<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: X-NONE; mso-bidi-language: PA;">It was brought out that </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman'; color: black; mso-color-alt: windowtext; background: white;">M/s Baba Farid Vidyak Society (Regd.) has established </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">educational institute namely "Baba Farid Group of Institutions" at Bathinda-Muktsar Road, Vill. Deon, Distt. Bathinda in the year 2005 in an area of 7.7 hectares having built-up area of approx. 55,000 sqm without obtaining consent to establish (NOC) / 'consents to operate' under the provisions of the Water Act, 1974 and Air Act, 1981 as well as without obtaining environmental clearance under the provisions of the EIA Notification.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">The institute was found violating the various provisions of the Water Act, 1974 & Air Act, 1981 and was issued notices as well as afforded opportunity of personal hearings by the Competent Authority for getting the compliances of the Pollution Control Laws. </span></p>
<p class="Default" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%;">The <span style="background: white;">institution</span> has obtained clarification from State Level Environment Impact Assessment Authority (SEIAA), Punjab vide no. SEIAA/MS/2021/4206 dated 20.05.2021 regarding exemption of Educational Institution from EIA Notification dated 14.09.2006. In the said letter, SEIAA has clarified that as per the copy of layout plan submitted by the institution, total built-up area and plot area of the educational institution is 54,109 sqm and 7.7 ha respectively. Though the built-up area of the educational institution is more than 20,000 sqm, but MoEF&CC vide Notification No. S.O. 3252 (E) dated 22.12.2014 has provided exemption to the buildings of educational institute including universities from obtaining prior environmental clearance under the provisions of EIA Notification, 2006 subject to the Sustainable Environment Management. </span></p>
<p class="ListParagraphCxSpFirst" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-bidi-font-weight: bold;">The institute was </span><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">issued notice u/s 33-A of the Water Act, 1974 with an opportunity of personal hearing before the Chairman of the Board on 07.04.2022, wherein amongst other decisions, it was decided that the institute shall not carry-out any activity in the additional land without obtaining statutory clearances under the Pollution Control Laws including obtaining of environmental clearance under the EIA notification 2006 (if applicable).</span></p>
<p class="ListParagraphCxSpLast" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 71.5pt; line-height: 150%;"><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi;">The institute thereafter applied for obtaining consents to operate under the Water Act, 1974 and Air Act, 1981. During visit on 04.05.2022, it was observed that the institute is located within 100 meter distance of a brick kiln (air polluting source), sharing 750 ft. of a common wall. Availability of 15 meter wide space between the institute and the brick kiln is only for 613 ft. length. For the remaining 138 ft. length; only 3 meter wide space is available for plantation purposes and presently, no green belt has been developed in the said area (138 ft. x 3 m). Consequently, t</span><span lang="X-NONE" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: Raavi; mso-bidi-language: AR-SA;">he institute was issued notice before refusal of consents to operate under the Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Chairman of the Board on 5.7.2022, wherein amongst other decisions, it was decided that the applications submitted by the institute for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 be returned and advised to re-submit the same alongwith requisite CLU permission / approved building plans.</span></p>
<p class="msolistparagraph0CxSpFirst" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">The institute submitted written reply vide its letter dated 13.07.2022, wherein it was stated that at the time of establishment of old land site in the year 2004-05, CLU and approval of site plan & building plans was obtained from the then concerned Sarpanch of Gram Panchayat, Deon (Bathinda). District Magistrate, Bathinda, vide its certificate dated 18.04.2011 has certified that Gram Pardhan (Sarpanch) was Competent Authority to approve the building plans in the rural area in the year 2004-05. The institute was visited by the officer of the Board on 30.08.2022 and it was observed that the institute is located within 100 meter distance of a brick kiln (air polluting source), sharing 750 ft. of a common wall. Availability of 15 meter wide space between the institute and the brick kiln is only for 613 ft. length. For the remaining 138 ft. length; only 3 meter wide space is available for plantation purposes.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';"><span style="mso-tab-count: 2;"> </span>In view of above, the institute has been issued show cause notice before refusal of consents to operate under the Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing on 17.11.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-bidi-font-family: 'Times New Roman';">During hearing, the Chairman of Baba Farid Vidyak Society (Regd.) submitted written reply of show cause notice issued and the same has been taken on record. He stated that at the time of approval of site / building plan on 7.1.2005 from the Sarpanch of Gram Panchayat, Deon, the area of the institute was 19.2 acre and the Gram Panchayat / Sarpanch was competent to approve the building plan in rural areas as already confirmed by the District Administration vide letter dated 18.4.2021. Therefore, they have applied for obtaining consents to operate for an area of 19.2 acres only. Further, the area of institute has been increased to 41.41 acre and they have also applied to the Deptt. of Town & Country Planning for CLU as well as approval of building plans. He further stated that green belt of adequate width has been provided towards the brick kiln and attached copy of layout plan showing the same.</span></p>
