Sunderlal, CEO                                 The officers of the Board brought out that the industry did not comply with the provisions of the Water Act, 1974 as well as decisions of the hearing dated 8.6.2021 and 28.3.2022 and Hon'ble NGT order dated 25.2.2021 passed in OA No.33 of 2013, OA No.30 of 2013, OA No.,10 of 2022.                                 Therefore, the industry was earlier issued notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 3610-11 dated 23/6/2022 alongwith an opportunity of the personal hearing before the Chairman of the Board on 8/7/2022, with the following proposed directions: i)            The industry shall take all necessary steps to close down its operations and stop forthwith discharging any effluents/ wastewater into sewer/ into storm water drain/ inland surface water/ onto land for stagnation/ irrigation or through any mode. ii)           The industry shall stop forthwith discharging any effluent/ emissions from its industrial premises or through any mode. iii)          The industry will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken and it obtains valid consents to operate of the Board under the provisions of the Water (Prevention & Control of Pollution) Act 1974. iv)          The Punjab State Power Corporation Ltd. authorities shall be directed to disconnect the supply of electricity available to the industry. v)           To seal DG set installed by the industry. vi)          Environmental compensation shall be imposed for damage to the environment by the industry.                                 The said hearing was postponed to 19/7/2022 and the same was further postponed to 27/7/2022 and 1/8/2022 respectively, due to administrative reasons. The representative of the company submitted during the hearing as under: (i)           They have commissioned both the RO plants to achieve the ZLD System. The system gets Zero Liquid Discharge means solids goes outside and liquid is used. They also submitted a water balance statement of both the units. (See Annexure) (ii)          They have put up layer of earth over the ash and over this earth green grass and plantation have been carried out and for the rest of ash, they have provided Green Net over the fly ash to take control over the fly ash each laying work will be continued. (iii)         They are not discharging any effluent during the odd hours and at the end of wall, inside the area, they have carried out bunding with sand bags. These sand bags have further been strengthened topography of the area developed and grass and plantation have been maintained in such a way that even during the train, water does not seep through. (iv)         They have laid a hume pipe for carrying out storm water through ash filled area and with this totally enclosed system will ensure no ash spillage to nallah. (v)          The process of de-watering with sludge de-watering machine have been made electrical as well as mechanical interlocking system. In the electrical system, push button wit alpha-numeric interlocking has been provided where key with A alpoha numeric will fit A alpha numeric and Key with B alpha numeric will got to B alpha numeric. Similarly, two locks with one key system have been provided. Two locks on the same lines where lock in Unit-1 on HTDS same lock on valve in Unit-II and key is common hence say HTDS stream will to got the HTDS Tank and LTDS stream will got the LTDS tank which are openable with one key only. This will avoid criss-cross of the HTDS/LTDS effluent transferring from Unit-I to Unit-II which means HTDS effluent will got the HTDS tank only and LTDS effluent will got the LTDS tank only. Hence, there is no contamination. (vi)         They provided colour coding on all pipelines. (vii)        They are complying with the decisions of the hearing dated 8/6/2021 & 28/3/2022, and the Hon'ble NGT order dated 25/2/2021 passed in OA no. 33 of 2013, OA no. 30 of 2013, OA no. 101 of 2020 and also comply with the SOP framed by CPCB for such type of industries. (viii)       The consent to operate under the Air Act, 1981 earlier applied by them may kindly be returned as there is some mismatch in the quantities mentioned in the EC and NOC. After hearing, the Chairman of the Board decided as under: 1.            The industry shall operate its ZLD system and pollution control devices installed by it, regularly and efficiently. 2.            The industry shall not discharge any treated/untreated effluent outside its premises at any time. 3.            The industry shall not use/ discharge its treated/untreated effluent in rice husk dumping yard for quenching purposes. 4.            The Environmental Engineer, RO, SAS Nagar shall return the consent application of the industry applied under the Air Act, 1981 and guide it to reapply the application properly. 5.            The industry shall reapply the consent to operate under the Water Act, 1974 and Air Act, 1981 for existing process/quantities. 6.            Environmental Engineer, RO, SAS Nagar shall visit the industry to verify the statements made by the industry during the hearing and shall submit his report/recommendations in the matter and also process the consent applications on merits to be applied by the industry. 7.            In case of failure of compliance by the industry, strict action as per law including imposition of environmental compensation shall be initiated.                                 The proceedings of the hearing were conveyed to the industry vide Board's letter no. 5277-78 dated 1/9/2022 for compliance.                                 The industry has now applied varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.                                 To verify the compliance of the hearing decisions as well as facts mentioned in the application, the industry was visited by officers of the Board on 30/8/2022 and it was observed as under: 1.            The industry was in operation during the visit. 2.            The industry has installed incinerator (4.2 MTD), but during the visit the same was not in operation as per requirement of industry 3.            Newly installed ETP as well as MEE was in operation. However, it is appropriate to mention here that the industry has upgraded its ETP to the total capacity of 1500 KLD against proposed 1800 KLD and has installed MEEs of capacity 90 KLD & 350 KLD (total 450 KLD) against proposed 500 KLD. The boiler of capacity 25 TPH alongwith its APCD is under installation. 4.            RO permeate is being partially used for cooling tower & partially in process & partially onto land for plantation. The industry is not achieving ZLD as on date 5.            The industry has not maintained its plantation area as per Karnal Technology. 6.            The industry has not removed flexible pipes & motor provided in the plantation area. 7.            The industry is in the process of cleaning of tank used for storage of Low TDS effluent of its sister concern unit M/s Nectar Lifesciences Unit-I & at present effluent of Nectar Unit-I is directly feed into treatment plant through common pipe. The industry is dumping fuel ash in the premises after mixing with effluent sludge originated from the tank under cleaning. The industry guided to immediately stop the activity and further guided to dispose off the sludge through TSDF. 8.            The industry is dump the fresh ash within its premises. The industry carryout fuel ash quenching which is at present being carried out by the industry. 9.            It was noted that the industry has provided a make shift arrangement for the disposal of excess vapour and waste steam after the ATFD of MEE plant. The industry was not provide a activated carbon column with adequate went height for the same after its condensate. 10.          The industry has laid the dedicated pipeline leading to the drain passing through the ash yard area for channelization of storm water. 11.          The industry was not provided colour coding on all pipelines and dismantle the discarded pipelines leading to dedicated storage tanks constructed for storage of HTDS and LTDS effluent of Unit-1. 12.          The flow meter installed at the High COD effluent pump / MEE feed is not working/ operational.                                 The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as not complying with the decisions of the hearing held before the Chairman of the Board on 28/3/2022 and 1/8/2022 as well as Environment Clearance granted by the Competent Authority, willfully causing water and air pollution in the vicinity, thus, violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately.  It was proposed to initiate action against the industry under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and also proposed to refuse varied consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause/ personal hearing.                                 Therefore, the industry was served show cause notice for refusal of varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 6430 dated 19.10.2022 alongwith an opportunity to persona hearing before the Chairman of the Board on 11/11/2022.                                 The representatives of the industry who attended the hearing submitted as under: (i)                  They have commissioned ZLD System and mainlined all pollution control devices efficiently. (ii)                The industry is not discharging any treated/ untreated effluent outside its premises at any time. (iii)               The industry is not using/ discharging its treated/ untreated effluent in rice husk dumping yard for quenching purposes. They are having R.O reject from their power plant. R.O permeate having TDS not more than 1000 ppm with all other parameters equivalent to fresh water use to allow this for ash quenching and keeping control to avoid fly. (iv)               The consent application has been corrected already and submitted to PPCB on 24.8.2022. (v)                They have replied to the consent to operate under the Water Act, 1974 and the Air Act, 1981 for existing process/ quantities. (vi)               They have installed the incinerator. But the incinerator was not in operation during the visit of Board officers because based upon load/ requirement they operate the system. (vii)             They have upgraded the ETP to the total capacity of 1500 KLD against proposed 1800 KLD and have installed MEEs of capacity 90 KLD and 350 KLD (total 450 KLD) against proposed 500 KLD. They boiler of capacity 25 TPH alongwith its APCD is under installation. (viii)           They are maintaining the plantation area as per Karnal Technology. (ix)               They have removed flexible pipes and motor in plantation area. (x)                They are cleaning low TDS effluent tank periodically during this process generation of sludge treated through sludge dewatering machine. This comes out of this dried in their sludge drying bed. They also informed that they have stopped the practice of dumping the fuel ash in the premises after mixing with effluent originated from the collection tank. Now, they started to dispose off above said sludge to TSDF, Nimbua. (xi)               They have sent 26.87 MT of ETP sludge to TSDF, Nimbua. (xii)             They have put up layer of earth over the ash and over this earth green grass and plantation has been carried out and for the rest of ash, they have provided Green Net over they fly ash to take control over the fly ash each laying work will be continued. (xiii)            They have shifted blower near condenser and provided adequate vent height. (xiv)            They have laid down hume pipe for carrying out storm water through ash filled area and with this totally enclosed system will ensure no ash spillage to Nallah. (xv)             They are complying with decisions of the hearing dated 8/6/2021 & 28/3/2022, and the Hon'ble NGT order dated 25/2/2021 passed in OA no. 33 of 2013, OA no. 30 of 2013, OA no. 101 of 2020 and also comply with the SOP framed by CPCB for such type of industries. (xvi)            They have provided colour coding and this is being continuous job and they will maintain it. (xvii)          They have installed and maintained of HCOD effluent flow meter with transfer pump facility. MEE feed flow meter with pump facility is available and working in operational.                                   After hearing the officers of the Board and the representatives of the industry, the Chairman of the Board decided as under: (A)  i)     On the basis of best assessment and judgement, an environmental compensation of Rs. 5.0 Lakhs is imposed to the industry. The industry shall deposit Rs. 5.0 Lakhs as environmental compensation within one week in the O/o Environmental Engineer, Regional Office, SAS Nagar. <p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">ii)       The industry shall provide garland drain at a plinth level of retaining wall alongwith collection tank to be collected the seepage water received from ash quenching so as to stop the discharge into drain through weep whole.   <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">iii)     The industry shall not dump the fresh ash within its premises. Fly ash generated from the industry in future shall be transported and dumped in an environmentally/ scientific sound manner onto own land of measuring 100 acres at Village Nimbua.   <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">iv)     The industry shall provide water meter on its difference streams so as to check the water balance of the both units. <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">v)       The industry shall make the adequate arrangement to hold all wastewater from a process atleast for 4-days in case of no demand period.  <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">vi)     The entire sludge generated from the process of the industry shall be disposed off to TSDF, Nimbua and no sludge disposed off outside the premises under any circumstances.  <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">vii)   The industry shall comply with decisions of the hearing dated 8/6/2021 & 28/3/2022, and the Hon'ble NGT order dated 25/2/2021 passed in OA no. 33 of 2013, OA no. 30 of 2013, OA no. 101 of 2020 and also comply with the SOP framed by CPCB for such type of industries. <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">viii)  The Environmental Engineer, Regional Office , SAS Nagar shall personally visit the industry to mark the plantation area developed as per Karnal Technology within industrial premises to be used for mode of disposal for R.O permeate in future. <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">ix)     In case of failure of compliance by the industry, strict action as per law including imposition of environmental compensation shall be initiated. <p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l3 level1 lfo2; mso-layout-grid-align: none; text-autospace: none;">x)       The Environmental Engineer, RO, SAS Nagar shall return the consent application of the industry applied under the Water Act, 1974 and the Air Act, 1981 and guide it to reapply the application as discussed during the hearing. (B)          Directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 be issued to the industry that: <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt 1.0in;">i)                    The industry shall achieve ZLD by operating ZLD system and pollution control devices installed by it, regularly and efficiently. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt 1.0in;">ii)                   The industry shall not discharge any treated/ untreated effluent outside its premises at any time. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt 1.0in;">iii)                 The industry shall reuse RO permeate for domestic purposes and for onto land for irrigation/ plantation within its industrial premises.  <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt 1.0in;">iv)                 The industry shall not discharge any treated effluent/ R.O permeate onto land for plantation which has already been developed outside the premises by the industry. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo3; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt 1.0in;">v)                   The industry shall remove the flexible pipes/ motors provided in the plantation area.                                   If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
