The periphery areas and open spaces inside the plot should be developed as “Green Belt” areas and at least 75% of the total “Green Belt” area should be used for planting of indigenous tree species whereas the balance 25% can be used for Ornamental trees, medicinal / ornamental plants, ground cover of shrubs and grasses etc. The project proponent shall ensure planting of 1078 trees in the project area at the identified locations, as per proposal submitted, with plants of native species preferably having broad leaves by July, 2022. The size of the saplings to be planted should not be less than 6 ft and each sapling shall be properly maintained. The project proponent shall make adequate provisions of funds to ensure maintenance of the plants for a further period of three years. The species with heavy foliage, broad leaves and wide canopy cover are to be preferred whereas use of water intensive and/or invasive species should be minimized.</span></p>

Efforts should be made to prioritise activities which are directly beneficial for the Environment in preference to those which are of a social nature and can be undertaken under the CSR budget of the company. Upon approval, the CER Plan will be included in and form a part of the Environmental Management Plan (EMP) of the project. The Plan will be implemented within a time period of 2 years.). </span></p>

<p class="MsoNormal" style="margin-right: -36.9pt; text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the industry vide its letter dated 21.11.2022 has submitted reply to the said show cause notice, which is reproduced as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">"We have received notice no. 3112 dated 18.11.2022 from your office regarding refusal of consents. We want to state that we have invested under invest Punjab initiative of Punjab Govt. and taken all the approvals from the Govt. We completely comply with Environment Laws and have never done any kind of pollution. As per EIA Notification, 2006, we have obtained Environmental Clearance and we have already submitted compliance its conditions. And we have complied with its maximum conditions and compliance of very few conditions is under process and we are already sincere about the compliance of pending conditions as guided by your field officers. Present status of compliance of pending conditions mentioned in the notice is as under:</span></em></p>

Further, we assure you that we will complete all the activities as per Environmental Clearance conditions within time that will be granted by your Department."</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">To verify the contents of reply submitted by the industry, undersigned has visited the industry on 21.11.2022 and observed that the industry has installed solar power generation plant of capacity 160 KWh on its shed. Further, the industry has also started work regarding village pond, Chatarpura and it has also constructed 2 no. washroom/toilets in Govt. Primary School, Chatarpura under CER funds. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">In view of the above, it is recommended that the request made by the industry regarding grant of 'consent to operate' may be considered and it may be granted 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 <strong>upto 31.03.2024</strong> with following special conditions:</span></p>
