<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US;">It is submitted that the industry was issued show cause notice alongwith an opportunity of show cause in writing within 07 days.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US;">Now, the industry has given a reply of the show cause notice vide dated 18.11.2022, which may kindly be perused.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US;">From reply submitted buy the industry, it is clear that the industry has not complied with the decisions of hearing held on 29.12.2021, till date.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US;">Subsequently, a complaint against Nahar Group of Industries has also been received through Zonal Office vide letter no. 6495 dated 26.10.2022, alleging that the group is spreading air pollution in the area.<span style="mso-spacerun: yes;"> </span>A copy of the said complaint is attached herewith for perusal. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-US;">Accordingly, Nahar complex was visited by EE and AEE of this office on 10.11.2022, during earlier hours. During visit, it was observed as under:</span></p>

The industry is using coal alongwith pet coke as fuel in the said boiler.</span></p>

It was further noted that the entire floor area near the boiler was lying covered with ash and the ash was seen kept haphazardly all over the area. The pictures are attached.</span></p>

<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';"><span style="mso-spacerun: yes;"> </span>Thereafter, the nearby village lehli was visited and local people were interacted with. During interactions, local informed that there is problem of fly ash in the area and the same was also noticed on roofs of their houses during the visit. The pictures are as attached.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt;"><span style="font-family: 'Bookman Old Style','serif';">From above, it is clear that the industry has not complied with decisions of the personal hearing held on 29.12.2021 and is violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974, intentionally and deliberately. Further, it is also evident that the problem of fly ash is still persisting in the area.</span></p>
<p class="MsoNormal" style="text-indent: 70.9pt;"><span style="font-family: 'Bookman Old Style','serif';">In view of above, it is recommended that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 21.3pt; mso-add-space: auto; text-align: justify; text-indent: -21.3pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry may be issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for stopping operation of boiler of capacity 40 TPH installed in Nahar process house-1, immediately.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 21.3pt; mso-add-space: auto; text-align: justify; text-indent: -21.3pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The application of the industry for obtaining renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, may be refused after affording opportunity before the competent authority.</span></p>
