CTOW/Renewal/SAS/2020/12703546 dated 27/10/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2020/12702821 dated 27/10/2020, both which had expired on 30/09/2021 for manufacturing of Bus Bodies @ 10 Numbers/day, Cargo Bodies @ 25 Number/day subject to suitable conditions mentioned therein.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the ‘consent to operate’ application for the industry under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were refused by the Board due to non-compliance of provisions of these Acts.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Accordingly, the industry was given an opportunity of personal hearing u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 before the Chairman of the Board on 01.08.2022, </span><span lang="EN-US" style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">wherein, it was decided as under</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">:</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall maintain and operate its Effluent Treatment Plant (ETP) regularly and efficiently, so as to achieve the effluent standards prescribed by the Board.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry will not discharge its untreated/treated effluent into any River/Drain/Choe etc. directly or indirectly, under any circumstances.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall maintain its plantation area regularly so that the entire treated wastewater is used uniformly in the entire area so that there shall be no stagnation of wastewater.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the provisions Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The entire plant process shall be carried out in the paint booths only.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall apply for ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 15 days.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The Environmental Engineer, Regional office, SAS Nagar shall visit the industry after 15 days to verify the compliance of environmental laws. In case, the industry is found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and environmental laws, environmental compensation shall be imposed from the date of violations earlier reported during the visit on 27.04.2022 to the date of next date of visit.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';"> Now, the industry has applied for varied of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">As per the record file, the previous fee deposited by the industry was adequate upto 29.02.2024. Now, the industry has deposited Rs. 190800/- vide R. no. 514985513 dated 01.11.2022 and the Air (Prevention & Control of Pollution) Act, 1981 Rs. 190800/- vide R. no. 601555539 dated 01.11.2022 under Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 28.02.2027 against the fixed assets of Rs. 3998.98 lakh as on 31.03.2022.</span></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The representative of the industry informed that the industry has applied for varied ‘CONSENT TO OPERATE’ as it had earlier not mentioned the details of Paint Booths installed by it in the previous application forms and the same were not reflected in their consent certificates. The industry has submitted its revised building plan got approved by Er. Sukhjinder Singh, Competent Person of Director of Factories of Punjab. The industry has submitted a copy of the classification of land use issued by the DTP, SAS Nagar vide letter no. 525 dated 25/05/2021 wherein it has been mentioned that the area under Khasra no. 16//13 in revenue estate of village Sitarpur (H.B. No. 154), Tehsil Derabassi, Distt. SAS Nagar, falls under ‘General Industry Zone’. As such, the site of the industry is suitable for carrying out expansion within its premises.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 0.0001pt -9pt; text-align: justify; text-indent: 45pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; color: red;"> </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Accordingly, the industry was visited by AEE of this office on 15.11.2022</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">.<span style="color: red;"> </span>During visit, </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">it was observed as under:</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The unit is engaged in manufacturing of bus and cargo bodies and was in operation during visit.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has installed one tubewell in its premises and flow meter has been provided with the same. As per record, around 55-60 KL of freshwater is abstracted per day.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has installed ETP for treatment of trade effluent being generated from various processors such as service station, phosphating section etc. further, the industry has also installed an STP for treatment of domestic effluent being generated from the unit. Both ETP and STP were in operation during the visit.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has provided a common flow meter on line carrying treated wastewater from both STP and ETP to plantation area. As per record maintained by the industry, around 17 KL of wastewater is being treated in ETP and STP. This does not corroborates with the consumption of fresh water as per record of tubewell, thus, the industry has been advised to check the flow meter installed with tubewell and also provide separate flow meters with treated wastewater from ETP and STP line.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Samples from outlets of ETP and STP outlet have been collected during visit and sent to HO lab for further analysis. The results of same are awaited.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The ETP and STP installed by the industry are having very old structures and the representative of the industry was asked to explore the possibility of upgradation of existing ETP and STP.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has done plantation in an area of around 01 acres by constructing ridges and furrows. The industry has been advised to clean the said 01 acre land area regularly and properly. Further, the industry also has 02 acres of land area which is not being maintained as per karnal technology. The representative has been asked to get it the said area cleaned and get it properly maintained within 02 months.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">No stagnation of wastewater was observed in the plantation area during visit.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has installed 04 no. of paint booth and 04 electric baking ovens in its premises. However, these were not in operation during visit. Further, no painting activities were observed to be carried out in open area outside the paint booths.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has installed 02 no. of DG sets of capacity of 500 KLD, which are provided with canopies.</span></p>
<p class="MsoNoSpacing" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">From above, it is clear that the industry has complied with most of the observations raised during earlier visits and has done significant improvement in its premises.</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0cm 0.2pt 6pt 0cm; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';"> </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">In view of above, if may approved, varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2023, </span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">subject to the suitable conditions and following additional conditions:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 0.2pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall install separate flow meters on outlet of ETP and STP, within 01 month.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 0.2pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall explore the possibility of upgradation of its existing ETP and STP and shall submit a report in this regard, within 03 months.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 5.85pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 5.85pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 5.85pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the provisions of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, at all times.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0cm 5.85pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The Consent is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0cm 5.85pt 0.0001pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.</span></p>
