A)   It is intimated that the industry is small scale red category dyeing unit. B)   The industry was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH3/2022/18009142 dated 16.03.2022 valid upto 15.03.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH3/2022/18009146 dated 16.03.2022 valid upto 30.06.2025 for dyeing of polyester fabrics cloth @ 3600 Kgs/day with discharge of trade effluent @ 90 KLD into sewer after ETP & domestic effluent @ 1.6 KLD into sewer along with one boiler of 02 TPH with trima cyclone separator along with adequate stack height & one DG set of capacity 125 KVA with canopy with conditions mentioned therein. C)   Now, the industry has applied for varied ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for Dyieng of Polyster Fabric Cloth @ 5500 kgs/day with trade effluent @ 220 KLD & domestic effluent @ 2 KLD into conveyance system of CETP 50 MLD along with one boiler of 02 TPH with trima cyclone separator along with adequate stack height & one DG set of capacity 125 KVA with canopy. D)  The industry has deposited consent fee Rs. 21,600/- vide UTR no. 000709569726 dated 07.11.2022 under the Water (Prevention & Control of Pollution) Act, 1974 & Rs. 21,600/- vide UTR no. 000709577036 dated 07.11.2022 under the Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the industry is adequate upto 30.09.2025 after deducting penalty. The industry has also deposited Rs. 5400/- vide UTR no. 000709565794 dated 07.11.2022 as NOC regularization fee. E)   Thereafter, the industry was visited by AEE of this office on 11.11.2022 during visit to the area and it was observed that:- <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt .75in;">1.    The industry was in operation during visit. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo2; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt .75in;">2.    The industry has installed 2 soft flow of capacity 450 kgs each & 3 soft flow of 300 kgs each in its premises. 3.    The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation as 240 KLD from its total 12 chamber of soft flow. However, the industry has granted 100 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry is 140 KLD more than the share allotted to it. Hence around 58% machinery of the industry was required to be sealed i.e. 02 soft flow of 450 Kg (6 chambers), which was sealed during visit on 18.10.2022 as per directions of the Competent Authority of the Board. 4.    The industry was visited surprisingly by the officer of this office on 11.11.2020 & found that industry has removed seals from its both the dyeing machines at its own, which was earlier sealed by the Board & was operating all the machines during visit. The report in this regard has been already sent by this office through e-office. 5.    Now, the industry has submitted that they have purchased shares of 120 KLD from M/s Koutton Dyeing House. The industry has now applied varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for discharge of effluent @ 220 KLD into conveyance system of CETP 50 MLD and requested to consider the same. 6.    However, as per the direction has been issued by the Competent Authority vide no. 27541 dated 22.12.2020 to the SPV, Tajpur Road, that no new entity (existing or proposed unit) shall be allocated any shares by managing committee of SPV without the prior approval of the Chairman of the Board. However, in this case the unit is engaged in purchase of share from other unit. 7.    The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP. The industry was also advised to provide the flow meter at inlet water supply. 8.    The industry has installed one boiler of capacity 02 TPH with cyclone as APCD in which rice husk/ agro waste was being used as fuel and adequate stack has been provided. 9.    The industry has got analyzed its stack emission samples from the Board on 24.02.2022 and as per the analysis report results are within limit i.e. 485 mg/Nm3. 10. The industry has also installed one DG sets of capacity 125 KVA with canopy and adequate height. 11. Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level.                          In view of above, it is recommended that consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused and action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be taken against the industry due to non-complying of directions issued by the Competent Authority of the Board, please.
