Earlier the hot mix plant was granted 'Consent to Operate' under Water Act, 1974 & under Air Act, 1981 which were valid upto 20-07-2021 for electric connection of the industry was restored temporarily upto this period with special conditions that:-</span></p>

The plant was visited by officer of the Board on 27-6-2022 & following observations were made;-</span></p>

However, the industry was made operational to carry out stack emission sampling. The rep. of industry started the DG set (without canopy) to start the hot mix plant. From the condition of DG set it appears that the industry is continuously operating this DG set.</span></p>

Accordingly, stack emissions sample was collected and analyzed by the Board’ Lab and as per the analysis report results are beyond prescribed standards.</span></p>

The rep. of industry informed that they are getting the tank cleaned from tanker service.</span></p>

<p class="MsoNormal" style="margin-right: 4.5pt; text-align: justify; text-indent: 71.15pt; line-height: 150%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;"> Thereafter the show cause notice was issued to the industry along with opportunity of personal hearing before Senior Environmental Engineer, Ludhiana, wherein it was decided that: -</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo4; text-autospace: ideograph-numeric ideograph-other; margin: 0cm 4.5pt .0001pt 28.6pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;">Consent to operate under Air Act, 1981 may be granted to the industry for period of six months with suitable conditions and additional conditions that:-</span></p>

<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -21.3pt; line-height: 150%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo4; text-autospace: ideograph-numeric ideograph-other; margin: 0cm 4.5pt .0001pt 28.6pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;">Environmental Engineer, Regional Office-1, Ludhiana shall visit the industry again after one month to collect fresh stack emission samples, seal the D.G set installed without canopy and submit the report alongwith recommendations in the matter.</span></p>
<p class="MsoNormal" style="margin-right: 4.5pt; text-align: justify; text-indent: 71.15pt; line-height: 150%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;"> Thereafter, the industry was visited by Officer of the Board on 9.8.2022 to check compliance of hearing decisions. During visit, it was observed that the Hot mix plant was not in operation. The industry has not removed the violations as observed during last visit on 27/06/2022 and the condition was same as earlier. The industry is not complying with SOPs framed by the Board for such type of industries. The Plantation along the periphery of the plant was not adequate. Stack height of bitumen storage/heating tanks was inadequate and movement area was not stabilized. During visit, the DG set of the industry could not be sealed, as there was no responsible person on behalf of the industry present at site.</span></p>
<p class="MsoNormal" style="margin-right: 4.5pt; text-align: justify; text-indent: 71.15pt; line-height: 150%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;"> Due to above violations, application of the industry applied for obtaining consent to operate under the Air Act, 1981 was refused and the directions u/s 31-A of the Air Act, 1981 for suspension of work allotted to the industry was issued to respected departments.</span></p>
<p class="MsoNormal" style="margin-right: 4.5pt; text-align: justify; text-indent: 71.15pt; line-height: 150%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;"> Now the industry has applied for renewal ‘Consent to Operate’ under the Air Act, 1981 along with requisite documents and fees. The industry has submitted CA Certificate regarding value of Fixed Assets as on 30-04-2022, Compliance report of previous Conditions. The documents submitted by the industry may kindly be perused.</span></p>
<p class="MsoNormal" style="margin-right: 4.5pt; text-align: justify; text-indent: 71.15pt; line-height: 150%; mso-pagination: widow-orphan; text-autospace: ideograph-numeric ideograph-other;"><span lang="EN-US" style="font-size: 12.5pt; line-height: 150%; mso-font-width: 95%;"> The industry was visited by the undersigned on 16.11.2022 and observed as under:</span></p>

The older DG Set which was without canopy was lifted from the premises of the industry.</span></p>
