It is submitted that the subject cited industry is a medium scale induction furnace and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FGS/2019/11104643 dated 28/07/2020 valid upto 30/09/2023 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2022/18219999 dated 11/04/2022 valid upto 31/12/2022 for the manufacturing of Round, TMT, CTD, Bars, Flat, Patra, Square, ERW Pipes (without Galvanizing) @ 21 TPH. Now, the industry has applied for obtaining consent to Establish (expansion) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for proposed addition of Billet, Steel Ingot & Bloom @ 229 MTD to the existing production of TMT bars, ERW Pipe, cold roll etc @ 342 MTD under Orange category with requisite documents. The industry has deposited of Rs. 72000/- vide Receipt. No. 368190076 dated 25/06/2022 as NOC fee and Rs. 18000/- vide R. no. 08/5511 dated 18/11/2022, which is adequate for a period of one year as per office order dated 29/10/2018. The industry was granted Environmental Clearance (EC) vide no. SEIAA/2019/717 dated 22/08/2019 under EIA notification dated 14/09/2006 for expansion of the steel manufacturing from existing 1,20,000 to of TMT of Billets, Round Bars, wire, flats, strip by Rolling mill and reheating furnace to 2,00,000 MTA of Billets, steel ingots & Blooms by Induction of Furnace (2 no 12 TPH each) and arc furnace (1x15 TPH) alongwith 1,20,000 MTA of TMT Bars, Round Bars, wire, flats, strip by rolling mill and reheating furnace located in the revenue estate of Village Ambey Majra, Mandi Gobindgarh District Fatehgarh sahib. The industry now has submitted amended Environmental Clearance vide no. SEIAA/MS/2022/896 dated 07/09/2022 in which the industry has proposed to install 1 induction furnace of capacity 39 TPH in place of existing inductions furnace of capacity 12 TPH each and 1 Arc furnace of capacity 15 TPH. However no change has been proposed in the production capacity of the unit w.r.t. Environmental Clearance granted to the industry. As per Board's office order no. 5 dated 3.5.2018, no verification would be carried out by Regional Office while forwarding the case to the officer concerned to whom SCA cum SAC has been granted. Moreover, the industry after obtaining EC, has been visited by this office and has obtained 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and no action against the industry is pending with the Board. Further, as per DTP letter no. 56 dated 17/01/2019, the industry is situated in the designated Industrial Zone of Mandi Gobindgarh as per notified master plan and the proposed expansion is being carried out within the existing premises, therefore, the site is suitable for expansion. No action is pending under the said act as per record of file of this office. Furthermore, as per the guidelines issued by Central Ground Water Authority (CGWA), Khanna Block of Ludhiana District falls in the list of notified area. As this industry does not fall in the list of water intensive industries and only require water for cooling and drinking purposes. Moreover, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under: It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Central Ground Water Authority. However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.    Now, the Punjab Govt. has constituted the Punjab Water Regulation and Development Authority (PWRDA) under the Punjab Water Resources (Regulation and Management) Act, 2020, which is mandated to regulate the water resources of the State for ensuring their judicious, equitable and sustainable utilization and management. The project is complying with the general siting guidelines of the Board mentioned in the policy dated April, 2013 and has obtained EC under EIA notification 14.9.2006 vide no. vide no. SEIAA/2019/717 dated 22/08/2019 and vide no. SEIAA/MS/2022/896 dated 07/09/2022. Keeping in view the above mentioned facts, it is recommended that the consent to establish NOC from pollution angle to install 1 induction furnace of capacity 39 TPH to manufacture of Billet, Steel Ingot & Bloom @ 229 MTD in addition to the production of TMT bars, ERW Pipe, cold roll etc @ 342 MTD, may be granted to the industry with suitable conditions and following special conditions: 1.        The industry shall use clean scrap as raw material and shall ensure that no hazardous or other waste like chemical drums, oil filters, shockers etc. shall be used as raw material. 2.        The industry shall comply with the SOPs laid down for operation and maintenance of APCDs. 3.        The project proponent shall comply with the all the conditions of EC granted to it in true letter and spirit.   4.        The industry shall comply with Punjab Water Regulation and Development Authority (PWRDA) guidelines.
