The industry was granted consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 for production of base fraction oil @ 11.2 KLD, light fraction oil @ 0.7 KLD, Co/Ni/ Zn Cake @ 5000 Kg/day, Gypsum Cake @ 4000 Kg/day and Calcium Molybdate @ 2300 Kg/day dated 20.04.2018 (valid upto 30.09.2022).</span></p>
<p class="ListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-IN" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-ansi-language: EN-IN;">The </span><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">authorization</span><span lang="EN-IN" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-ansi-language: EN-IN;"> under HOWM Rules, 2016 was also granted to the industry on 20.04.2018 (valid upto 30.09.2022).</span></p>
<p class="ListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; color: black; mso-color-alt: windowtext; background: white;">The </span><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">industry</span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; color: black; mso-color-alt: windowtext; background: white;"> was granted passbook-cum-actual user certificate under the </span><span lang="EN-IN" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-ansi-language: EN-IN;">HOWM Rules, 2016 </span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; color: black; mso-color-alt: windowtext; background: white;">for procurement and reprocessing of spent catalyst as mentioned at Sr. 10 of Schedule-IV @ 10 TPD, waste used oil @ 8.8 KLD and waste oil @ 5 KLD.</span></p>
<p class="ListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">The matter relating to unscientific handling, management and disposal of spent catalyst generated from various processes of oil refineries was under consideration of the Hon'ble National Green Tribunal (NGT) in Original Application no. 67/2020 in the matter of "Nathan Choudhary V/s State of GNCTD & Others. After considering the report filed by the Central Pollution Control Board, the Hon'ble NGT was pleased to pass an order dated 11.9.2020, whereby the SPCB / PCC were directed to take action to stop continuation of the violation of Law and remedial action for past violations. Upon examination of the order dated 11.09.2020 of the Hon'ble NGT, the industry was found to be the defaulting unit for procuring and processing 27.39 MT of spent catalyst of category 18.1 of schedule-I of Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016<span style="mso-spacerun: yes;"> </span>without authorization in the year 2019-20. Consequently, the Board vide order no. 11 dated 5.1.2021 has imposed environmental compensation of Rs. 6.0 lacs on the industry in accordance with the methodology of the CPCB. </span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">The Hon'ble NGT vide its order dated 09.04.2021 disposed off the application with the direction to ensure the deposit of financial penalty / environmental compensation as imposed upon the industry for violation of </span><span lang="EN-IN" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-ansi-language: EN-IN;">Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016</span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">. </span></p>
<p class="ListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">The industry was afforded an </span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">opportunity of personal hearing before the Chairman of the Board on 24.05.2021. After hearing, it was decided that the industry shall submit its contentions as above in writing alongwith documentary proof within one week for taking further decision in the matter. </span></p>
<p class="ListParagraphCxSpLast" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">Subsequently, the</span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;"> industry vide its letter dated 17.06.2021 submitted that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0cm 0cm 6.0pt 54.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">i)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">It had purchased spent catalyst through online auction on 16.04.2019 and was not aware about the category of spent catalyst.<span style="mso-spacerun: yes;"> </span>It was no where mentioned in the online auction or in any other document that in which category the above mentioned catalyst belong to. The industry has processed the spent catalyst in accordance with the SOP prescribed by CPCB. Moreover, the industry had no knowledge of the fact that which category such catalyst belong to.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0cm 0cm 6.0pt 54.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">ii)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">The functioning of the industry is to process the hazardous waste into non-hazardous as per the guidelines of CPCB and the industry is working for the same from the date of its establishment and thereby working for pollution prevention and preserving environment.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0cm 0cm 6.0pt 54.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">iii)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">The industry falls in small scale category and not operating regularly for last more than one year due to COVID restrictions and is running into financial losses.</span></p>
<p class="ListParagraph" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">The </span><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">industry</span><span lang="X-NONE" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;"> has now applied for obtaining varied consents to operate under the provisions of Water Act, 1974 & Air Act, 1981. Due to non-deposit of environment compensation of Rs. 6.0 lacs, </span><span lang="EN-IN" style="font-size: 11.5pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-ansi-language: EN-IN;">the industry has been issued show cause notice before refusal of consents to operate under the Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Chairman of the Board on 17.11.2022. In the meantime, the industry has filed an appeal before the Appellate Authority against the order dated 5.1.2021 passed by the Board for imposing EC of Rs. 6.0 lacs. The appeal was heard by the Appellate Authority on 16.11.2022 and the orders are yet to be received.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">During hearing on 17.11.2022, Sh. Mukesh Jindal, Prop. of the industry has assured in writing that <span style="mso-spacerun: yes;"> </span>the industry shall deposit environmental compensation as imposed by the Board consequent to the orders passed by Appellate Authority<span style="mso-tab-count: 1;"> </span>and requested for grant of consents.</span></p>
<p style="margin: 0cm; text-align: justify; text-indent: 72.0pt; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman'; color: black; mso-color-alt: windowtext;">After hearing the Prop. of the industry and officers of the Board, it</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; color: black; mso-color-alt: windowtext;"> has been decided by the Chairman that the industry be granted 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 upto 30.6.2023 subject to the conditions that :-</span></p>
<p style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo2; background: white; margin: 0cm 0cm 0cm 36.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; color: black; mso-color-alt: windowtext;">The consents are valid for obtaining passbook-cum-registration certificate as well as authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016 only.</span></p>
