Subject:      Application for obtaining renewal of 'consent to operate' under the provisions of the Water Act, 1974 and Air Act, 1981 – M/s National Metal Castings, Bhadla Road, Tehsil Khanna, Distt. Ludhiana. Reference: Industry’s online Application ID 20349931 (W) and 20349925 (A) dated 17/11/2022. It is submitted that the subject cited industry is a small scale cupola furnace unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDHKH/2018/7526473 dated 11/05/2018 and under the Air Act, 1981 vide no. CTOA/Fresh/LDHKH/2018/7526398 dated 11/05/2018, both valid upto 30/09/2022 for the manufacturing of C.I. Casting etc @ 720 MT/Year. Now, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has earlier deposited consent fee of Rs. 9200/- vide UTR no. BARBU22300686762 dated 27/10/2022 as Water consent fee and Rs. 9200/- vide UTR no. BARBU22300686887 dated 27/10/2022 under Air Act, 1981 against the un-depreciated fixed assets of Rs. 11.97 Lacs as on 21/10/2022 as per CA certificate dated 22/10/2022, which is adequate upto 30/09/2027 as per Board’s Office Order dated 29/10/2018 after deducting NOC regularization fee Rs. 700/-, which is adequate. The industry has given the details of increase in its fixed assets i.e. installation of G.P. Sheets & tiles in building and purchase of Gear Motor, Electric Motor, HPS WHT 400, Almirah and Printer. There is no increase in production capacity as well as pollution load due to increase in the fixed assets. Accordingly, the industry was visited by the undersigned on 17/11/2022. During the visit, it was observed as under: 1.        The industry has installed 1 no. cupola furnace of capacity less than 3.0 T/hr, which was not in operation & wet cap is installed as APCD with cupola furnace and is using hard coke as fuel. 2.        The industry has submitted certificate from PSCST, Chandigarh vide no. 266 dated 01.06.2018, which is reproduced as under: "It is certified that M/s National Metal Castings, Bhadla Road, Mandi Gobindgarh, Punjab has installed Air Pollution Control Device on their cupola furnace having melting capacity less than 3T/hr as per the technology evolved by Punjab State Council for Science & Technology, Chandigarh." 3.        The industry has not installed any D.G. set in the industrial premises. 4.        No water is being used in the process; therefore, there is no generation of trade effluent. Whole of the water being used in the wet cap scrubber, is re-circulated. 5.        There is no generation of any trade effluent except generation of domestic effluent, which is discharged onto land for plantation after passing through septic tank.   Further, the industry is located in the industrial area of Khanna. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:                    The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries. It is further intimated that as per Board Office Order no. 244 dated 3/6/2013, the powers have been delegated to the Environmental Engineers of the Regional Offices of the Punjab Pollution Control Board to grant 'consent to establish' / operate under the Water Act, 1974 and Air Act, 1981 for Cupola Furnaces irrespective of its capacity. As the industry being a small scale cupola furnace having capacity less than 3 MT/hour and operated very few days in a month. Further, the industry has already installed its Air Pollution Control Device as the design of PSCST, Chandigarh vide letter no. PSCST/CC/981 dated 02.04.2009. Therefore, there is no need to get the analysis report for granting it renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981. However, the industry may be advised to get monitored stack emissions from any NABL approved lab. In view of above, it is therefore recommended that renewal of 'consent to operate' under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry upto 30/09/2027 with suitable conditions and additional conditions that:  a.        It shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">b.        The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">c.        The entrepreneur/industry shall obtain necessary statutory permissions /clearances from all other concerned departments. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">d.        The industry shall not generate and discharge any kind of trade effluent. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">e.        The industry shall not start wet process without prior approval of the Board. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">f.         The industry shall not install boiler, furnace without prior approval of the Board. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">g.        The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">h.       The industry shall dispose off its hazardous waste to TSDF Nimbua within one month and submit compliance of same to this office. <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">i.         The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain / water bodies. <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">j.         The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. (See attached banner). <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">k.        The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.  <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">l.         The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
