated 07.03.2021 which was valid upto 06.03.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">It is pertinent to mention here that Hon’ble National Green Tribunal, New Delhi has passed combined orders dated 25.02.2021 in the matters of OA no. 33/2013 (THC) titled as Karnail Singh & Ors. V/s CPCB & Ors., OA no. 30/2013 (THC) titled as Jai Singh & Ors. V/s Union of India & Ors., OA no. 101/2020 titled as Suhail Dhurani V/s State of Punjab and OA no. 164/2020 Satinder Mohan Singh Grover & Ors. V/s Central Pollution Control Board & Ors. The above applications disposed off by the Hon’ble National Green Tribunal, New Delhi. The operative part of the orders of the Hon’ble National Green Tribunal is as under:</span></p>
<p class="Default" style="margin-left: 47pt; text-align: justify;"> </p>
<p class="Default" style="text-align: justify; text-justify: inter-ideograph; margin: 0in .5in .0001pt 27.0pt;"><strong><em><span style="font-size: 11pt; color: windowtext;">“17. In view of the exhaustive report furnished by the Committee which is also available on the website of this Tribunal so as to be accessed by the concerned parties, as per procedure being followed by the Tribunal, what is required is further action by the concerned authorities as well as the industrial units for compliance of the norms in the light of observations and recommendations. Such action is particularly required for calculating CEPI (even if it is not in the list of „critically‟ or „severely‟ polluted category), compiling information about the number of industries in different categories and whether ground water extraction is permissible, water quality monitoring stations, status of execution of action plan for air quality management, action plan for restoration of environmental quality management and its monitoring mechanism at District level. It needs to be verified whether MSIHC Rules, 1989 are being followed by the industries handling hazardous chemicals in respect of onsite and offsite emergency plans and conducting mock drills. This is necessary to prevent industrial accidents resulting in deaths and injuries and damage to the environment, the Tribunal has come across recently several such accidents2. Menace of rice husk use and ash management also needs to be controlled.</span></em></strong></p>
<p class="Default" style="text-align: justify; text-justify: inter-ideograph; line-height: 115%; margin: 0in .5in .0001pt 27.0pt;"><strong><em><span style="font-size: 11pt; line-height: 16.8667px; color: windowtext;"> </span></em></strong></p>
<p class="Default" style="text-align: justify; text-justify: inter-ideograph; margin: 0in .5in .0001pt 27.0pt;"><strong><em><span style="font-size: 11pt; color: windowtext;">18. Accordingly, the State authorities and the industrial units in question may take further remedial action expeditiously. The State PCB may ensure compliance in exercise of its statutory powers, including those under the Water (Prevention and Control of Pollution) Act, 1974, the Air Prevention and Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 to ensure compliance by the concerned industries in a time bound manner, including preventing pollution, assessment and recovery of compensation for the past violations and restoration of water, air and soil quality, following due process. Restoration plan be got prepared by the joint Committee of CPCB and State PCB, in consultation with such other individuals/organizations as may be necessary, and timely execution of the action plan may also be overseen. The Committee may specify the authorities responsible for execution, including the role to be played by the industrial units. The restoration plan must provide for treatment of waste water in areas where water quality has deteriorated, particularly the locations identified by the Committee. The action plan may further include, apart from measures already mentioned, restoration of the soil quality where the soil quality has deteriorated and on the same pattern, restoration of drains adversely affected by discharge of pollutants including hazardous waste. The State PCBs may also to act on the recommendation for rice husk management and VOCs. The action plan may be prepared within three months, stipulating its execution within six months thereafter. Status of compliance as on 31.12.2021 may be compiled by the joint Committee of CPCB and State PCB and report furnished to the Chairman, CPCB for such further remedial action as may be found necessary.</span></em></strong></p>
<p class="Default" style="text-align: justify; text-justify: inter-ideograph; line-height: 115%; margin: 0in .5in .0001pt 27.0pt;"><strong><em><span style="font-size: 11pt; line-height: 16.8667px; color: windowtext;">The applications are disposed of.</span></em></strong></p>
<p class="Default" style="text-align: justify; text-justify: inter-ideograph; margin: 0in .5in 12.0pt 27.0pt;"><strong><em><span style="font-size: 11pt; color: windowtext;">In view of above order, all pending IAs will stand disposed of as the matter will henceforth be dealt with by the joint Committee of CPCB and State PCB in accordance with the statutory provisions of the Water Act, Air Act and EP Act or any other relevant law. “</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/18335123 dated 06.05.2022 which was valid upto 05.11.2022 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/18335101 dated 06.05.2022 which was valid upto 05.11.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">Now, the industry has applied for renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents which may kindly be perused.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The industry had deposited Rs. 24260/- vide R. No. 953069449 dated 31.03.2022 under Air (Prevention & Control of Pollution) Act, 1981 including Rs. 2160/- as late fee / penalty and Rs. 500 as facilitation fee. The industry has submitted that they have deposited Rs. 24260/- dated 31.03.2022 under Water (Prevention & Control of Pollution) Act, 1974. Now, the industry has submitted Rs. 22100/- vide R. No. 621655093 dated 04.11.2022 under Water (Prevention & Control of Pollution) Act, 1974 including Rs. 500/- as FDF and Rs. 21600/- vide R. No. 573978522 dated 04.11.2022 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 is adequate upto 04.03.2024 against the fixed assets of the industry Rs. 862.39 lacs.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The industry has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as SOP compliance.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry was visited by AEE of this office on 10.11.2022. During the visit, it was observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry was in operation. During the visit, only manufacturing of thinner by recovery of spent solvents was being carried out. The representative of the industry, informed that the APIs have not been manufactured since March, 2018.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The source of water supply in the industry is tubewell as well as PSIEC supply. The industry has installed separate flow meters with this tubewell and with the PSIEC Supply.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed a multi effect evaporator for treatment of wastewater. During visit, the MEE was in operation.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The representative of the industry claimed that no effluent is generated while manufacturing of thinner in the reactors and during recovery of spent solvents by distillation.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The domestic effluent generated by the industry is being discharged into the PSIEC sewer.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed an alkali scrubber to control the process emissions, but the same was not in operation during the visit. Representative of the industry informed that the process for which it has been installed, is not being carried out.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed DG set of capacity 320 KVA, which is equipped with canopy and stack of adequate height.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">It is worth to mention here that the Central Pollution Control Board has issued Standard Operating Procedure (SOP) for the units engaged in recovery of spent solvents vide notification in March, 2018 and amended notification in August, 2019. As such, the industry is now engaged in recovery of spent solvents procured from other firms/ agencies/ industries, and it is required to comply with the guidelines mentioned in the SOP for utilization of the spent solvents and install minimum request facility as delineated in the Standard Operating Procedure issued by the CPCB for recovery of spent solvents. In this regard, it was observed during visit that the industry has complied with the guidelines mentioned in the SOP for recovery of spent solvent like the industry has installed VOC absorption media connected to the vent of condenser, secondary condenser with chilled water/brine, online analyzer for TOC at the vent outlet and had made connection of vent of all the storage tanks with the condenser unit etc.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; line-height: 150%; mso-list: l1 level1 lfo1; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The industry is complying with the various terms and conditions of the earlier granted consents.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif';"> </span><span style="font-family: Tahoma, 'sans-serif';">In view of above, it is recommended that the renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be further extended for one year i.e. 31.12.2023 subject to suitable conditions as per earlier consents granted by the Board.</span></p>
