Ltd., Village Agampur, Tehsil Sri Anandpur Sahib, District Rupnagar. </u></em></span></strong></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">It is submitted that the industry was earlier granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2021/14656998 dated 08/01/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2021/14656971 dated 08/01/2021, both were valid upto 30/09/2024<span style="color: black; mso-themecolor: text1;"> </span>for operation of stone crusher and screening cum washing plant 7000 CFT/Day subject to the suitable conditions mentioned therein.</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: 67.5pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0in 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 903 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 0in 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the unit has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry has submitted the compliance report of previous consent granted to the unit, undertaking regarding code of practice & regarding legal mining and CA certificate dated 04.06.2022, wherein, the value of fixed assets of the industry as on 04.06.2022 is of Rs. 107.66 Lakhs with the value of plant and machinery of Rs. 65.46 lakhs. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">As per record file, the fee deposited by the unit was adequate upto 31.03.2025 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Now, the unit has deposited Rs. 25,200/- vide UTR No. N158221260435492 dated 07.06.2022 under the Water Act, 1974 and Rs. 25,200/- vide UTR No. N158221260433898 dated 07.06.2022 under the Air Act, 1981. As such, after deducting 50% penalty as late application fee, the fee is now adequate upto 30.09.2027 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="Default" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; color: windowtext; mso-font-width: 110%; mso-bidi-language: AR-SA;">It is added here the unit has also submitted Rs. 7316/- vide DD. No. 005042 dated 14.11.2022, as advance fee w.r.t the stack emission samples and has requested to conduct the sampling through the Board, which shall be conducted shortly.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Georgia; mso-bidi-font-family: Georgia; mso-font-width: 110%; mso-bidi-language: AR-SA;">Further, it is pertinent to mention here that the Executive Engineer, Deptt. of Irrigation-Cum-Mining, Rupnagar through e-mail dated 20.10.2022 and the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib vide no. 1005/Crusher dated 18.10.2022 has informed that there are 04 no. gravel mining sites operational in District Rupnagar i.e. Bhallan, Kotbala & Aaspur, Bari Haveli and Rasidpur Jindapur for obtaining raw material. The unit has submitted the slips of obtaining raw material from the approved mining site of District Rupnagar i.e. Bhallan de-silting site.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, as per circular no. 443 dated 09.08.2021, the case for renewal of NOC/Consent to operate for Red, Orange and Green category of small scale industries/projects, without inspection/physical verification of the environmental parameters at the time of submission of such applications is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. As such, the stone crushing unit covers under orange category and was not visited to verify the compliance before processing the current application.</span></p>
<p class="MsoBodyText" style="text-indent: 67.0pt; line-height: 150%; margin: 5.95pt 5.7pt 6.0pt 5.0pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma;">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2023, subject to the suitable conditions as mentioned in the previous consents granted to the unit and additional conditions as under:</span></p>

If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing.</span></p>
