<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Earlier, the promoter company was granted consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2020/11773370 dated 08.01.2020 which was valid upto 07.01.2021 for development of 91 plots (364 Dwelling Units), 17 shops under the name and style of M/s Splande Developed by Green Home Builders, Zirakpur, District SAS Nagar in a total area of 24872 sqm (29736.70) subject to certain conditions mentioned therein.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The project proponent had earlier proposed an STP of capacity of 200 KLD based on FAB technology to treat the wastewater generated from STP and the treated wastewater shall be utilized for horticulture @ 9 KLD in an area of 1968.708 sq. yard and 189 KLD shall be discharged into MC, sewer. The unit has also proposed the components for the STP which includes Collection tank, FAB reactor, Secondary Tube Settler, Clear water sump, Sludge drying beds.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The above residential project was visited by the officer of the Board no. 06.01.2021 and observed as under:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The above residential project is located on R.H.S. of Zirakpur-Banur National Highway.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent has constructed flats, instead of developing plots at the site for which it has obtained NOC from the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent has not started the construction work of STP at site i.e. violation of condition no. 16 of special condition of NOC granted by the Board i.e. The promoter company shall carry out the construction work of STP at the site, in commensurate with the construction work of the project. </span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent has violated the various terms and conditions of the consents granted by the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The said report was conveyed to Zonal Office vide this office letter no. 279 dated 27.01.2021. Thereafter, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued to the project proponent along with opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 09.03.2021, wherein it was decided as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent shall not carry out further construction activity if it require to obtain environment clearance under EIA notification, 2006.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent shall comply with the conditions of NOC granted to it vide no. CTE/Fresh/SAS/2020/11773370 dated 08.01.2020, which was valid upto 07.01.2021.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent shall get the validity of NOC extended, immediately.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">Environmental Engineer, Regional Office, SAS Nagar shall process the applications of NOC application to be submitted by the project proponent.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company was granted extension in validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2021/15499139 dated 18.06.2021 which was valid upto 25.03.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company applied for consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for the operation of</span> <span style="font-family: Tahoma, 'sans-serif';">Residential Project of 91 plots & 17 shops of which 28 residential plots & 17 shops to be constructed by builder and same was processed through OCMMS.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company had submitted completion certificate issued by M/s Harit Enviro Engineering & Consultant Solutions which is reproduced as under:</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">“This is to certify that we have successfully completed the work of Design, Supply, Installation, Testing & Commissioning of Sewerage Treatment Plant of Capacity 200 KLD at for M/s Green Home Builders for their Project namely of SPLANDE in Zirakpur.</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">The STP has been successfully completed in all respects and handed over to client M/s Green Home Builders on dated 30.09.2021 in good working condition & we will not be responsible for any theft, physical damages of the equipment at later stage.”</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company had submitted compliance report of the previous granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The promoter company had earlier submitted that:</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 1in;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">“Here it is pertinent to mentioned that we are constructing only on 28 plots (112 units) and 17 shops & had got the plans approved for this much construction only, form MC Zirakpur (copies annexed). The total area under construction undertaken by us, i.e., M/s Green Home Builders is 17148.84 sqmt. (approved plans & area detail annexed please), which is less than 20000 sqmt. Rest all the plots are sold off and will be constructed by independent owners and that GHB will have nothing to do with their construction exercise.</span></em></strong></p>
<p class="MsoNormal" style="text-align: justify;"><strong><em><span style="font-family: Tahoma, 'sans-serif';">We ensure the Board that if at any stage, the construction area, to be executed by GHB, seems exceeding 20000 sqmt, we will be bound to obtain EC from SEAC Punjab as per EIA notification 2006.</span></em></strong></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The project proponent had earlier obtained permission from MC, Zirakpur vide letter no. 3104 dated 28.11.2019 for disposal of Municipal Solid Waste and construction and demolition waste. The project proponent has proposed that solid waste to the tune of 735 kg/day shall be generated and it will comply with provisions of Municipal Solid Waste Rules, 2016.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company had earlier obtained CLU from the office of Regional Deputy Director-CUM-Competent, Authority Local Govt. under PAPRA Act vide letter no. CLU/DDLG/PTL/2019/16801 dated 19.06.2019, Hadbast no. 290 and village dayalpura Hadbast no. 289 for an area measuring of 29736.70 sq. yard.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the promoter company was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2021/17343151 dated 17.12.2021 which is valid upto 30.09.2024 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2021/17342775 dated 17.12.2021 which is valid upto 30.09.2024 for Residential apartments with S+4 configuration on 28 plots and 17 no. commercial shops subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">Now, the promoter company has applied for varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the operation of</span> <span style="font-family: Tahoma, 'sans-serif';">Residential Project of 91 plots & 17 shops of which 28 residential plots & 17 shops to be constructed by builder alongwith requisite documents.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The promoter company has deposited Rs. 126500/- vide R No. 839385219 dated 29.10.2021 under Water (Prevention & Control of Pollution) Act, 1974 including Rs. 500/- as FDF and Rs. 126500/- vide R No. 865055445 dated 29.10.2021 under Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as facilitation fee. The consent fee deposited by the promoter company is adequate for three years i.e. upto 10.11.2024 against the fixed assets of Rs. 3944.89 lacs as on 31.09.2021.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">The site of the project was visited by officer of the Board on 18.11.2022. During the visit, it was observed that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The above residential project is located on R.H.S. of Zirakpur-Patiala National Highway.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent has constructed flats / apartments on the 28 plots (plot no. 1 to 28 earmarked on site plan) with S+4 configuration and commercial shops at the entrance of the project.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">The project proponent has installed the STP adjacent to Plot No. 14 i.e. at a place earmarked on approved site plan.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: Tahoma, 'sans-serif';">During the visit, it was observed that construction work by some other promoters on number of plots having S+4 configuration was under progress as well as construction on number of plots has been completed having S+4 configuration. The other project proponents need to obtain the separate consents for the operation of the same. As confirmed from the one of the representative, he submitted as under:</span></p>
