Subject:     Proceedings of the personal hearing given to M/s Kathpal Dairies (Unit-II), Village Kokri Phoola Singh, Tehsil & Distt. Moga before refusal of 'consents to operate' under the Water Act, 1974 and the Air Act, 1981 by the Chief Environmental Engineer (B) on 17.11.2022. The following were present: From Board's side: Er. Jaspreet Singh, Accountant It was brought out that the industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 11.11.2021, which were valid upto 30.06.2022. The industry has applied for obtaining renewal of consents to operate of the Board under the Water Act, 1974 and Air Act, 1981. The industry was visited by officer of the Board on 07.10.2022 and it was observed that the industry has not yet put its effluent treatment plant into operation i.e. it has not yet stabilized the ETP, which is based on biological treatment system.                    In view of above, the industry has been issued show cause notice before refusal of consents to operate under the provisions of Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing on 17.11.2022. During hearing, representative of the industry submitted written reply of show cause notice issued and the same has been taken on record. He stated that the industry is not in operation for the last more than one year due to some un-avoidable circumstances including financial crunch. He further stated that they have upgraded the effluent treatment plant and deposited consent fee for 2 years and requested for grant of consents. After hearing the representative of the industry and officer of the Board, it has been decided by the Chief Environmental Engineer (B) that: 1.           The industry shall put its effluent treatment plant into operation atleast two months before re-starting its plant and inform the Board, accordingly. 2.            The validity of consents be extended upto the adequacy of consent fee deposited by the industry. 3.            RO shall keep a watch over the activities of the industry and recommend action in case any violations are observed at any time. 4.      During hearing, representative of the industry was made clear that in case the industry start generating wastewater without prior stabilization of effluent treatment plant, action as deemed fit would be taken against the industry.
