CTOW/Varied/SAS/2021/17311982 dated 24/12/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/SAS/2021/17311543 dated 24/12/2021, having validity upto 23/12/2022 for manufacturing of Liquid Bromine @ 1800 Kgs/day HBr (48%) @ 2000 Kgs/day subject to suitable conditions mentioned therein.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry was lastly given an opportunity of personal hearing under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide its letter no. 5888-89 dated 27.09.2022 before the Senior Environmental Engineer of the Board on 18.10.2022, wherein, it was decided as under:</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall assure that the entire chemical reaction process will be carried out in airtight vessels/systems so as to ensure that the nature of the chemical reactions is not charged to ensure that no organic compound is formed.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the Environment Laws.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry 10 days to verify the statement given by the industry during hearing and to send comments/recommendations thereafter.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> Now, the industry has applied for renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents and consent fee.</span></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">As per the record file, earlier, the industry had deposited Rs. 28800/- vide online UTR no. SAA282652288 dated 28/08/2021 under the Water (Prevention & Control of Pollution) Act, 1974 (linked with App. ID. 16308839) and Rs. Rs. 28800/- vide online UTR no. SAA282652306 dated 28/08/2021 under the Air (Prevention & Control of Pollution) Act, 1981 (linked with App. ID. 16308698). The industry has also deposited additional consent fees of Rs 86400/- vide R no. 89542 dated 22.11.2021 (Rs 43200/- each in account of under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under both the Acts against the fixed assets of Rs. 250.7 lacs on 31.03.2022. as such, the fee already deposited by the industry is adequate upto 30.09.2026.</span></p>
<p class="MsoBodyText" style="margin: 0cm 5.8pt 6pt 0cm; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;"> </span></p>
<p class="MsoBodyText" style="margin: 0cm 5.8pt 6pt 0cm; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">It is worth to mention here that in the previous ‘consent to operate’ granted to the industry by Board, following special conditions were imposed that:</span></p>
<p class="MsoBodyText" style="margin: 0cm 5.8pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">The industry shall clarification regarding applicability of EIA notification for the production of broming & Hbr or not from MoEF&CC within the stipulated time period.</span></p>
<p class="MsoBodyText" style="margin: 0cm 5.8pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">The industry shall follow the MoEF&CC for necessary clarification as sought by it vide its letter dated 12.08.2021. If the MoEF&CC does not exempt the industry from environmental clearance, at this stage, the industry shall obtain the environmental clearance immediately and shall also stop the HBr production and any such other activities carried out in industrial unit.</span></p>
<p class="MsoBodyText" style="margin-right: 5.8pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px;">In this regard, the industry has submitted its reply, mentioning that they have already requested MoEF&CC to clarify regarding applicability of EIA notification dated 14.09.2006 and reply of MoEF&CC is still awaited. The industry has uploaded the relevant document vide online reply dated 04.11.2022, which may kindly be perused. Further, the relevant part are attached in agenda note.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 36pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">In this regard, it is submitted that manufacturing of liquid bromine and HBr does not involve any organic reaction, as bromine does not contain any carbon atom and is inorganic nature. Thus, the undersigned is also of the view that the unit is not covered under category 5(F), i.e. “Synthetic Organic Chemicals” of EIA notification dated 14.09.2006. Therefore, the undersigned is of the opinion that condition no. 01 and 05 in the previous ‘consent to operate’ granted to the industry can be removed.</span></p>
<p> </p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif'; color: red;"> </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Accordingly, the industry was visited by AEE of this office on 15.11.2022</span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">, during visit, it was observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The unit is in operation & is in engaged in the business of manufacturing of Liquid Bromine & HBR.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry uses sodium bromide, potassium bromide and ammonium bromide as raw material and has installed 05 no. of storage tank for storage of raw materials in its premises.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Firstly, raw material is sent to GCR 102 reaction tank in which some impurities are removed. Then, the raw material is fed to the distillation columns, from where liquid bromine (product) is obtained and is filled in bottles.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed 01 tubewell in its premises and the same provided with flow meter.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Wastewater being generated from the process is collected in a collection tank, from where; it is transferred to pH neutralization tank, in which caustic is used. Thereafter, wastewater is fed to evaporators (04 nos.).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">During visit, it was observed that the industry has now provided glass columns on 03 number evaporators for collecting the vapors being generated from these evaporators. Further, the industry is in the process of installation of glass columns on remaining 01 evaporator also and the representative of the industry informed that the same shall be completed within 07 days. Further, during visit, no significant vapors and odour was observed from the unit, which shows, the industry has now made compliance to the previous observations.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">During visit, significant improvement was also noticed in housing keeping of the unit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has installed wood fired a boiler of capacity of @ 2.0 TPH, which has been installed with Cyclone as APCD. The stack emission sampling could not be carried out due to non-availability of air lab staff. However, the stack emission sampling of unit was carried out on 30.03.2022 and the results are as under:</span></p>
