The brick kiln was visited by the team of officers of the Board on 19.4.2022 and it was observed as under: -
1. The brick kiln was in operation during the visit.
2. The brick kiln is using agro-based (Mustard based) waste and crushed coal as fuel.
3. The brick kiln has obtained consent to operate under Air (Prevention & Control of Pollution) Act, 1981 which is valid upto 30.09.2022.
4. The brick kiln has failed to obtained consent to operate under Water (Prevention & Control of Pollution) Act, 1974.
Now the subject cited brick kiln has applied for renewal of 'Consent to Operate' under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974. The subject cited brick kiln has earlier deposited adequate consent fee, which is valid up to 30.06.2031 as per new fee structure. Now the BKO has submitted the Rs. 1500 vide no. 70591324 dated 07.10.2022 as NOC regularization fee. Rs 9,000/- vide UTR No. 702775228 dated 31.10.2022. The fee submitted under Water (Prevention & Control of Pollution) Act, 1974 is valid upto 30/10/2019 including 400% penalty fee.
The brick kiln was again visited by officer of the Board on 16.11.2022 and it was observed as under: -
1. The brick kiln was not in operation during the visit.
2. The brick kiln has stabilized the movement area with keri.
3. The industry has maintained plantation in the periphery of the brick kiln. However, three rows of plantation are not maintained.
4. The brick kiln has applied for crush coal as fuel. However, earlier, the brick kiln was found using agro-based (Mustard based) as fuel.
5. The arrangements provided by the brick kiln for domestic waste treatment and disposal was found in-adequate.
As the industry is violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, it has now been proposed to refuse Consent to Operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 after affording the opportunity of personal hearing before Environmental Engineer, Regional Office-1, Ludhiana at E-648B, Focal Point, Phase-5, Ludhiana.
You are therefore requested to attend the above said hearing on 21/10/22 at 11:00 a.m. failing which it will be presumed that the industry has nothing to say and action as proposed above will be taken against the industry.
